Not honoring end of contract

After 3 years of bank drawn payments, and honoring our conract with this comnpany, they try to charge for 5 months extra service. We moved from the address of original service in Feb 2007 and continued our payment committment until our contract was up in July 2007. Despite the end of terms, they continued to try and charge us. When we asked for explanation, they said we needed to send a signed letter of cancellation to a long distance fax number(972-620-5553) - of course they don't want to make it easy. We sent the letter in August but just recently within the last month found out that they did not honor the cancellation notice because the signature did not come through on our original letter. When we called to clear it up they refused to let the unwarranted charges off unless we re-signed with them for another 3 years at our new residence. These people are crooks - I have re-sent the letter Dec 2007 and they threatened to ding my credit if I did not pay for a service at a residence I have not lived at for almost a year. We held up our agreement - when did it become the corporations decision whether or not we want to continue service?? Our contract was up, then we had to jump through flaming hoops to cancell it. Anyway, I can't find any other fax number to send my letter in hopes of finding someone in the Monitronics company with some morals.

We were approached by a salesman from Platinum Plus at our door about a year and a half ago. Note that our neighborhood has clearly marked signs saying "No Solicitors". They convinced my wife that we were getting a "free" alarm system *because* we were going to be the first on the block to sign up, and would put a sign up in front of our house for a period of one year. After that, we were told we would be free to cancel or change monitoring services. When we were called back by a representative from Platinum Plus (I think) to verify the agreement, I reiterated that policy - we may cancel after one year or change monitoring services. Of course, Platinum Plus sold the contract to Monitronics, who apparently have no record of my phone call and view the contract differently. What we were told verbally, what I agreed to in a recorded conversation with Platinum Plus, and what Monitronics is trying to hold us to are two different things. First of all, by claiming that we were getting a "free" alarm system installed because we agreed to put a sign in front of the house seems like a pretty solid claim that any ensuing agreement with a monitoring company only pays for the monitoring service - NOT amortizing out the cost of the alarm system and installation, since advertising for them is worth money in hoped-for additional sales in our neighborhood due to the sign we put up for them as part of the agreement. In other words, we got an alarm system installed that was paid for in advertising.

So, we were mislead - apparently - as have been many others. Just do a google search on "monitronics scam". I'm sure there are good people working for the company, and maybe it's even their corporate intention to "do the right thing". But, if so, there are processes and standards they are going to need to work on - foremost among those is their dealings with subcontractors and sales people. They need to make sure that there is no possibility that misunderstandings take place, that it is perfectly understood what is being sold, what is being given away "free", and what putting a sign in front of ones' house "buys". They also need to make sure that the salesperson states in unequivocal terms:

    - You will be held liable for 3 years for monthly payments of $xx.yy, totalling $x,xxx.yy
    - The amount financed pays for ____ ____ ____ (product and/or service).
    - You cannot cancel this contract, but can pay off the total early.
    - You must cancel in writing after the initial period

These items were not made clear to us, were misrepresented, or outright lied about.

Due to the agreement I made verbally on the phone, the misrepresentation of the salesperson, and having held up to my end of the bargain I made with the salesperson (prior to our account being sold to Monitronics), I have cancelled the agreement myself, asked them to stop monitoring my home, and stopped paying Monitronics.

    Bill In Atlanta
After years of being with Monitronics, I upgraded my alarm system with another company and cancelled my contract with Monitronics. I paid my bill in full and 3 months later they tried to extort me for another months monitoring. I refused to pay it and they sent it to collections. The collections agency put it on my credit report. I called the credit agency and told them if they would remove the listing on my report I would pay them. They said that they would not remove it so I told them to go Screw themselves and I would file a complaing with the BBB and the Credit Commission.

I hate Monitronics. I'm counting the day when my contract is up which is next year 2013 and I'm going to write them and cancel my account.  They can't not renewal a contract without your signing again and they can't keep the contract going or force you to pay a bill.  I will be sending this letter certified mail and keep a copy of the letter and request a signature card to make sure they received it.  I will call after a week to make sure they got the letter and if they give me a hard time then I will not hesitate to send all information to my AG in my state and I will have an attorney fire off a letter and I will notify the federal government of their practices. I will not take no for an answer.  I will not be bullied into staying with a company that rippers people off.  I CANT WAIT TO GET RID OF MONITRONICS. THEY SUCK BIG TIME ! ! ! ! ! ! ! ! ! ! ! !

You can tell from the tone of some of these emails that the writers are not able to choose words carefully, so you really can't expect that they would be careful and courteous when it comes to signing or breaking agreements.  After all this complaining, learn something folks...read every word before signing your name to it...ask questions.  Do not sign anything that has terms and clauses you cannot live with.

Ok so your right you should read the contract and understand it before you agree to it and sign it. I will say however that is not the general issue here. The issue is the company is not honoring the contract and is using deceptive practices.

    Monitronics Customer : 36-Month Contract
    | 1 reply
    Hello All,
I'm providing a step by step including a Service Cancellation Template Letter that I will be using to mail to Monitronics on Monday August 12th, 2013.
Today is Sunday August 11th, 2013 - My first name is Phillip and I own a residence located in Southern Califorina.  I am in no-way affliliated with or do business with any of the companies mentioned or contained herein.  I plan to discontinue service with Micronics and upgrade my Home Alarm System to a Smart Screen Home Alarm System from another provider at the end of current contract period.
The provider change is due to the simple fact that a Micronics Sales Representative or Customer Care Representative has NOT followed-up on my account since the Home Security Installation back in 2010, not even one occurrence in the past 33 months.

