My parents were contacted by this 'law office' this evening just before 9 pm. They were told they owe a debt on an unpaid credit card from Target and if they didn't pay immediately (by phone or online) they would have a legal judgment filed against them. Fortunately my mother contacted me right away when she realized that they would not provide any account numbers, etc, that they DID NOT have a credit card with Target and she was alerted when theywanted her checking account info to pay the debt.

    Debt collectors are required by federal law (FDCPA) to send a letter within 5 days notifying the alleged debtor of the debt, and that you can send a written dispute and request proof (validation).  Failing to send that letter within 5 days is a violation of FDCPA, and you can sue them for it.

    Deceptively threatening your parents that they could just "file a judgement" against them if they did not immediately pay some "debt" they didn't owe (without first suing and winning in court) is also a violation of FDCPA.

    Be careful, since this law firm/debt collector has a history of complaints of filing lawsuits against the wrong people, and of obtaining default judgements through "sewer service".

    Mary Jane Elliot of Novi does not care who she sues!  Last year my husband and I were fighting her in court at the state level to remove a judment against us for a debt that was not ours.  Her deceptive preactices prevented us from refinancing our home.  The debt belonged to someone else with the same name as my husband.  This week our case was heard in federal court.  I am thankful to our attorneys, Michael Nelson of Grand Rapids, MI and Curtis Warner of Chicago who took on this case to challange a bully lawfirm.  DO NOT LET MARY JANE ELLIOT GET AWAY WITH HARASSMENT!  Seek legal action now!  And do not try to explain yourself and "work this out" with her.  Her representatives will lie and deceive you.  Only work through an attorney and search for one who will take the case on a contingency.  You don't have to spend hundreds or thousands to defend yourself. Mary Jane Elliot will pay those attorney fees for you when the judge rules against her!
