Lets start out by saying i have been a member of direct buy for over 15 yrs. Direct Buy started out as United Consumers Club then switched to Total Home, then again as we know it as Direct Buy. When we joined the membership was a little over 1000.00 if i remember right. After we first joined we did save a lot of money on furniture and carpeting. But its now 15 years later and membership is 5000.00 which i would never pay. we went to order new furniture and what a shock i could get the same thing from a local store for almost the same price and they would even deliver it. When i pointed this out to a direct rep they contact there corporate head quarters to see if we could get a better price, They wanted to jump through hoops to prove i was not saving any money, i personally contact there home office  and they never returned my phone call.  So we priced out another manufacture and the same thing no real savings. Take note if you do join you will have to spend over 20000.00 to maybe break even. Just go to Consumer Reports web site. There use to be a savings at Direct Buy but not anymore. DO NOT JOIN YOU WILL JUST WAST YOU TIME AND MONEY.

    There are more and more class-action suits all over the States,
    I hope that you will consider contqcting any of the lawyers incolved

    Hey Trudy,

    I'm from Ontario. I've signed for BD membership 4 weeks ago. I submitted my Notice of Cancellation within 10-day period after signing. In my agreement it says "this program is not sold on a trial basis and that no refund of Membership fees will be made. Members do not have the right to terminate this Membership agreement without paying the amount remaining for this membership". I'm explaining that I'm NOT finding any savings and provided examples of not having savings. They jump through the hoops to prove me wrong and now the Owner is saying that I'd have to pay 890.0$ fee because it's not cancellable agreement. Is it TRUE?

    DB is so full of S**** that I am outraged by them every day
    I am in Ontario also, & my contract said the same thing 3 years ago,
    BUT I got every penny back!!!!!
    I kept finding  cheaper prices & kept my written proof,
    them I came across a calendar from the police station
    all about different types of FRAUD & THERE WAS A # NUMBER I CALLED,
    CONSUMER PROTECTION BUREAU OF ONTARIO,
    THEY told me that a contract demanding that you give up your rights ia a violation of the CONSUMER PROTECTION ACT OF ONTARIO,
    THIS refers to -=--NO REFUNDS & NO CANCELLATIONBS...
    ALSO, included is the UNDUE PRESSURE TO JOIN
    ***Were you offered the 30 day trial?
      THE contract is INVALID because it is not a NEW Corporate contract,
    which was apparently being written up at the time of the video
    Video was done on March 27, 2009
    which includes a 3 day cooling-off period
    PROOF; Google: CBC MARKETPLACE ---THE PRICE CUT PROMISE
    About 12 minutes into the video
    Barrie, ONtario db owner, Christine DeMarsh talks about a
    NEW CORP POLICY...3 DAY COOLING-OFF
    Just based on that, you have an INVALID CONTRACT (Misinformation which is Fraudulant (no matter how long it took for you to find the info)

    Thanks for quick response. So just to confirm - I'm writing a registered letter that I was offered wrong DB policy contract (without 3-day cooling-off period) and send it to them - is it right? And for sure I'm going to say in the letter that contract demanding that you give up your rights is a violation of the CONSUMER PROTECTION ACT OF ONTARIO!!! Also I'm going to register my complain at DIRECTBUY COMPLAINT site.

    Be very specific by adding the details about the CBC video,
    the contract you signed is out-dated, against db corp. policy & vs. the C.P.A.  
    INC copies of proof of cheaper prices
    Refer to Consumer Protection Act  Part 3--Unfair Practice
    14. (2) 1. db misrepresents that the goods & service have characteristics,
              uses, ingredients, benefits it does not have
           13.representation that transaction...DOES NOT include
              rights ,remedies, or obligations it, if it is false or misleading

    15. (2) b. excess price
           e. excessively one-sided in favour of db
           h. undue pressure to  sign

    Hey Trudy,

    I've sent registered letter. It's already past 8 business days since they received this. What would you recommend to do next? I'm ready to go all the way to the court to get my money back. By the way, does anyone know what's the regular price they are charging for 3-year membership? Mine was 5134.00$ because they alledgedly discounted 1000$ due to the promotion. I want to know regular cost. Does anyone know?

    Hi Trudy,
    I'm thankful for your help & wanted to provide an update.  The owner sent me a registered letter back with the items I listed and how DB's prices are cheaper and I don't have an argument anymore.  The other store I was comparing them against increased their prices so I have to start over.  I guess I need to find new products I never cared about buying and show the price differences there and that will take me hours I'm not sure I have.  I think I'll call Izard Noble instead.

    I understand the frustration but please don't give up
    Try asking your friends & family to help you do the price comparing
    Don't forget that you can get proof of prices by using on-line shopping print outs & many stores offer their flyers on line also
    Try to stress the point that db promises EXCESSIVE SAVINGS, SO even a slightly lower price from db is exaggerated,
    especially if you are paying a financing fees & % interest

    I am still shocked that there do not appear to be any law suits in Canada  so far, but I keep hoping...
    still try contacting the suits in the States for some advice or maybe some new leads on a law suit in Canada

    Does anyone know if the 3 day rule applies in New York?  I just purchased yesterday May 8th.
    I was going to send them an email request to cancel, also send a certified letter with return receipt, AND call my credit card company to dispute the charge.  But first I need to know if I'm within my legal rights since in the contract it states that it "not cancellable".  Please advise.

    I purchased our Direct By Membership Jamuary 31st. I live in Ontario and I am ashamed to have purchased this membership because i did not feel good about it as i sat in the showroom but felt that it made sense as a new home owner.

    How do i get out of this?

    Roman, if you want your money back with the least hassle do this:

    Go to the center at 10am on Saturday morning with a Picket Sign.
    Stand there & tell everyone coming for the presentation your expeerience.
    Make sure your on Pubic Property and in compliance with Local Laws.
    I'll bet you a cup of coffee the mananger/owner will write a check and give it to you on the spot to leave.

    That's what a guy in California did and the owner came out with a check in less then one hour.

    PLEASE SEND YOUR REG. OR CERT. LETTER FIRST, with proof of cheaper prices,
    or WITHIN THE 3 DAY-COOLING OFF (See letters from TRUDY to ROMAN),
    give 10 bus. days for them to respond, IN WRITING ONLY---
    ****IF you get no response, then you can check the laws for picketing,
    the laws are very strict & you could get arrested if you break them,
    ***You will have some proof of being ignored, if you send the Reg. letter
    & have it with you, when you picket.....
    the ideal scenario would be for the owner to come out & co-operate,
    BUT you cannot expect this  (Jim Picketer was very lucky)
      The police are not sympathetic to db's hidden tactic criminal acts...

    GOOD LUCK EVERYONE.........PLEASE DO NOT GIVE UP

    IF you blindly go out & picket, you are at risk  of your 3 day-cooling off time running out & no proof of your demands

    I bought mine in May 2010 at a cash price of CAD$4990, with sales Tax of  CAD $648.70.  The total amount come to CAD$5638.70.  I am in the process of demanding a refund.