    - Summary of Montronics Home Security System
In October 2010, two young men who were excellent representatives of Fist Defense Security (FDS) and Monitronics arranged for the installation of a Monitronics LynxSIA Plus Security system equipped with a Honeywell GSMVLP 2-Way Voice module.  Again, the installation was provided by a Regional Monitronics dealer out of Las Vegas, Nevada - First Defense Security, Inc. (877) 202-1796  https://www.1stdefensesecurity.com ]
The Monitronics Home Security System was available for a single payment purchase price or with a Monitronics 36-month contract that included 24-hours by 7-Seven days a week by 365-days a year Alarm Monitoring.

    - Summary of the Initial Install and Monitronics Contract Review
The Regional Dealer Rep from FDS provided a 36-Month contract that was fully read with due diligence and signed by myself. I have achieved due diligence as a corporate professional with over 10 years of corporate contract negotiation experience from draft to wet signatures by principles of multi-billion dollar US Corporations (Fortune 1000). I am compelling you to agree and understand that I always pay careful attention to detail in regards to contracts. And, therefore;  I am asking that you trust this process will be flawless from the homeowner/consumers side of the table.
The system has worked as advertised with very little maintenance required with the exception of re-securing the AC Power Adapter for the LynxSIA and  moving a couple of sensors with the assistance of well-trained Monitronics Technical Support Reps (855) 422-4767 who assisted with the re-location of the door/windows sensors due to a complete home re-model that is still in-progress.

    - Summary of the Required Next Steps
The first payment for this service was October 8th, 2010. And, therefore I will need to call Monitronics Customer Care (800) 447-9239 [http://www.monitronics.com/home/support/contact-us]
During the call I will confirm the 36-Month contract that I signed with the two boys from Utah representing Defense Security (FDS) (877) 202-1796 [www.1stDefenseSecurity.com] and Monitronics will end October 2013.
On Monday upon arriving at my office/work I will call a Monitronics Customer Care Representative at (800) 447-9239 to confirm the contract information, mailing address and fax number. This call will occur between the hours of 8:00 AM and 6:00 PM PST and upon completion of the call I will have all the details I need to complete the template letter that I have attached below
According to the companies webite [http://www.monitronics.com/home/support/contact-us]

I am in the process of canceling our service and I am being berated by your sales rep on how you all's service is better and how difficult it is for me to just cancel.  First off, we are not going to another service provider, we are doing our own internal monitoring.  Second, the alarm was tripped a month ago and nobody ever called or notified anybody of the incident.  Finally, all in all no we are not cancelling due to poor service or high rates, but if you people continue to push me about cancelling I will have no problem pointing out the short comings of your company on social media and the BBB. CANCEL!

    I hate them
I am dealing with cancelling them now.  I only have them because I signed a contract with an installer and didnt realize the underlying monitoring service was Monitronix.  If I had known that, I'd have never signed with them.  Why?  Because I had monitronix years ago.  I had a 2 year contract back then.  20 months into my contract, I had a roommate who let the house get smoky 2 times in one week and the alarm sounded.  No emergency vehicles came though.  I called monitronics and we determined the service wasnt working.  They sent out a repairman who told me that the alarm was never riginally connected to the telephone.  So, for 20 months I was paying for nothing.  I told them to cancel my contract or refund my money for those 20 months.  They refused both saying it was my fault for not testing their system.

Monitronics refuses to except my cancellation. My original agreement was with Devcon (Monitronics bought the contract) and on section 2.7 it states I am only responsible for 25% of what is left on the contract ($215.58) of which my new alarm company will pay. Monitronics continues trying to get $862.33 from me. When I call and ask to speak the supervisor he says they will honor this but I never get a revised statement. When I call to check on the new statement they say I owe them $862.33.  I ask for the supervisor again but he will not return my call. So I now have a call out to another person, but I'm holding my breath, it's been several hours now. These people are nothing but crooks they can't even honor there owe contracts let alone return a call.

    Frustrated
The person  you are billing is deceased, I contacted you in Jan. after her death you said you needed a death certificate. You were told it had not been given to us yet. I have spoken I believe to everyone in your company. When the certificate came in I made a copy and sent it to the address I was given. A few weeks went by you called and I went thru the whole thing again, you said you never recieved the certificate, I sent another one same result. On the third try you finally said it was recieved and the service would be terminated and the bill would be forgiven. Well here we are in May and it is still on and beeping constantly. Calling your company is useless as I'm sure this will be too. We have unplugged the thing but it has a battery, funny thou that it dosen't go off at night but starts at 8 a.m.. I just talked to two different people one being tech support who says it will do this till the battery runs down. I want the service terminated NOW! As for the bills Send them to Sunset Memorial Cemetary I'm sure they wilol get it to her.

My husband and I have the same problem, We didn't know we had 5 years of contract with Monitronics, until we called that we want to cancel their service because we're moving to another country. They want us to pay the remaining more than two years bill. Why would we pay for a service that that we won't use anymore? We are willing to pay for any early termination fee, but not the whole remaining  years of contract, we didn't even know they put us to 5 years. I can't go back to work because my husband isn't well, aside from his diabetes and alcohol problem, he has prostate cancer.  My husband should have listened to me not to replace ADT with Monitronics. We didn't have problem with ADT for years, cheaper and it was easy to cancel their service when my husband called them.
