Let me start by saying I will try and answer your questions with the best answers without violating any of MY contracts. Second, If you are civil towards me and approach me as such I will respond, if you jump on my back with the "mod Mentality" I will skip your question and move on.
First, our marketing firms. I cannot release information on who we use per contract, however, EVERY call is transferred to our QC department where we have the consumer tell us what they are buying and what they were told. After reading these few complaints, I have changed a few questions including we now ask EVERY client if they have been told this has ANYTHING to do with the government. If they respond yes, they are automatically corrected and at the point we let them know they have not joined our program yet and they have every right to back out. We also have terminated 8 employees since my first post for misleading pitches. I will be shifting to in house marketing shortly this should clear up a few things.
Ok as far as the DNC list, all data is targeted double opt in, this means that every number called has been entered on a website either by a consumer or someone entering in a fictitious number at least twice in reference to financial help. Unfortunately  we can not control if little Johny threw a number on a website because he was trying to get something. We do scrub numbers from our data as soon as a client is not interested.
We provide education and tools to use. Our android tablets are preloaded with the customers financial picture and a budget that the customer and their adviser has previously discussed. It also has a calculator built in with their budget so they know "if they can afford something". We do not do what the old "LI" companies did which was call the banks on the customers behalf the vanish. We teach the customers how to do this on their own and we assist them along the way. As for "stealing information", we explain that their are better alternatives to paying off their debt, we explaining that their are banks with 0% offers and IF the client wishes, we can submit an application for them. We then ask the client the information that is required on the application. Nobody forces anything out of them.
Charge backs or disputes, I have been in business for quite some time. I was working under a few other companies and moved on to be on my own. My accounts have been up since November and my sales have been consistent since. I have had no big increase nor do I want one.  Charge backs typically spike in month 2 or 3 , Im in month 5 and the ratios have dropped .5% due to changes we made.
Im still laughing at this deleted media thing. I see you have found a company that in your eyes is fraudulent scamming somebody so you feel its your duty to create an uproar based on practices from other companies. WE ARE NOT CARD MEMBER SERVICES. If I were to catch my employees or any others threatening anyone, they would be fired and I am not sure if I would be able to type this now because I dont think there are computers in prison. I do not tolerate such inhumane acts.
I think I have covered most of what was ask, I will be back in a few days. Until my next rear end chewing, you folks take care and have a good day

Oh my, thats a lot of words for not answering the 1st question!
Glad you enjoy DeletedMedia, though. Too bad you didn't read further and see ALL the recent reported "companies". Removed your comment, guess you complained even though it's all posted right here.

      So, we'll give it another try- FCC 47 CFR, Chapter 1, Subchapter C, § 76.3, Part 64, Subpart L.
Written Do Not Call Policies, affiliates, principles, subsidiaries to be provided to ANYONE whom requests. The illusive document looks something like this from a bunch recently sued by the FTC.
I'd suggest you have one for any impending lawsuits, but you might consider it another "bandwagon" comment.

      http://b2bvb.com/compliance/B2BVB_Business_Policy.pdf

And, how about being registered with the respective Secretarys of State to conduct business by phone. Its the law here, and you do show registered!

It will take more research to decipher your mentality about "Little Johnny", who may have used a debit card, but didn't give, nor want YOU having ANY of his personal info. He doesn't need, or want ANY your "services". What part of that don't you get?

I like your way of thinking. I see your main goal in life is to attempt to dis-credit every company out there based on some bad apples.
As far as compliance issues, I am licensed and registered with ALL of the proper agencies here in Florida.
As far as having information removed, Ever heard of slander? What you are doing is clearly slander and you obviously have no idea what you are talking about. You are using 1 chapter laws to your own twist. You sure do sound convincing however, my attorneys had quite the laugh reading your replies. Post wasnt you want on your facebook page as my attorneys will keep collecting it as we build our case. You are not a consumer who has had interaction with my company, you are a self titled watchdog out to slander my name because unlike the 100's of other companies you have either slandered OR told the truth about, you got a response from me and now you choose to use it as your personal play ground.

Man, you go to all kinds of trouble to avoid TCPA. Hey, if ya don’t want to give it out to the people, then don’t give it out! So, everything’s got to be anti-watchdog? Dare we even ask exactly what those other fired employees where doing? Let me share some real peoples testimony of abuse, threats, extortion, terrorism from chs, similar to my own- since you dont do it, maybe you've never experienced it.

