Cell phone misrepresented as new

Earlier this year I bought a phone the advertisement for which I have copied and pasted:

Sale date: 16/01/12
When I received it, it came with a message saying that I couldn't update it. After a few emails back and forth, I decided it wasn't worth hassling as I could live without updates.
Then a number of aps stopped working as they were no longer compatible with the old operating system, so I took it to a phone shop who said they could update it.
They then sent a report saying:
Repair attempts failed. The PCB has a slight bend in it, the handset has previously been
worked on by a 3rd party & been tampered with there are small burns marks on the
charging port area. Handset is beyone repair.
When I contacted Wireovia they told me that it was too long ago. When I emailed them their advertisement and suggested that they had sold me a product that was not as described, they did not answer.
I am very annoyed and would like some advice about 2 things:
- What can I do to get my money back? and
- How can other people be alerted to the unethical practices of this company?
