Continual Calling for Someone not living here

This company continues to call at odd hours of the morning and daytime.  I have informed time umpteen times that the person they are tying to find does not live here, yet the jsut continue to call.

Recently they have called as follows:
09-29-09 - 7:05 AM
10-2-09 - 11:45 AM
10-5-09 - 11:48 AM
10-6-09 -  4:19 PM
10-7-09 -  7:07 AM

I am retired and have absolutely nothing to do with these people.  I wish some entity would cause them to stop bothering us at our number.

    WFNNB is a bank that handles credit card accounts for a number of retail store chains.  They appear to be a subsidiary of Alliance Data Systems, and are subject to regulation by OCC, which regulates national banks.

    Other complaints confirm that they routinely call their customers when they are even one day late.  The actual calls may be coming from a debt collector, calling on delinquent accounts, so the caller may be subject to FDCPA and similar state laws.

    If they call again, ask if the caller is a direct employer of WFNNB, or is employed by a debt collector.  

    If they are a debt collector, obtain their name and address and send them a letter, certified return receipt requested, notifying them that they have been repeatedly calling you in error, attempting to contact <insert name here>, that you do not know that person nor can they be contacted at your phone number <nnn-nnn-nnnn>, that they have repeatedly promised to remove your number but continue to call it, and that they are to cease harassing and calling your phone number, as required by FDCPA.

    If they claim to be with WFNNB, or refuse to disclose name or address if they are a debt collector, then contact Advanced Data Systems/WFNNB executive offices to request that they cease calling.  Should you get no cooperation, file complaints with FTC, Texas Attorney General, your state AG, OCC, BBB, etc.

    If they are a debt collector and fail to cease calling after confirmed receipt of your letter, you can sue them, in your local state or federal court.  You do not have to sue them in Texas.  Look for an attorney who will take the case on contingency, since FDCPA allows the court to award both damages and attorney fees.

    They called my company 30 times a week and tell me I have accounts with them, I don't have any accounts. Now they call my house phone repeatly telling me and my son i have accounts we don't... they refuse to give names, account info or there ID

    Alliance Data Systems does the collections for WFNNB. I intend to file a complaint against them with the FTC for violation of Section 805 of the FDCPA for calling me outside of the allowed 8AM-9PM (local time) time period.

    This despicable company has called my elderly parents' home upwards of 25 times a day for the last month.  Since the phone numbers shown on their caller ID were either multiple listings or shown as "Unknown," "Unavailable" or "Private" we were uncertain as to whom our complaint should be directed.  However, after some Internet research, I traced them all back to WFNNB.  My mother suffers from severe osteoporosis, diabetes and congestive heart failure.  She could not reach the phone in time and no messages were left when she failed to pick up on the call.  She is 89 years old.  Last night, she was in such a state of distress and anguish as a result of this harrassment that she had to be sedated.  Now I am angry.  No one does this to my family.  I intend to contact the BBB as well as my state Attorney General's office as well and make them aware of these despicable practices.  This is an outrage!

      I have no credit cards, revolving accounts, etc. So this isn't an issue with non-payment. They simply have the wrong number and keep calling. A person on 800notes said that he was able to get his number taken off their calling list by being proactive and calling the company. He was assured they would stop calling. I've had this problem with other collection agencies. I'm beginning to think my cell number was recycled.

    fhhjdmd- What? Do you work for them? Idiot. I was getting about 6 calls a day from them- asking for my daughter (who does not live here). They were rude and persistent... I finally stopped the calls just yesterday. I let my home fax machine pick up their calls. I'm sure the loud screeching noise in their ears is what made them stop. I didn't get my usual 8:15 am call today.
    And for your information- they are calling people who don't even have accounts with them. Like me! And I have never been late on ANY bill ever my entire life. So stuff it.

    You Idiot, now much do they pay you for this posting. They call me atleast twice a day asking for a person who I do not know. I told them many times that I never heard that name, they accuse me of lying. I wish you get these calls so you know what we all go through.

    Are you kidding me? You expect someone to go through the trouble of writing a letter and send it return receipt (fee involved and time spent) for harassing phone calls? These bozo's called me over 60 times and I have NEVER held any account with them, not to mention that I have not had a a late payment of any kind in over 20 years. Every call was a robocall. I'll be damned if I'm going to expend one ounce of energy to make them stop unless I am getting paid for it. I informed them in no uncertain terms that I would get an attorney if they kept it up and (guess what?). They did. That was after I informed them that if they called my number one more time that I would contact an attorney. They don't care. You must be an employee of that company to make such an outrageous suggestion. Or, what kind of sheep are you?

    WFNNB has been calling my Grandmother's number since last November looking for the person whom previously had her new number.They call at all hours of the day at night and each time are told no one here by that name so stop calling.They claim to removed the number from their database but? In June we took my grandma to the court house to file a harrassment suit and no contact order and they were served about a week later and the calls stopped for a whole monthe,until yesterday morning when they called at 6:40 am. I answered told them again they had the wrong number,this call was being recorded,and reminded him that they were served with a no contact order and the guy said he wasnt served directly so he could and would keep calling when he wanted to cause this was the number he had and so now we are at the police station filing a police report so that we can proceed in court and every call they have made since being served they will be fined $1500. and that will be free cash in my grnadma's account.Someone has to put a stop to this [***]!It is the same guy calling every time and he must be a huge moron or suffer from dementia to keep asking the same damn thing!

    You can also sue them for violating TCPA.

    Violations are up to $500 per call, or up to $1500 per call if willful.

    Contact a good consumer attorney in your state.  You might try www.naca.net

    If a creditor is calling your phone, and you want the calls to stop, then you will need to withdraw your consent for the contacts.  Some Courts recognize a consumer's right to ask a company to stop these automated calls under Telephone Consumer Protection Act (TCPA).  

    Send the company a certified mail letter.  In that letter, identify your phone number and demand that they stop calling.   Be sure to keep a copy of the signed letter together with the return receipt.  I have posted sample letters on my web site’s law library.  http://www.sue4abuse.com/library.html.

    After you have done that, you may be able to pursue them for violations of the TCPA (Telephone Consumer Protection Act).  This is the same statute that is used to sue junk fax companies.  The statutory damage award is $500 for each call and $1,500 per call for willful violations.

    Your state's collection practices act may have additional prohibitions and remedies which are applicable to your situation.

    Once you have written your cease communication letter, and if the calls continue, your best option may be to have an attorney help get their attention or pursue claims under the Telephone Consumer Protection Act (TCPA).

    There is currently legislation pending to insure that consumers cannot withdraw their consent for these calls.  If you want to preserve whatever rights you have, you should contact your US representative and Senators.
