Not Wendy Pico

The RH Group has called both my house phone and my cell phone leaving intimidating messages for someone named Wendy Pico.    The first time I assumed it was a legitimate wrong number and politely called them back to say that this was not Wendy's phone number.    I don't know how they got both my numbers and the wrong name or whether there is any such person that actually owes someone money, but I think that it is a scam and wanted to add to the list of complaints.    If I can figure out a way to sue them for harassment I will!

    If they keep calling...
    tell them to cease, and file complaints with FTC and the NY AG.  They have a history of complaints reporting fraudulent collection attempts.

    Fraudulent "debt collectors" also often engage in other forms of FDCPA violations, typically harassment and abusive collection.  Increase their complaint numbers.

    These guys...
    ...have a history of ignoring cease and desist/you've-got-the-wrong-number letters.  Go ahead and try the letter route if you don't mind throwing away the money you'll spend on sending these letters certified (it's not free) but in the meantime - there's a very good chance that those letters get filed in the circular file unopened and unheaded - start the complaint process.  File a complaint with your AG first and foremost - you can contact the NY AG if you want, but it is in your best interest to go to your own state's AG first.  Your own AG can tell you if RH is even able to practice business in your state or not (if they are calling you where you live and/or work, they are doing business in your state) and your own AG is obligated to advocate for you by taking your complaint and contacting, on your behalf, RH Group.  New York's Attorney General can't tell you what businesses are able to operate in your state (unless your state happens to be New York) NY's AG is under no obligation to work on your behalf.  It's fine to contact NY's AG, but you really must contact your own first.  And don't hold your breath on those letters.  And, please, if you are strapped for cash, don't even bother with the certified mail.  I'm 100% certain, from my experiences working with legal aid clinics, that it will be a waste of time and money anyway.