          Barbara, Oct 2011 writes:
"I am fighting lymphoma cancer and do not need to be harassed every day and more than once a day by Card member services. No one seems to have a solution."
March 2012, An Elderly American Consumer writes: “The [male “rep“] cursed, using names a sailor would find shocking. When asked for a supervisor, a different [male “rep”] asked us to repeat the curse words the first said- and began laughing and cussing worse than the first.
March 2012, American Consumer writes this direct quote: (a female “rep” says) “You don’t know who your f-in talking to. I’ll put a  m-f-n noose around your neck.”
So you got re-posted/pasted on face book, and “honest” put in parenthesis. CHS is killing people. Anyway, while im entertaining your attorneys, might as well really get em hooting and laughing, with the U.S. Constitution:
“But when a long train of abuses and usurpations, pursuing invariably the same Object evinces a design to reduce them under absolute Despotism, it is their right, it is their duty to throw off such Government, and provide new Guards for their future security.”
          Therefore,
          “cardholderserices“robo-call-must-stop! Period!

"The TCPA restricts the use of automatic dialing systems, artificial or prerecorded voice messages, SMS text messages received by cell phones, and the use of fax machines to send unsolicited advertisements."

Adj.    1.    unsolicited - not asked for; "unasked advice"

So again, since you keep wanting to hit the TCPA, re-read my previous statement where every call that is made is a phone number that has been entered in at least 2 places for financial education. This is called targeted, double opt in data. Meaning, the majority are wanting help, yes there are a handful of people that do not wish to speak to us, there number has been entered in the past. This is caused by people entering fake phone numbers on websites or people obtaining a new phone number.
Also I understand the aggravation and severity of threats from other companies however, My company does not tolerate nor practice that kind of business.
Please provide SOLID proof that MY company is harassing or threatening the public or be a grown up and admit you are basing your remarks on companies you have read about or experienced yourself IN THE PAST.  I have humored you, now lets see if you really are as honest as you claim to be.

OK, you are absolutely right,- I don’t get all the “in house marketing” stuff you’ve mentioned. There’s no official guide book for the average Consumer on that.  But in an HONEST debate, would like to point some things out.
TCPA is not just about calls to cell phone and fax machines.  It also talks about residential telephones, emergency, & 911 lines, hospital, medical physician, poison control, fire and law enforcement, patient room, health care facility, elderly home. And, about “people obtaining a new phone number”. Century link says (and I get it, may not be true, I don’t know!) that before a land line number is re-assigned to a new customer, it sets idle, and one will hear the message “This number is no longer in service. . “ for 9 months.  Just my opinion, that’s plenty of time for any marketing firm to realize it’s not a valid # to continue calling, no matter where and when it shows up. And lets be honest, the comments elsewhere on this thread began busting your balls last month, and who knows what and where that has gotten.  You went and posted the rebuttals, &  I asked for DNC Policies. From what I gather, you’ve not been the recipient of hundreds of robo-calls month after month, year after year. So, switching gears- perhaps a negative experience can be made positive. Your obviously very familiar with the business. Will you help us average Consumers see how and where the chs robocalls ultimately break down? I respect your developing new a new system opposed to older L1, [and I wont pretend to grasp it all] but I think most folks would agree that we need some solid laws to deal directly with the chs robos. What rule of law changes would you suggest, to both keep your company out of cycles of card member services complaint threads, and stop “robo-rachel” for good?

Im short on time but Im now starting to like your approach and have more respect for you now. Here is the problem with the robo dialer, Most of them are not in the US. The government can go after these companies but cannot stop them because of where they operate. The best way starts right at home, When you sign a letter or terms, read the fine print, see if your info is going to be sold. Also, a new number for those having problems is always a good idea.
My company scrubs all declined calls each night, whether it be MS Jones telling us to go get screwed or mr Jones telling us he is not interested. Why, as a business, would I want to keep that data? It doesnt make sense.
Also, as far as the threats go, If everyone keeps one thing in mind, HANG UP! these losers who can not accept no for an answer know nothing about the person on the other end of the line, there is no excuse for citizens to worry. If you choose to hang up on them and then fear it was your bank, flip your card over and call the 800# on the back of your card just to check.
Nobody should fear the phone, a couple of AT&T badasses should not ruin your day. At the end of they day, they are going back to the projects to live a poor life.
My company charges the high fees because my overhead is through the roof. I dont hire just anybody, I require every agent to be licensed and backround checks along with drug tests every 28 days. My company also carried a very large bond.
I will give you more later, as I said in the start of this reply, I am short on time right now. HAVE A GOOD DAY!

aren't using information obtained through any terms "authorized" by a consumer, either explicitly or even through hidden fine print. They are simply ignoring the law, and hiding from prosecution.  There are even complaints from an IRS employee, with repeated calls to an IRS number.

