TRS keeps sending me bills for $226.59 for a returned check made out to Sears Full Line.  I did not write this check.  I live in Oregon and the debt was incurred at a Washington mall.  I have never even been to Washington.  I have sent TRS 2 letters and they still send me bills.

They have a reputation for attempting to collect "bad checks" from the wrong people, and ignoring consumer disputes in violation of FDCPA.  Several AGs have investigated them.

They are associated with Telecheck, which acts as a credit reporting agency for bounced check collections.  Apparently, they figure they are above the law.

You already know what happens when you ask nicely.  They will ignore you and trash your credit.

Get an attorney and sue their [***], since otherwise they will interfere with your ability to open new bank accounts.  Both FDCPA and FCRA allow courts to award damages and attorney fees, so you should be able to find attorneys to take such cases on contingency.

I got a call about an hour ago from TRS Recovery regarding a bad check written to Walmart!  I was going crazy trying to figure out what they were talking about because I havent had that low of a check number in over 10 years and dont write checks that often.  Once I got my friend here, I started telling her about it and since I have signatory authority only on her account, I had her check hers.  Sure enough it was a check she had written from her account, my name is no where on it!  Why should i have to take the time to clear up crap they have screwed upon!!

If your name is not actually on her checks, then they might have you in their system if you signed for one of her checks that was presented at some retailer that was a client of theirs.  If you had presented id like a drivers license when presenting that check, then your DL might be in their system tied to her checking account number, even though it isn't your account.

You should receive a letter from TRS within 5 days notifying you of this alleged debt.  They have also probably put derogatory information on your Telecheck file, which would interfere with opening a new checking account and also might interfere with you using one of your own checks at any of their retailer clients.

Send a written dispute to TRS disputing the alleged debt.  In addition, obtain a copy of your Telecheck report, and dispute any errors you find.  Send all disputes certified return receipt requested, since you are building a paper trail documenting noncompliance with FDCPA and FCRA, in case you have to sue.

If they continue to harass you over a debt you don't owe, or continue to damage your Telecheck credit file, get a consumer attorney, as they have a history of very poor compliance short of credibly threatening legal action.

Let an attorney straighten it out.
