This is the second time I have been notified the there is a check to Walmart 220 Eca for $154.47 that is not mine. Ref.#37101533728377.
I had spent a long time on the phone with TRS. They said the check was from Citizens Bank, where I have never done banking and I have not written a check to Walmart in forever. I use my credit card!!!! Please get this situation straight. I have worked to hard to get good credit to have this happen.There are at least 3 Laurie Turners in Hurst TX. Get the right one, PLEASE!!

    You are wise to use only credit cards for retail purchases instead of checks of debit cards.  Use of credit cards safeguards your checking account from the risk of fraudulent charges stealing your money.  They have stronger protections against fraud, and they avoid the possibilty of overdraft or other credit damaging screw-ups that can result from use of checks.


    TRS Recovery is a debt collector, as defined by FDCPA.

    Since they have contacted you about a debt, they were required to send you a letter within 5 days notifying you of your right to dispute the alleged debt and have them obtain proof from the original creditor.

    Send them a letter disputing the debt and requesting proof.  Mail it certified.  Texas has more stringent state laws than other states, requiring that debt collectors respond within specified periods when consumers dispute alleged debts.  If they keep harassing you without sending you proof you owe it, contact the Texas Attorney General for assistance.  

    If you have further problems, find an attorney in Texas with FDCPA and FCRA experience. Both laws allow you to sue for damages, and allow courts to award attorney fees, so you should be able to find an attorney willing to take such cases on contingency.

    Do not let this go unresolved, or let them drag it out, since if they are attempting to collect on some debt from you, then they are also probably posting damaging information with Telecheck, which can interfere with your ability to open bank accounts.  Force them to fix their own mess, in court if you have to.

    They are not legitimate.  I received a letter stating I owed 162.00 for a bad debt.to Walmart. When I called them they told me to give them my drivers license#  to see if they could match it to the alledged account. I gave a incorrect number and they told me that was the license someone used to open a account wth Kiaprim credit union.  They wanted me to give more information like a current routing number. Do not give them information if you do not want ID theft. They will not send proof of a charge because they do not have it.  Report them to FTC.Org.

    You caught them using deception in an attempt to con you into paying a debt you did not owe, basically trying to defraud you.

    If you had given them a current routing number, they would have just taken money out of your checking account, via an ACH charge, probably including a "fee".

    They have a history of complaints that point to a systematic failure to comply with federal debt collection law, FDCPA.  This site has a steady stream of complaints of harassing calls to the wrong people, attempts to collect on unowed debts, refusing to provide proof of alleged debts, and unauthorized charges showing up in consumers' checking accounts.

    Sending them a letter, mailed certified, notifying them that the alleged debt is disputed, and that you are requesting that they send proof you owe the alleged debt.

    If you have further problems, contact your state Attorney General for assistance.  

    If that doesn't resolve the problem, find a consumer attorney with experience in FCRA and FDCPA litigation.  Both laws allow courts to award damages and attorney fees if you win, so you should be able to find an attorney to take such cases on contingency.  You might try www.naca.net

    Our local Walmart is very upset with this co.
    August 30,09 they said i bought merchandise of 100.00 dollars an stopped check August 31,09[Number 819].I do not remember even buying this much at one time ,much less stopping the check.
    Sept.03,09 it was paid to Ky.Bank check 873 100.22 dollars.
    They just notified me of this in July after two years.
    Call Walmart they will tell you I owe nothing 1 859 234 3232.
    Call Kentucky Bank they will tell you it was paid with check 873.
    What did you do with the 819 check You said  I stopped?If you continue to harass me the next one you are haearing from is my lawyer.I have been to your web site, you have even tried to scam people.You picked the wrong one this time.

    The fact that the bank records, and Walmart's records, both show the check was paid, are proof that it was, in fact, paid.  If it was actually blocked "due to a stopped check", then it would not have gone through only 3 days later.

    TRS is full of sh*t.  They have a history of complaints indicating that they often just make up excuses for why alleged debts are owed, even when they are not.  This is basically a con game.

    They are deceptively claiming "you stopped payment", in order to claim you owe it, or owe them some "collection fee".  As your verification with your bank and Walmart indicate, they have no basis for this claim, even though they might have in the normal case where a check did bounce.

    According to FDCPA, debt collectors are prohibited from using deception to collect debts.  TRS false allegation that this check was stopped, and that it is still owed, without any verifiable reason to believe so, are deceptive.  They just made that up, as it works in their favor to get money out of you even if it isn't owed..

    Contact an attorney to look into sueing them, as that is likely to be the most direct way to force them to resolve this without further damage to you and your credit.
