This is one of many companies lately, who insist on getting around the DNC listing. These people call constantly, don't leave a message, however when you call them back they want to send you magazines. When I call them and tell them to stop it, I get this answer. We are exempt from the DNC registry. Then why do we have it. This seems to be getting worse every day. It's looking more and more like another boondoggle in Washington.

Not a business. log on to the DNC you signed up on and register a complaint. Next time they call inform them you have filed a continued complaint with the DNC. And since your number is not a business they can expect a $10,000 fine for every infraction.

No. Placing your number on the National Do Not Call Registry will stop most telemarketing calls, but not all. Because of limitations in the jurisdiction of the FTC and FCC, calls from or on behalf of political organizations, charities, and telephone surveyors would still be permitted, as would calls from companies with which you have an existing business relationship, or those to whom you’ve provided express agreement in writing to receive their calls. However, if you ask a company with which you have an existing business relationship to place your number on its own do-not-call list, it must honor your request. You should keep a record of the date you make the request.
They should check! My cell number is on DNC, but people just don't care...
Best is NOT to answer any calls from numbers you do not know...

First thing that comes to my mind, is that many people buy products or services online, enter contests, raffles, etc. Most of these have a set of terms and conditions you agree to in order to complete your purchase, contest entry, receive a free widget, etc. Most people don't read the "terms and conditions" attached to their orders. Most people don't read the 1800 word contest rules. Somewhere in those terms or rules or whatever, which the person is agreeing to, is either a) permission to contact you, b) permission to have their partner/affiliate company contact you, c) send you offers they think you may be interested in.
Not all of these have a separate checkbox for the opting into future contact.
Even if their terms don't mention this. If you establish a one time business arrangement, you effectively exempt the company from being prohibited to contact you because you established a "past business relationship" and as such, the company can outsource contacting you about another offer (of anything) to a company that calls on their behalf.
Now my experience with this company is as follows:
Received a call today. No message (I don't answer calls I don't recognize the number of)
Called back, received a recording that I have reached Lester, Inc. If you have received a call from us, we are contacting you on behalf of one of our clients. If you would like to receive more information about Lester Inc, press x (I think it was 1), or visit our website at www.lesterusa.com. If you would like to be placed on our do not call list, pres y (I think it was 2)
I pressed y (like I said I think it was 2) the recording said to be added to our do not call list, please leave your name and exact telephone number you wish to have added to our list. If you know the product you were being contacted about please include the product name. Please note that our list is based on telephone numbers and not your name so it is important you include your complete telephone number. Please allow up to 48 hours for your request to be processed.
I proceeded to leave roughly the following message, "You do not need my name, since you already stated your list is tracked by telephone number and not by name. My number is area code <xxx> xxx-xxxx. Please place me on your do not call list. Again my number is xxx-xxx-xxxx. Since you do not leave a message I have no idea what product you are contacting me about. Since this number is on the Do Not Call Registry and I have asked that you place me on your do not call list I will allow a reasonable amount of time, and then if I am contacted by you again, my next communication with you will be through my attorney. Again the phone number to remove is xxx-xxx-xxxx.
So now, I'll give them a few days (they said 48 hours, but I will give them the benefit of the doubt and allow 2 BUSINESS days (monday and tuesday) instead of 48 hours... And I'm adding them to my contacts, so I'll remember the name. So they call me after Tuesday, it's time for a letter from my attorney -- We'll see how it goes. But I figured, give them the number 3 times,
Do as I do...call their office number about 20 times a day... Just say Hi
