Hello,
My name is Marwan Almowaffaq from Yemen. I have a case that I need your advice; I was abused and treated very badly. Your help will be highly appreciated
I will narrate my situation in brief. Please don’t neglect reading it. I need you to fully finish reading it, and advice what should I do about my situation.
On 15 March 2015, I have traveled from Yemen to Moscow for representing Yemen tourism promotion Board at MITT 2015 exhibition, which took place at 18-21 March 2015. The delegation was scheduled to travel back to Yemen on 22nd of March. All the delegation has returned to Yemen, but I decided to extend my stay for another 3 days to enjoy visiting the city, then to return back on 25th of March.
March 25th, I headed to Vnukovo airport in Moscow to return to Yemen. The flight route was; Moscow – Istanbul, Istanbul- Sana. The flight took off to Istanbul at 4:30PM, and then from Transit I continued to Yemen. At 3:30 AM on 26th, the flight reached near to the Yemeni borders, then suddenly the plane turns back and lands in Jeddah airport in Saudi Arabia. What was learned at that moment is that Sana airport was bombed, and we have to return back to Turkey. So the plane returned to Ataturk Airport in Turkey.
After reaching the Ataturk airport I was in dilemma, so I headed to Turkish airlines asking them to send me back to Russia, but they refused, they told me that I don’t have a valid visa any more. They offered me to travel to Algeria, but I do not have anyone in Algeria, where would I stay, how I’m going to sustain my stay.
They treated me with a very careless way, I have some video records shows how they talk with me.
So I have spent around in the airport 12 hours coming back and forth to Turkish airlines office to ask for a solution but nothing positive, then they lead me to the airport police, whom in return held me in airport prison and they started the procedures for deportation from Istanbul by force. They made me sign on papers stating I came to turkey with a valid visa, while I wasn’t traveling to Turkey from the first place, it was just a transfer.
So they held me at airport prison for 4 hours and they were to send me on the first flight to Russia or any other country that don’t have a visa required for Yemen nationalities. I needed to decide immediately.
I had three option ; Russia , Algeria or Egypt, so I decided to travel to Egypt, then at the time of the flight I was escorted to the aircraft with the police officer like if they escorting a criminal, I don’t what crime had I made. I only retrieved my passport at the moment of boarding the airplane. I have also a video while I have been escorted.
So I headed to Egypt on the next flight. After the flight reached the Egyptian lands, I left the aircraft heading to the immigration check, in order to enter to Egypt, but I was confronted with a surprise, Egypt no longer permits Yemeni nationalities to pass to its border without a visa. How could an airline depart to the country that will band the passengers to enter without making sure that it’s permitted or not. Thus, my entry was rejected and I was apprehended at airport’s police again for deportation back to Turkey then to Russia. I stayed under arrest for 24 hours waiting to be deported on the next flight to Turkey, but suddenly an hour before, the authorities in Egypt has issued an exceptional 30 days visa for the arrivals on that day, due to the fact that the new law of visa was only applied at the same day of my arrival.
3:30AM On 27th of march, I had got my visa and entered to the Egyptian lands. When I went to collect my luggage, I found that my belongings were not there, so I reported a claim. Now it’s been 40 days since I lost my luggage.
at the beginning I contacted the Turkish airline station herein Egypt they told me to wait for 21 day for the search process, after the 21 days are over they told me that they are still searching, but I informed them that according to the AITA regulations ,after 21 days are the maximum period for searching, Then they must start the compensation process. So then, they asked me to fill some forms.
A week later, I contacted them again to check the process; they informed that it’s still under process. I tried to explain my situation that I will be traveling back to Yemen and I won’t be able to collect luggage or compensation from there because there is no Turkish airlines station operating in Yemen. The representative here in Egypt gave me contact details for the claims department in Turkey. I contacted them and they asked me to fill the previous forms again. After that, I contacted them after few days explaining my situation that it is critical, but in return, they told me that they would start the search process. I replied, “After 40 days you are telling me that you are just starting the searching process, while you should have already closed it, either by finding my luggage or by compensating me”. They replies in vague reply.
So finally, I demanded a deadline to find my luggage or to compensate me, so I could decide when to travel back to Yemen. However, they just ignored my emails.
After all of this, I had a very terrible journey and I am already in very bad state of mind, I have been abused in Turkey, then in Egypt then I lost my luggage then I stayed over 40 days with luggage. Still the Turkish airline do not care, and they ignore my message while it’s their fault not mine, they made my condition even worse. I barley have money for my accommodation and for the daily expenses, I explained it to them over and over but all that they offered is stalling, vague replies and ignoring my contact.
I hope that you can help me or at least advise me what can be done and what I should do.
