My annual membership dues are automatically paid via a credit card payment every year, but I still get "Restart Your Membership Today" e-mail notices from Bally Total Fitness even though my membership has been renewed and was just recently paid a month ago.  Additionally the e-mail advertises that I can renew my membership for $99.00 even though my annual membership renewal is less than this. These e-mail messages are annoying at a minimum and if one is not paying attention to the automatic  membership payment on his or her credit card, an individual could potentially end up paying an additional $99.00 above the normal membership payment that's already been debited to the member's credit card account.

    Bally's has a long history of deceptive billing and renewal notices.  They recently settled with the Texas Attorney General over similar problems.

    If you are getting deceptive bills from Bally's or any company, file complaints with FTC and your state Attorney General.

    Bally Total Fitness Corp. mailed fake bills to former members

    AUSTIN – Texas Attorney General Greg Abbott today charged Bally Total Fitness Corp. with unlawfully attempting to mislead its former customers into paying “past due” membership fees they do not owe.

    Bally Total Fitness Corp., based in California, operates 24 fitness centers in and around the Dallas, Houston and San Antonio areas. An investigation by the attorney general’s office revealed that between summer 2009 and March 2010, Bally mailed more than 11,000 misleading “past due” notices to former members in an attempt to encourage them to rejoin their former gym. The notices created the false impression that former members had outstanding dues that needed to be paid.
