I got out of my contract according to paragraph 2 (a) and it says I will get a refund in 15 days. well we're at day 45 and when I went to the spa to get an answer the guy said " you just have to wait for the check" I tried to point out that it says "15 days" in the contract that they are so tricky about getting you to sign then strictly enforcing to their benefit but so casually ignoring when you try to get them to adhere to it. The guy said "good luck with small claims and you'll never get a lawyer to take the case for that little money" Guess what? It's called "breach of contract" and can lead to monetary pennalties. In short stay away from "Bally Total rip off!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!.

    File a complaint with your District Attorney's consumer protection or fraud unit.

    You would also be wise to close any account they had access to for automatic payments, to prevent future unauthorized charges.

    In addition, document your contract termination, IN WRITING, SENT CERTIFIED RETURN RECEIPT REQUESTED to the address indicated for contract termination on your contract, to document when and for what reason you are terminating.  Do this IN ADDITION to filing a written complaint with your District Attorney.

    Bally's has a habit of stringing people along claiming they are terminated, or will be refunded, and then some collection agency or "unrelated finance company" comes along years later and claims they have an "unpaid loan" for the full contract amount that is due.  They depend on the average consumer's trust and lack of written records of what transpired years ago to attempt collection on a fraudulent "bad debt".

    When you are just getting flipant answers from someone at the health club, they are actually setting you up for the above racket, just waiting for time to pass.  Your contract probably does not specify cancellation through the health club directly, but specifies exactly how to do so, and if you don't, or can't prove it, they will demand full payment, AFTER the contract ends, so you haven't even used the facilities during the period you thought it was cancelled.

    I have been trying to get out of this contract since day 3. I have gotten the run around and know that i stop paying they want to send me to collections. I have told them that I got hurt at work and they replied that that is not there problem. I have been trying to reach them to send a fax or a letter but that seems to be another game of tag.

    This is such a good information! For me, the case is that I am still receiving billings three months after I was told the membership had been terminated.  I guess I will sent in certified return receipt mail with all my written records to the address indicated for inquiries and for contract termination.  
    My question is:  how is the written complaint with my District Attorney going to help?

    Bally's sucks - I have recieved my first phone call today about a $1600 balance from 2004. All I can say is "Here we go!!". I, too, had cancelled the contract due to relocation. What I never knew, or at least remembered, is that this was a loan that I was repaying from jump for membership. Reading through several blogs now - it's amazing how stupid we all are to fall for that. I only remember the smoothie bar and how there were never any close parking spots. HA! $1600 for, I would guess around five visits. What a business!! Seven years later, Planet Fitness seems to be ok so far. "I pick things up and put them down" right? Any way - seeing that the last post was 2009 - I am probably just venting to myself. Sweet
