July 2, 2009 Vanderburg, Chase, & Associates called me and left a voicemail saying they needed to contact me regarding a Robert Wilson and stated the company name so fast I couldn't understand it Vander....(i have never heard of this person or company.) A male/female stated my name was on his FRAUDULENT papers and I needed to call them back ASAP and they were also looking for this 'Robert Wilson.' I called the number from the voicemail and entered the extension 877-822-2677 x3039 and the case number I was told. I was able to talk to the person from the voicemail who asked me repeatedly "Do you know who Robert Wilson is?" I replied no and what is this regarding? He stated I DIDNT NEED TO KNOW WHAT ITS REGARDING UNLESS I KNEW WHO THIS PERSON IS! EVENTHOUGH MY NAME IS ON IT supposedly!! How rediculous. I asked again what company he/she works for and he said Vander..Chase.. and hung up.

They have a habit of tossing out a lot of legalese BS ("case number", "fraudulent papers" [sic]) and threats, pretending to be law enforcement, threatening to jail people, etc. These are common illegal tactics for debt collectors collecting on payday loans.
As for your name being on something, he's probably lying (and violating FDCPA in doing so). He probably just used some skip-trace database, such as Accurint, to try to locate relatives or neighbors of someone he is looking for, and between his own incompetence, and the junk these databases are full of, he got you.
How many "Robert Wilsons" do you think there are, and what are their odds of calling the wrong people if they are trying to find one? There may be hundreds, if not thousands, of "R. Wilson" listings in most large cities, and most of them are NOT even related.
If you don't know who they claim to be calling, simply tell them so and tell them to stop contacting you.
If they keep harassing you, you can send them an FDCPA "cease communications" letter, and sue them if they violate it.
If they make threats, contact your local police. Police don't like people making threats and pretending to be police.
They also appear to be a debt collector collecting on payday loan checks, which does not relieve them of their duties as debt collecotrs to comply with FDCPA, validating debts, not engaging in threatening or abusive behavior, etc.
What they appear to be doing is misrepresenting many states bad check laws that normally apply in the case where someone purchases goods by check, that then bounces.
That is NOT the same as when someone borrows money through a payday loan, issuing a post-dated check to close out the loan that is known by both parties to not be good at the time it is issued. The payday lender knows they are lending to a risky borrower, uses whatever due diligence to decide whether to make the loan, and knows that some percentage of their post-dated checks will bounce and they will have to try to collect.
That does NOT automatically make writing that check a fraudulent act under state laws, just as failing to pay other types of loans are not automatically fraudulent acts, unless someone is borrowing money with the intent to not pay it back. This debt collector appears to be making threats of arrest or prosecution on that basis, which would be a violation of FDCPA and state debt collection laws.
Since they also have many complaints that they are contacting the wrong people, it is not surprising that they are making threats against people with no connection to the alleged debt, who owe them nothing.

They called my sister and stated they're doing an investigation on me. Stating she was Agent Jones and giving a file number. Saying the company name so fast you can't hear it. I had to dail number back to find co. name.
Next, look it up on the internet. They have you so upset you can,t focus.
They're located in Texas.
They have repeatedly called our home as well as calling my husband at work threatening him with jail, court, fines, etc. I have received calls from this company at my home from numbers showing all over the united states. They are abusive and rude, to say the least. They refuse to send the proper documentation to substantiate the debt, refuse to give a physical address of their "firm", refuse to give working fax numbers, claim they are attorneys and/or are a legal firm, and refuse to quit calling my husband at work even though he has told them repeatedly that calling him at work is not appropriate so then they threatened to call his boss. This is against almost every FDCPA regulation. But since you cannot locate them, you cannot send a Cease and Desist letter, either.
By setting up payment arrangements, do I have any legal grounds to file a complaint with the FDCPA regarding this company. Now Im afraid that the money I am sending them isnt really going for the payday loan that was supposely in their office., I understand that they are a debt collector., but I wasnt aware them using the " fraudulant check and suppose court summons" was against the FDCPA..
Please give advice on this for me ..
