Beginning in Jan.2011 BOA misapplied my mortgage payment and placed it in Escrow. I send my payments via on line through my personal bank a week to 10 days early so that payment can arrive on time. I'm told I am sending it too early and throwing their system off. However,the bank has misapplied my payments and sends me a statement each month indicating I am late and attach a late fee. I go through numerous departments including speaking with Managers and Supervisors assuring me the problem will be corrected within 24-48 hours. Here it is May and I still am in dispute with the bank and nothing is resolved and no one seems to know what they are doing. I am told to call back 3-5 days and check my status....... surprise the issue has yet to be corrected. I have contacted the State Bank Commissioner in Dover to investigate the problem and informed BOA I plan to go to the Media and provide everyone's name and ID# that I have spoken with. I have never dealt with such incompidant people in my life. Does anyone know where I go from here?

    I have had the exact same problems and more.  I also send all payments via online banking.  Every time I receive a notice that my escrow is short, I send in the payment.  They misapply the payment and then I start getting calls from their debt collecting arm.  I call customer service and they tell me they will fix it.  They don't.  I speak with supervisors who tell me they will fix it.  They don't.  The first time this happened was December of 2009.  I called numerous times over a period of 5 months before it was fixed.  Each time, the person told me that they could see what had happened, how it needed to be fixed and that it would get fixed.  It took 5 months for that to happen.  It happened for the second time a couple of months ago.  I finally spoke with someone in the Payment Research Department and they fixed it.

    Then, last night I got a call from their debt collecting arm telling me I had missed a payment.  It turns out that they took my regular monthly mortgage payment and misapplied it to principal and listed my account as being behind with no payment received at all.  Of course, they have no explanation for how this happened and. of course, they are telling me that it has been fixed.  We shall see . . .

    I have been a homeowner for 14 years and I have never dealt with this level of incompetence from a mortgage company.  I am going to submit a written complaint to them requesting that they sell my mortgage and I am also going to lodge a complaint with the Attorney General's consumer division.

      You should also file a formal complaint online with the office of the comptroller of the currency. They will the route your complaint to bank of america. Written explanations must be sent to Washington DC and yo yourself. You will receive a formal complaint id for each complaint you file. Keep filing the complaints to Washington DC.

      I have had the same problem with my mortgage and discovered a hole lot more is going on. I have been looking for more people who have had this issue in hopes of taking them to court. I would be very interested in speaking to anybody with this problem as iam sure its a breach of contract and misrepresentation, iam going to give my number in hopes I can get a few more people to start a class action. they have screwed me so bad that iam in jeopardy of losing my home. my name is tracee my number is 619-715-4458 please call or text. please please contact me asap..

    When you have a problem with "losing" a payment, document it through a RESPA dispute, IN WRITING, mailed ceertified to the RESPA dispute address from your statement or loan docs.  

    They are required by federal law to respond to RESPA disputes in writing themselves, within a statutory period.  Should you have further problems, your copies of your disputes combined with your certified proof of mailing and the USPS verification of delivery provides a paper trail of your sending them as well as what the specific dispute issue was, and if they don't respond timely, file a complaint with HUD backed up by your documentation.

      File a formal complaint with the office of the comptroller of the currency in Washington DC. The will give you a file is number. Keep filing complaints with this office. By law they have to respond to the comptroller and to yourself. Then file complaints with your senators, state reps, and your state attorney general's office.

      My husband and I have never missed a mortage payment with Bank of America. We are watching TV and this guy gets out of his car and starts taking pictures. We asked what ar you doing? He says, you missed at least 2 mortage payments and we were told to take photos of your home. My husband and I looked at each other and clearly said this has to be a mistake, as we make our monthly payments. Sure enough, we call Bank of America and they said we missed 2 payments one in 2010 and one in 2012. No one never called us saying were late, we never look at our statement because we pay the same amount every month. We do not have our recepits as we pay cash and they were missed palced. They SCAMED us big time for 2 payments. Thank God, we have a saving account and ran to the bank the next day and paid the 4,300. Now, I am still figthing them to get our money back and figthing them for late payments. I have not pulled our credit to see what damage has been done as we cash and carry. And to top it off... they sold my morgate as of June 1st 2013.

      File a formal commitment complaint with the office of the comptroller of the currency.  By law they must reply yo them and also yo you. Keep filing complaints until you are satisfied. Every time you file the comptroller will send you a complaint id number. This can all be done online with ease.

    I have had massive fraud with Bank of America. They did not apply some of my payments at all, it was like I was sending them free money. Once I got an attorney, they posted 3 payments on the same day. They embezzled money from my escrow account and so on. I also went through hell regarding a loan modification. Quite honestly, no one should expect a loan modification from Bank of America because there is none. It is a trick to make you default and take your home. They make much more money that way.

    They could care less if you are dying, got an operation, lost your job or any other unexpected inconvenience that might happen in your life. Do not fall for their traps. This is called F-R-A-U-D!! They need to be exterminated like a bad roach infestation that has corrupted this country's economy.

    They are committing widespread fraud. When you "mislead" millions of people to believe that you are going to help them and even make them miss payments in order to get a loan modification, that is called fraud:  http://en.wikipedia.org/wiki/Fraud.

