This company has been calling me for  years and harassing me. I finally get a court summons in and it states I have a credit card with money I owe that I never took out. My mother works in Credit Card Collections for 20+ years. I have one credit card and it is through a CREDIT UNION in town. Not a US BANK. And I am paid off on that card.
I called Mary Jane M Elliot's office back for two days just to have an african american woman with a serious attitude problem laugh at me and not help me at all. I called back and spoke to some older man and he had the same attitude. I asked if I could recieve paperwork from the Credit Card agency on what I owed them and any other information they could give me.
He stated "Yeah right, we will continue with our lawsuit against you even if you had statements yourself."
I am on Social Security, No car, No family to take me to court and I have $.09 they can take from me. It seems that they will do anything to steal money out of innocent people's pockets.

    At least the lady you called told you the truth.  They WILL proceed with their lawsuit, and they really don't care whether it's your account, since if they get a judgement, you WILL then owe it.

    They have a record of complaints indicating they try to tag various people with "debts" and obtain default judgements against them.  Complaints including apparently obtaining default judgements by sewer service, which may also be an indictor of systemic problems in their identification of the correct debtor.  They may be filing lawsuits without checking who they are suing, or without even having adequate documentation to show the party they are suing owes the alleged debt, depending on obtaining default judgements in most cases.

    If this isn't your account, you need to demand that they prove to the court that you owe it.  They are also probably violating FDCPA in various ways, so you want an attorney familiar with FDCPA not only to defend you from this lawsuit, but to recognize their violations and countersue them, Since FDCPA allows courts to award damages and attorney fees, that may be the way for your attorney to recover your costs in representing you.

    Called them.... it is a collections agency.... they told me who they are looking for.... Im not that person... they seemed attitude friendly to me and said they would remove my number... lets hope they do... sure have been getting a lot of calls from scammpers on my cell phone lately.  Thinking I should give out the white house number next time these [***] heads call me. Maybe then it will stop.  ROFL.

    I had identity theft and this broad is handling the collections of the referred account  and basically as stated by others they don't care just want money from whom ever they can get it from period!Let the [***] collect the money then sue her!

      FCRA/FACTA provides procedures to deal with fraudulent accounts, and if debt collectors or CRAs violate, you may be able to sue them.  Violations can include not responding within designated times, so they can't just stonewall and string you along.