At this point, there is nothing at all limiting the continued exponential growth of outlaw robodialing from outside U.S. jurisdiction, even though those profiting from the schemes are probably U.S. based.  That simple fact has been born out in the tripling of complaints over the past 2 months, even though FTC supposedly sued and shut down a major robodialer using foreign facilities only about 4 months ago.

Most people have received "Rachel" calls.  I've received 4 or 5 in the last several months, on both unlisted landline and cell phones, but others are reporting receiving several a month to several a week, even several a day, totally ignoring demands to cease.  With the current state of affairs, there is nothing to prevent the phone system from being made unuseable, choked with robocalls, even affecting safety infrastructure like hospitals and medical providers.

This does not mean they can't be stopped, however, only that the current mode of outlaw operation evades the current tactics for tracking them down.

The two points of vulnerability are the pathways through the U.S. phone system, and the money trails back through the payment processors, particularly VISA and MasterCard.  The fraud doesn't succeed without buying phone access into the U.S., probably through VoIP carriers, and it doesn't succeed without running fraudulent charges through VISA and MasterCard.

Both the telecom carriers, and the payment processors, are neglecting their duties to protect the public from this fraud, making short term profits, but with an overhang of potential liability.  The roboscams will continue to grow their scams until it blows back on the telecoms and payment processors, probably with Senate hearings and lawsuits.  There is nothing to stop this trajectory from playing out, so Catastrophe Theory predicts that outcome.

Alright now we're getting somewhere. Also Mr. Sommers comment above confirms what I've been thinking. What your saying is that a new # change [and new owner DNC registration] wont solve getting rid of the robo-rachels? Even bigger question- Given the robos originate outside of U.S. Jurisdicion, Is this where the seemingly ever present “foreign for profit” fits in?

No. Most all operations are in the US. Usually the only thing outside the US is the server or the "dialer". Because the calls are being made from outside the US there isnt a whole lot they can do.
As far as a changing number, that is a 50/50 chance it will fix the issue.
Look, these people are looking for 1 thing when they call, a quick yes or quick no. I understand your phones are ringing off the hook and that is quite annoying. If you answer the call, just politely tell the rep you pay your cards off each month and a lower rate wouldn't help you, then hang up. It really is that easy.
Me personally, I have fun with them when they call my cell phone, Its probably not right, and its probably some sort of cannibalism, But its funny. I know exactly what to say to make them get all excited before I drop them on their head. If its a legit company, im a little more nice. You can usually tell a lot by their tone and voice. If they sound like they have surpassed a 3rd grade education and they dont live next to snoop dog, it may be a legit company and typically are very polite when you say you are not interested.
Loud horns and whistles and such, they dont do anything to the reps, Most of these phones have a noise reduction and volume controlled ear piece. nothing gets any louder that where the volume is set. You want to get back at them, waist their time, Lead them on then just start randomly talking, then answer a question then talk about your goldfish. My guys are trained to let go of a call if that happens, a fly-by-rep is too [***] to understand what is going on.
Hope this has been a little help. I am thinking about passing this info to the thousands of people we have and do help so you can hear a few good stories, on the other hand Im not quite sure how the "hey go defend me" mentality would go over. Choices choices.
Just like the BBB, alls you can do in most places is report the negative, there is no where to go say, "Hey, these guys really helped me out".  Thats why the internet is no longer a credible source for reviewing a business. It sucks for business owners unless you use Ebay or amazon and I cant advertise on either lol.
Until next time, you all take care

I appreciate, and respect that you are busy with many other responsibilities. Surely you see how frustrated people have become. For most, the only encounter with companies under the general category of “card services”, has been at the other end of nasty robo-calls. Or perhaps knowing of someone who’s gotten involved with one of the fraudulent ones. I for one, am grateful to have some positive communication. The now defunct [I think, really don’t care] facebook stuff served it’s purpose to get some in-depth rapport going here. If you don’t mind, for complaintwire, would prefer to remain anonymous. Many elderly residence folks i know are terrified, even though “robo-rachel” just pisses me off, making- as you can tell- meds ineffective, pain levels off the charts, as well as  recovery impossible. With all this going on [we got robo-ed twice in 5 mins, same jerk, last time!] Doctors and other health providers cant hardly get through. Some time, perhaps latter, would like to get your thoughts on some real tangible changes to law.
And, if I may give a rallying call-out; hope you are also liking the sound of- Come on America! We’re better than this! Does it have to take to entire collapse of our financial, and telephone systems, as some comments describe, to finally resolve this?

