Collecting payday Loan
Complaint
EP
Country: United States
I got a call from this Amy Jones with Bryon Keith & Associates about two weeks ago and she left me a message for me to call back with a case number starting with B. I called back and spoke with a Shannon Jones and he tells me that I owed $775 from a payday loan from Lazer Lending. He wants me to pay something up front and then put me on a payment plan.He stated that the original loan was $480 but with the fees it went up and that he was willing to work with me and knock off $200. I asked him for some type of proof and all he faxes to me is a letter stating my name previous address and email the case number and the name of the original creditor on a letterhead with there name. But I dont know what to do he confirmed my full social but when I look up the companies name I find nothing on them. Can someone help they are talking about putting a judgement against me and garnishing my check. Back then I researched them and found no info on them and looked up there website and did not find anything. Today I looked it up again and did find a website but it does not look legal to me. Some way or another they are trying to get my money. Please advise!!!! I put a complaint in with FTC.

Apparently it has become easy for criminals to obtain access to consumer identity, credit report, and skip-trace information, even bank account numbers, which they now use to run phony "payday loan" extortion rackets. Many of these are conducted from overseas, often India, as evidenced by complaints reporting that callers have "thick Indian accents", but there are also a number of phony debt collection extortion rackets being run from several locations in the U.S.
Numerous complaints against this "Bryon Keith & Associates", including reports of threats they were "suing" or would "garnish wages", as well as many allegations of fraud, are being reported here.

Collecting on fake "payday loan", claiming to be "the Justice Department".
They are using EFT, using their "Bryon Keith & Associates" name, to extract money from consumer bank accounts.
"i received a call and they said they where calling on behalf of Advance America Cash Advance. They said I owed money on a loan that never had.I was so scared i made a 100 down payment. I knew I never gt a loan from AACA. So I called AACA I was no where in their database. They informed me that i should have not gave them my card number. She went on and told me to ask the so call justice department to email me the documents. Eric said he would email me them when i Paid what I owe. He tried to tell AACA was lying, it's funny they called their selves the Justice Department but when the money was debited it said Bryon and Keith & Associates."

"They are fake--tried to pressure me.. I asked for verification and they sent something my 10 year old could have done on a computer--no letterhead, even handwrote my address."
"Then the second caller was female, but upon leaving a message, it was like she had to think of which name she was planning on using that day - which happened to be "Amy Jones". She proceeded to give a "case number" of 1 letter and 3 numbers, stating they were from the "garnishment department." When I called back, I immediately demanded a verification of debt, to which "Amy" became flustered and didn't know what to say - so she had to get her "supervisor" on the line. The "supervisor" wanted to fax the information, but I insisted on him mailing it. When I received it (which I was surprised about), as in the previous posts, the verification of debt looked like something anyone with elementary school skills could have printed. It showed no date of the supposed loan, nothing about the original debt except for the amount. Nothing official-looking whatsoever."

"I called back today, and got the MGR "Shannon" - (male) who provide me with my bank account information and that I took a payday loan out back 6/2009 and never repaid. (YEAH RIGHT like they would ever give you $ and not have auto draft to take back payments) and now they are claiming I owe them 800.00. He told me at that time this morning I had until 5 pm today to call back and set up payment arrangements. Nonetheless, I called my bank (and since the account has been closed for well over 1 yr) I had to order copies of my bank statement to have the proof that I did no such activities with this NO NAME PAYDAY Company. Parent name is Cash Today.com but he couldn't give me the company name who is requesting my wages be garnished b/c there are more than xxx number of subsidaries under than parent name. So, with that said, I call him back a few hrs later to have him provide me proof that there is such a claim out there for me. He stated he would fax to me in 45 mins since they were going to lunch. I told him that I need an official document to prove that they are going to "garinsh my wages" and the name of this payday company who is sueing me. I have yet to receive this and it's been almost 3 hrs since I last spoke with him. He then claims that if I dont give him my account number to begin a payment arrangements they will have no other choice but to submit a garnishment to my employer. As I explained to him that it was going to take several business days before my request could be fulfilled from my bank; he states he is going to give me 7 business days to contact him back.
BEWARE, I too believe this to be a scam. Still can't find a legit business name for Bryon Keith & Associates or Brian Keith & Associates to confirm."

Typical of this type of scam. Make up a big amount for the "payday loan", then apply pressure to pay immediately, in exchange for a "discount". The "debt" is still fake.
"I asked him for some type of proof and all he faxes to me is a letter stating my name previous address and email the case number and the name of the original creditor on a letterhead with there name. "
This particular group appears to send some phony "verification" that they make up. Several similar complaints against them report mailed or faxed letters to "document" the fake "debt".
"But I dont know what to do he confirmed my full social but when I look up the companies name I find nothing on them."
It has become commonplace for these criminal-run fake "debt" extortion rackets to obtain SSN, current or past addresses, bank account numbers, employers, relatives, etc. The overseas versions appear to be using fake payday loan sites to get consumer information, but there are also indications they have gotten access to U.S. credit report and skip-trace services.
Confirming your SSN means nothing. It is neither proof that you owe some debt, nor does it prove you owe money to some unknown caller trying to con you.
"they are talking about putting a judgement against me and garnishing my check. "
A legitimate debt collector threatening that, as if they could just do so by their own actions, would be engaging in deceptive collection as well as making illegal threats, in violation of FDCPA. You could sue them for making such threats. These are crooks, nothing more.
"when I look up the companies name I find nothing on them. "
They are a sham "debt collector". Basically a bunch of crooks with phones, nothing more. They can't "sue" you, "arrest" you, "prosecute" you, or "garnish your wages".
"Some way or another they are trying to get my money"
The only way they can get your money is if you give it to them.
"I put a complaint in with FTC."
Good.
What website URL did you find?
They are, however, vulnerable at two points:
1) Their phone provider. They may be using VoIP, but most likely use the same carrier even though they may change phone numbers frequently.
2) Their method of getting the money transferred.
If the scam got that far, how did they say payment should be sent?
Western Union?
MoneyGram?
Other?

On 7/8/15, I received a call from Global Solutions stating I defrauded a company called Lazer Lending due to nonpayment of a loan from 2008 (which I also did not take out). They also would provide no documentation or details that would support that I indead owed Lazer Lending. The same conversation took place as mentioned above - sending me multiple letters that I never received, etc. They then threatened to take me to court and garnish my wages. When I ask one person for their phone number, they gave me the wrong number. Beware of all of the above companies!
This is a scam
