I have been notified by TRS Recovery Services Inc. PO BOX 60022 CIty of Industry CA 91716-0022, that I owe a creditor named Tele Check $46.30 due to a non sufficient fund with check number 107. This company could not even type my name, and I have never used this company or had a check number of 107. When I opened my checking account it started above this number. What can I do to penalize them? After researching them I have found I am far from the one they are scamming. In order to settle a dispute with them they want my bank routing and acct number. This is an actual business and this is illegal and I would like to see action taken or I will be contacting the better business bureau , and I will keep climbing until something gets done. For such a large company to let this happen is ridiculous. Please Help. Thank you for your time.

It would be reasonable to expect that documentation of an actual "bad check" claim would include a copy of the alleged "bad check", which would show it's actual bank and account number, signature, who it was made out to, the amount, date, and processing notations on the back showing where it was presented.
In addition, contact Telecheck (part of the same company as TRS) to request a copy of their credit report under your name. They are required to provide it. If you find erroneous negative information (such as this alleged "bad check"), send Telecheck a letter disputing that information.
If you have problems getting TRS Recovery to cease harassing you, or getting Telecheck to remove erroneous information from your credit file, contact an attorney, since you may be able to sue them for FDCPA or FCRA violations. You can find a consumer attorney in your state through www.naca.net
It is not YOUR responsibility to somehow prove this "debt" isn't yours.
Under FDCPA, it is THEIR responsibility to provide you such proof on your request if they continue to insist you owe it.
Providing them your bank checking account number doesn't even "prove" this "bad check" isn't "yours", but it does make it possible for them to run a charge through to take your money, after which they will probably claim "you agreed" to the charge.
TRS Recovery is in the business of guaranteeing checks presented to retail merchants, such as Walmart, acting as collection agency if they bounce. Telecheck is a credit reporting agency that collects and sells credit reports that include bad check information.
At this point, it doesn't sound like they've provided ANY information on this alleged "check", not even who it was actually written to, and nothing that might reveal whether this is a case of mistaken identity, a forgery, or really some online payment and not even a check. A "check" numbered "107" is suspicious on it's face, since if it's a real "checking account", it would have just been opened.
