This company said that only $1 for diet pills plus shipping. I paid, and within a couple of days $58.93 came out of my account. I called my bank and they said that nothing could be done. Stay away from this company.

    Your bank is wrong.

    You only authorized $1, they took $58.93.  The difference was an unauthorized fraudulent charge.  

    Request that your bank close this account number to prevent future fraudulent charges.

    File a police complaint against Momentum Direct for ACH fraud, and submit a written dispute to your bank under Reg. E requesting that they reverse the unauthorized charge.  Send that dispute to the dispute address indicated on your statement immediately, and make sure it is sent within 60 days of the statement date of the statment showing the fraudulent charge.  Mail it certified, return receipt requested, so you have proof of when your bank received it.  

    Include copies of the many on-line fraud complaints against Momentum Direct with your complaints to support that this company is intentionally engaged in extensive ACH fraud.

    Request a fraud affidavit from your bank, fill it out, sign and notarize it, and send it to them.


    If your bank does not accept your complaint, file a complaint for violation of Reg. E against your bank with the Office of the Comptroller of the Currency, responsible for regulating your bank's legal compliance.  Send a copy to your bank's CEO or regulatory compliance officer.

    It would be wise to also open a new checking account at a different bank, if this one won't look after your interests.

    You may also want to include a copy of their BBB report with your complaints.

    Note that most of their complaints are in the categories of "Refund or Exchange Issues", and "Billing or Collection Issues", consistent with the many consumer claims of deceptive offers or charges.  

    Also note that BBB claims there are 48 pending complaints, and that mail has been returned from each of the 4 addresses they have for the company.  This is their understated hint to beware, as they almost never include pending complaint counts in their reports, usually limiting them to the results after the company has had time to respond.

    I found this report written by inveras in Digg 09/2008.  This should end Momentum...

    "A Harris Country District Court issued an asset freeze and temporary restraining order prohibiting Momentum Direct LLC  and its owners Robert B and Christopher M Jones from making unauthorized bank account withdrawls from customers who attempted to cancel their orders."

    As of September 2008, The Attorney Generals Office was seeking up to $20,000 per violation and up to $250,000 for victims over 65 years old.

    I'm researching the outcome and will post when I found more information.

    Online Weight Loss, Skin Care Retailer Agrees To Cease Unlawful Conduct
    Momentum Direct failed to cancel orders, withdrew unauthorized funds from bank accounts

    HOUSTON – Texas Attorney General Greg Abbott today resolved the state’s enforcement action against online weight loss and skin care products retailer, Momentum Direct, L.L.C. Last September, the state charged the defendant with unlawfully shipping unsolicited products to customers, failing to cancel customers’ orders and debiting customers’ bank accounts without their permission. Under today’s agreement, Momentum Direct and its owners will pay $150,000 in restitution and remain subject to an injunction that prohibits similar unlawful conduct in the future.

    Momentum Direct has already paid $100,000 in restitution to its customers. With today’s agreement, an additional $50,000 will be made available to compensate purchasers who were harmed by the defendant’s unlawful conduct.
