This company has auto dialers calling illegally acquired phone numbers on old discharged debt.

They have purchased deeply discounted "bad debt" paper from 1999/2000 and are attempting to collect by misrepresenting the facts.

I had a call on my cell phone, it was an auto dialer and I cb on another line, one listed under my name and the rep told me it was a debt from 2000, I explained to Tony that it was discharged in 1999.

He put another "Senior" rep on the phone, Jessica, who informed me it was incurred after the BK, which to my recollection is pure BS.

Anyway, I was verbally trampled and told her I was aware of the AG investigation and this was an attempt to collect a discharged debt.  Blatantly illegal activities.

She screamed over me and I let her rant and told her to phuck off.

I guess I will have to file a complaint with AG in MICH,

    Despite their BS claim that it was from 2000, they admitted they knew about the BK and knew what date to use to claim it was later.  They should have been careful to avoid any action that might violate the BK order.  Instead, they attempted to use deception and abuse to get you to pay anyway.

    File complaint with FTC and the Michigan AG, for illegally attempting to collect on a debt discharged in bankruptcy, use of deceipt in falsely claiming it was not discharged and misrepresenting the original date of delinquency, and abusive collection.

    If it was discharged in BK, it is illegal for them to collect.  If you have further problems you might want to contact your BK attorney, since many also handle FDCPA/debt collection litigation, and collection of a debt discharged in BK would also be an FDCPA violation.

The proposed consent decree includes certain monitoring and reporting obligations and customer disclosures, as well as a civil monetary penalty. Asset Acceptance is currently reviewing the proposal with counsel and has begun to discuss the matter with the FTC. The company indicated that it believes that the resolution of this matter will not have a material adverse effect on its business.

    I keep getting calls from this business asking for an Allison whom I do not know.   Repeated calls back to them do no good.   I did actually speak with a nice man this morning and he advised I might need to contact the attorney generals office of Texas.   He says my number shows blocked but calls come in daily.
