Country: United States
this is afni's respond to to my complaint to BBB about what they are doing..... if it makes sense to you
tell me what it means....
This is in response to your letter to Afni, Inc., regarding the above referenced matter. We appreciate your assistance in bringing our consumer's concerns to our attention. In that regard, on or about March 2001, AT&T notified Afni the above referenced account remained due and owing from Mr. XXXXXXX. This account was established on March 1, 2008 and was considered delinquent by the creditor on October 24, 2008. The service address for the account was his still-current address.
The communication through the Better Business Bureau, as well as his simultaneous multiple emails to various people within Afni, is the first indication that Mr.XXXXXX disputes the account, despite an initial notice being mailed to his current address on April 22, 2011. In response, I have requested an investigation and validation to be mailed directly to the consumer. This may take up to 30 days. He is welcome to manage his account online at www.afnicollecitons.com or call a Consumer Relations Specialist at (866) 716-1284. Thank you.
They did not get the alleged debt from ATT they got it from another collector, which at my urging
verified the ATT bill did not exist as my debt and sold it to Afni. I provided the very same info.
which now Afni claims never even seen it ( they seem to do that a lot, from all that is available on
their tactics to harass and intimidate through false claims....

Get an attorney and sue them.
You might try www.naca.net
Since when is a 2001 account opened in 2008?
This is a pretty typical case for AFNI, as they try to "fix" their information and claim it matches anyone they think they can pin it on.
They imply that "you" owe it, even to BBB, but it's not likely they checked anything at all with ATT, as you know from checking with ATT that this account is NOT under your name.
They are trying to pin it to you supposedly based on this "address verification", even passing this off to BBB as some sort of verification of the account that you might assume was checked with ATT, yet since it is not a verification directly back against ATT information, it is fraudulently misrepresenting that supposedly they verified "you owe it".
Also note their little "suggestion" about how you can "manage your account" online. All you could do there is pay them. They are masters of twisting the English language to deceive by implication, while leaving space to wiggle out if caught.
They have been caught using "deception by confusion" before, basically just throw a canned garbage response letter back at any dispute, hoping the consumer gives up and pays. A federal judge ruled against them over deceptive dispute response letters a couple years back, in a 3 state class action lawsuit.
