Hi,
I am a member of Bally Fitness Center club in Saint louis which closed  last week . Now I want to get out of the contract as the club closed, when I called bally's they said that once the club closes I will be automatically transferred to another club. I tried to explain that the nearest club is around 15 miles and I do not want to go so far but the representative said they will review the issue but may not cancel the contract.
Does any one have a similar experience? What is the policy on Bally Fitness Club closure? Does the contract hold?

    Never go by what they say.

    Check the contract.  What does it say, and if there is a clause allowing termination in event of closure based on distance, make sure you follow the contract terms with regard to notification of termination and where to send it.  Be sure to send it certified return receipt requested so you have proof you sent it and when, as well as proof they got it.

    They routinely attempt to evade contract termination even where allowed by the terms of the contract.  Keep all records, and if you terminate in accordance with the contract, on any hint of their refusal to terminate file written consumer fraud complaints with FTC, your state AG, and your local District Attorney.

    I was also a member of Bally Fitness in St Louis that closed on April 30th.   I have a copy of my contract and the contract states " You may cancel this Contract if the club of enrollment permantently relocates ten or more miles from the original location or goes out of business, and we fail to provide an alternate club within ten miles of the closed club which will honor your membership at no additional charge."  My contract has been canceled but I am fighting with Bally's to refund my payment after my cancellation.  I would call them and let them know that your contract states 10 miles and you want to cancel your membership.

    Bally's is the worst fitness group in the country as far as contracts, fees and useless support staff.  They do not consider a member as a person, but as livestock--just one more animal by which they can make money.  They are rude,generally uninformed and often contradict the previous representative that I have spoken with.  I am trying to get a refund for several months where I was supposedly stuck in a contract and not attending Bally's.  I found out that they had cancelled all contracts and I had been paying month to month on a service I hadn't used for 6 months.  They did not notify me at all and are refusing to consider my request.  I was 19 when they roped me into a contract.
