A man called our business line looking for an employee that does not work out of our office. when ask to leave a message he did not want to clarify if it was business or personal. Then he became very rude, and called back several time making rude comments. After about the 5th call he finally gave up.

    Sounds like a debt collector.  

    They may call looking for someone to collect a debt, but under the FDCPA, they are not supposed to disclose to third parties that the person they are trying to locate owes a debt.  In addition, if the consumer they are contacting notifies them that he cannot accept their personal calls at work, they must cease calling at work.

    Yes it's true we can not say "the reason I'm calling is because the person I'm calling for owes a debt"... However I can call, and say that I am a debt collector, and that I want a certain person to call me back without saying that the person I'm looking for owes a debt.

    I can tell people that I will not say that the person I am looking for owes a debt, because that would be breaking the law, and I can tell people that I can't say that the person I am looking for doesn't owe a debt because I am not a lier.

    For example if someones ssn is 000.00.2024... And if I'm not alowed to disclose someones last 4 digits of a ssn, I can tell them that I can not tell them the last 4 digits of their ssn but I can tell them that I ate 20 apples, and drank 24 beers this morning. Talk about a coincidence.

    I tell people as a last resort if they are not sure if they can make a payment that if they just call me back and tell me they want to cancel the payment that it is illegal for my business to debit their banks..... however if I only make outgoing calls, and I don't answer the phone to incoming calls then it's impossible for them to speak to me, and therefore if they can't speak to me then they can't cancel payments with me... So you see I never lied, and I never told them that they wouldn't be able to get ahold of me to cancel payments, I told them that IF they contacted me and told me that they are canceling payments then I can not debit their account.

    No matter how you look at it. debt collection is the way it is.

    And that is why you NEVER authorize anyone to directly debit your checking account.