Ok, so after I typed my response yesterday I was called by Rachel. I wanted to play a game (I know, Im a cannibal but I knew it wasnt my company lol), So I pressed 1. I went through the first little skit then asked them to hold on a second I had another call. I then switched over and 3 wayed the local police non emergency number, explained to the operator I wanted them to record the call and remain quiet, she agreed. I then switched back over and started talking to the rep, I played nice after wasting 10 minutes of his time and told him I was not interested. Persistent little [***] wouldnt shut up so I spoke over him and told him to go back to school and learn the meaning of the word no. Then it happened, he was going to skull [***] my sister and rape my wife then kill me..... HAHAHAHAHAHAHAHAHA I said words I will never repeat in return fire to that kid, I also informed him I knew who he worked for (which I did because of where he said he was located) and proceeded to tell him Id see him in a few hours. He got very quiet and then the  operator chimed in....
This is a problem and I am going to speak to a few of my people to see what we can do to shut down a few of these brute force call centers.   Just keep in mind 1. No one scares me therefore I can have fun 2. These people have no clue who I am. 3. dont try this unless you are prepared for a fight, just hang up. 4. not all companies are like this so please dont judge me. We dont judge a full race because there are a few in jail, lets not do it to companies either.
I will keep you guys updated on my attorneys progress, I think it will be easier for me to do something from the inside. Have a good day and laugh

Well, if I saw a huge pattern here Id be concerned.
When deciding which card you are going to get you really do need to read the fine print, also, only use well known banks. If you have bad credit, take $300 to your local bank and tell them you would like to build your credit with a secured card. Most of those report to the 3 credit bureaus just the same.
I say this because, you will typically find these stories are coming from a sub-prime card. Meaning not a well known bank. Also, pay close attention when dialing a number, most scammers that fish will either change 1 letter in a web address such as Chase.com being the real site they would purchase Chas.com and mirror chases site to get your info. They do the same thing with phone numbers. Just pay attention when your fixing to make a call, We Americans are lazy, we dont like to pay attention and a lot of the foreign scammers know this and take advantage of it.

No, most robo calling in the US originates in the US.
The offshore thing is perpetuated by the players to give the illusion that there isn't anything that can be done.
Reliability & call quality would take a notable hit without even getting into the efficiency aspects of offshore dialing.
US based hacked SIP/Asterisk enabled machines are a dime a dozen & their the driving force behind the robo calls.

Then you and little Johnny should read the privacy terms and conditions of every!!!! site every!!!! time where it says third party info and how using those sites gives them the right "not option" but the right to share, sell, use, your info however they want for whatever they want whether you like it or not!! And if in your crusade to rid the free world of marketing to consumers who are too lazy read what they sign, and really think that everything they buy online is cheaper because it's magic!! And not because those companies sell your info to subsidise the discounts they pass on to you!!! The same ones you think you are entitled to be cause you own a computer.. HAHAHA.. Or maybe you could just accept that not every company that uses a curtain type of advertising medium that others may have misused in the past, is also or has the intention of misusing it as well. Or do you believe everything you see on T.V too!!??
Just because a company isn't 100% transparent in an highly competitive industry where every other company or aspiring millionaire wants to know how you do what you do and how they can rip it off, doesn't mean it's a fraud or scam !! And to all of those morons who ask why don't you have an address that I can come visit where I can walkin face to face? This is why!! Because misinformed uneducated loud mouth people with impulse control issues don't ask ?? They make poor choices and blame other people!! But the most important reason is "cost" it's common sense these are online companies not retail centers!! Cost savings given to customers comes from, among other places the lack of overhead from stocking displaying advertising items that they sell and not paying for man power to run stock face and stand around waiting for you to ask for something they don't sell, it's a business low overhead means less cost to consumers profit ratio. But by all means keep blaming other people for your lack of common sense and so that you won't be bugged by advertising ever again, don't check your mail turn on your T.V or radio or answer your door or visit a website or drive on the free way! And don't answer the phone!! Oh wait just don't answer your phone cause only telemarketers lie right!!?? Oh yea and don't get a speeding ticket!!! Ever!!! Because 85% of all law enforcement entities sell your info from every ticket because it

Your "Mr. James Harden" did in fact lead me to give him all my credit card info so he could call Citibank and discuss what kind of decrease in interest could be given me in exchange for a charge of $1,200.00 that would be charged to another card. I asked him what the percentage of my total loan was and he didn't even know. Isn't this exactly what you said your company does not do...." call the companies on the customers behalf"? I told him I don't think Citibank does "conference" calls after all the other crazy scam warning signs and more "verification" and guess what? He got angry and said business was over. Thankfully! (Sigh of relief!) We wasted over an hour of each other's time. I also changed all my credit card numbers. Lesson learned. Never speak to anyone other than a reputable source and NEVER give out personal info on the phone! Your staff is extremely incompetent and I won't waste an hour of time with any of your callers again.  And I won't tell you my name because I don't want to be scammed.
