Harrassing phone calls
Complaint
Carol Oliwa
Country: United States
I am receiving Harrassing phone calls at work and at night at home. I will loose my job if they don't stop I have told them not to call me at work several times and they ignor me. I can not discuss these false charges they claim I owe while at work. I would like to see the proof that these charges are even mine. When you charge something, don't you have to sign the receipt? I would like to see my signature on the receipts.

Debt collectors are required to comply with a federal law known as FDCPA.
That law prohibits abusive and harassing collection, including calling you at work if they have reason to believe you cannot take their calls there. Harassing calls, including calling you at work when you have told them not to, are violations, and you can sue them.
It also requires debt collectors to mail a letter within 5 days of initial contact notifying you of the debt, and of your right to dispute it and demand that they obtain proof from the original creditor that you owe it. Doesn't sound like they sent you any letter, for which you can sue them.
Sounds like you don't even believe you owe this "debt", and they are evading your attempts to dispute and obtain validation, by abusive and harassing calls, threatening your job through calling you at work, deceptively failing to notify you of your right under law to dispute and request validation, and directly and implicitly implying you have no right to dispute.
You can find similar complaints against them, here. Notice the numerous complaints of abusive collection, calling and harassing relative, harassing calls to the wrong people that continue even when they are notified they have the wrong person. also note their employees posting on the threads, again harassing people for complaining about their illegal practices.

Looks like they collect for American Express, from some call center in India, with similar complaints of illegal harassment.

When a debt collector evades your attempts to dispute alleged debts, in violation of federal, law, they are basically running a fraudulent "shakedown" racket, by evading FDCPA while using abuse, harassment, and threats to coerce and extort payment without any proof you even owe them. These types of illegal practices often result in defrauding of people who actually owe nothing.
FDCPA allows courts to award actual and statutory damages, plus attorney fees, if you sue them for violations and win. You can sue in your local federal or state courts, and because of the attorney fees, many attorneys will take these cases on contingency. Hand it off to an attorney and let them do what they do, in federal or state court, so your adversary can pay you both. You could sue them yourself in small claims court, but why give them a discount, and possibly miss something? You get better justice in federal court anyway.
You can find a consumer attorney in your state through www.naca.net
Good, that I had recently "True Caller" installed, a call blocker. now both 716 numbers are on that list. I would advise anyone, who is getting harassed on their cells, to do that too.
If you have further problems, get an attorney and sue them.
There's really no reason to put up with this nonsense.
it was very hard to understand him due to his thick east indian accent and he mumbles when he speaks. I had to listen to a voice mail on my phone multiple times just to kinda figure out what he was saying. if they call me again I will lodge a complaint with FTC and attorney general
