There are a number of shady payday lenders who use equally shady debt collectors to try to get around state law, charging illegal levels of interest or fees, or operating without the required licenses. Attempting to collect on amounts in excess of what you believe is owed may be an indication you are dealing with such a shady or fraudulent business.
All businesses operating in your state must comply with your state's laws, even if they are located in other states. If your state requires licensing of out of state lenders or collection agencies who attempt to collect from residents of your state, then they may be operating illegally. The whole loan may be illegal, in which case, all that might be owed them is a return of principal to undo the illegal loan.
Mr. David Hester if thats your name, if ypur company is legit than you and your co workers would be applying any and all proper lawful technics. Don't get on here pretending to be using proper technics and your not. Before you begin calling someone just remember that there are lawd to be involved to protect the consumer. Also the company involved needs to get in contact with the consumer to try and resolve the matter. There are protocols that are to be followed. So Mr. Hester, in some states its illegal to do certain things. Some companies do things to get around those state laws so they can make.an extremely large profit. Payday loan companies if the state has a law forbidding you to do that type of business just remember after charging all those extra fees you have received your monies plus. So before you start taking action ask yourself if I attempt to by trying to get more monies by using an collection agencies was I breaking law of that state. If tactics are used inappropriately and this is reported can we really afford to be investigated. I've had some companies tell me no and still go through with the procedures. So really who has broken law. You may have an legitimate complaint but in the end your gonna be hit with major fees and other state penalties. If that state forbides your business tell the consumer "NO." Your company is just as guilty as the consumer not paying the full loan and fees back, besides you broke a written contract with thay state as the consumrr did with

If you read the fair act consumer laws, it is illegal to contact you at your job if you have told them not to. No one can garnish your wages but the gov't or a judge order. Scare tactics, threats of arrest, etc are all illegal. If you request the original paperwork in regards to your debt you must rec. them within 10 days. I have filed a complaint with the Atty Gen Office and BBB today acutally. Swearing at you is also illegal. I have mine on my answering machine saved on a debt I don't owe. Third party contacts are illegal. There are a bunch of laws protecting consumers. I also called the company I supposedly owed which told me no I owed nothing this company buys lists of people who owe or have owed a debt. Mine was paid off in 2006. It is past the statute of limitations also in my state.

Your experience is consistent with fraudulent collection of faked "debt".
Contact FTC. They have recently sued a number of "debt collectors" found running similar shakedown rackets.

I have gotten several different messages from these people claiming everything from IRS problems, my SSN and Bank Info was compromised maybe over the internet, I may have been the target of a fraud etc, today they have a guy saying he's Det Steve Johnson and he has court documents and I need to be home between 3 and 6pm or he will come to my place of business if I do not comply an arrest warrant will be issued in my name then he leaves the same number and another number 716 362 2812. I am turning it over to the Mass AG office tomorrow. I did some checking it's a bill collector Total Recovery Solution in Lakeville Ma. This is 100% illegal. Report this to your local AG it's possible they will have to pay you a settlement!

Definitely a scam...I called them back and instead of giving me straight answers, the guy on the phone was extremely rude telling me to "drop the attitude". I told them any legit company would not be talking to folks that way. When I asked for a manager..he said he was the only one there....Total scam.