    I am not sure if you have filed a complaint with your Attorney General and the OCC regarding this fraud. This is a starting point. I highly suggest that you eventually file a lawsuit against them because they have every intention of making you life a living hell like they did to me. I was also targeted. These criminals need prison and nothing less. Let them whine all they want after they have fraudulently made huge amounts of money off of the backs of helpless homeowners.

      I filed two complaint with the office of the comptroller of the currency and with my congressional reps and state attorney general's office. The fight will continue. I have God on my side!

    I have had a similar problem.
    In July 2010 I was fully paid up, after a couple of months of being behind, due to unemployment. Then, July 30, 2010 I paid via online bank and Bank of America aplied to the ALREADY PAID July payment.
    MY PAYMENT WAS MEANT FOR AUGUST 1, 2010.
    For one year they have sent me late notices and occasional foreclosure threatening letters. Last week they sent a mod guy to my house.  I do not need a mod!! I am fully paid up!
    I filed a complaint with the MA Attorney General last week but I have a feeling since this is not a mod issue, they might not be able to help me.
    And I avoid their collection calls - nothing but rude, extremely young people with hoodrat accents telling me "You gotta pay."

    Did you ever receive a resolve?  I am having very similar issues dating back to two months of misapplied funds in October / November 2009.  While they denied my loan modification - they never reconciled my account and left my account with a delinquency of two months of payments.  I am currently in my fourth hour today on the phone with BOA.  In the two years of "review" my credit history has taken a beating and yet they promised that it would resolve itself once the modification review was finalized.  Last month - they called and said that it had been denied and my mortgage statement continues to show a delinquency of two months. Zero Coupon department says that it paid out to the investor therefore there are no funds to move. I could care less who it paid out to and when - I just want my account to show that it was paid and all fees and late charges that were assessed because of their misapplication to be removed.  

    After 4 hours - my call was disconnected - so here I am starting over for the second time today.  I have sent two years of both bank statements along with copies of cancelled checks per their request and still no resolve.  I am now back on the phone with Zero Coupon who insists that it is an MHA matter and last week - MHA department said that my account was clear and that zero coupon / payment research should be able to fully reconcile my account.  Do you have any recommendations?

      File a formal complaint with the office of the comptroller of the currency in Washington DC. This process is online, free and unlimited. You can file a complaint every time you do not get what you deserve. Contact your state reps and state attorney general's office.

    We had Countrywide - problem 1 - who modified our account in January 2009 in the midst of selling our loan to Ocwen - problem 2 - In September of 2010 I received a letter from Ocwen that Bank of America would start servicing our loan on October 13, 2010 - they finally loaded our information or "boarded" it on November 13, 2010.  Three days later, I received a phone call that I was $10k behind in payments because I had not paid in almost 2 years (the time that our account was with Ocwen).  The problems stemmed from when Bank of America took over our loan - instead of giving us a Bank of America account number, they reactivated the Countrywide account number from December 2008/January 2009 - that was sold to Ocwen.  I have spent hours on the phone with Bank of America, even all the way to the Customer Advocates in the President's Office - What a JOKE!!  I have now had two different attorneys working on this and they are even to the point of saying do whatever the bank wants just to clear it up and go from here.  I have paid my principal and interest every month.  I have not sent them escrow because when I do, it never goes to my escrow account.  They tell me that I didn't send in the full amount even though I had proof that I did.  So now, they apply my money/payment however they want to apply it, usually to a Partial Balance, then they add it back in, take it back off, move it here, then move it there.  By the end of things...they have moved, shifted, "borrowed", so many times, the money just seems to disappear and yet again, they are telling me I've missed another payment.  They are now trying to say that the last year's worth of payments I have made were applied to the two years payments from the time that Ocwen owned/serviced my loan.  Two years when Bank of America didn't even own my loan.  I have every single piece of paper, proof of what is going on, copies of transaction histories, etc..etc.. but still according to them I am in the wrong.

      File a formal complaint with the office of the comptroller of the currency in Washington DC. It I an easy online process. Keep filing complaints with them then file complaints with you congressional reps, your state reps, and your state attorney general's office.

    I have had the same experience and am trying to figure out who to contact to have the issue resolved!  Bank of America bought our mortgage loan from Huntington--I would NEVER go through BoA if given the choice.  I have been arguing with their incompetent employees for over 2 years for misapplying a payment I sent in July, 2009.  It is now December, 2011.  This has been the most frustrating experience and a complete waste of my time and energy to resolve their mistake!!  They applied my payment to the principal instead of the payment and since doing so, the records have snowballed to monthly missed payments and late fees.  I had to send them my personal bank records showing every payment I made and on time--and they still have not resolved the issue.  It is riduculous and I need to know the names and addresses of who to send letters to in order to bring this to someones attention who is competent enough to see the issue and resolve it.  CSR's and payment research personnel have been worthless!  They told me the issue had been resolved in November of 2009 and it never was!  Now they tell us it is too late to resolve anything because they have already reported their earnings to their investors from 2009.  This is their fault!  They have my money!  They have missapplied it! Please contact me if anyone is looking into a lawsuit against them!
