Unethical Sales practices
Complaint
DK Washington
Country: United States
I would like to file a complaint against:
Highland Homes
3020 S. Florida Ave Suite 101
Lakeland, Fl 33803

I believe their sales practices, and agent Carolyn Harmon 941-725-0318, are ruthless, greedy and unethical. The house I'm buying appraised for less than the selling price. In lieu of providing comps to the VA to support the selling price Highland Homes canceled the contract.
On the letter I received they inform that I have the option to pay the difference. So I requested to do so. Their response: sure but we'll have to write a up a new contract with a $10K+ higher selling price and you may pay the difference on that.
I believe Carolyn and Highland Homes is behaving unethically. I should be allowed to pay the difference on the original contract.

Mr. Washington signed a contract on December 6, 2014, we were informed of appraisal shortage and immediately Asked for a new appraisal to be order and were denied request. Buyer switched lenders and again could not order a new appraisal, Submitted comps to appraiser who rejected the submission as comps provided were not listed in MLS. Offered HUDS or Tax Records to prove values and were denied again. Offered Mr. Washington the option of paying the shortage or cancelling with full refund. These options were offered a few different times and each time Mr. Washington said he would pay the difference and then proceeded to try to assist with the appraisal shortage being addressed but by means that we are not able to adhere to such as having no one on staff who was legally a member of MLS with the knowledge to submit information only entries as the appraiser was requiring before considering an adjustment to value. Almost 4 months after contract and many attempts to resolve the issue the decision was made to act on contractual rights to cancel the contract and refund Mr. Washingtons deposit. After the cancellation was processed Mr. Washingtons Realtor contacted us to see if he could write a new contract at the new pricing in which we responded directly to her, Mr. Washington has had no contact with us personally on his own behalf other than to send emails and post such as the above. At this time the original contract has been cancelled, a refund has been submitted and there are no contractual outstanding items to be addressed. P.S. A new contract would require a new Appraisal therefore the statement is completely inaccurate regarding paying the difference of original appraisal on a higher purchase price.
