suspect is in bexar county jail, san antonio, tx,  also gave detective's name plus phone number....why i am i still receiving collection letters?

    Contact the Texas Attorney General for assistance.

    If you are getting collection letters from TRS in Illinois, you may also wish to contact the Illinois Attorney General, as there is recently passed Illinois law governing proper handling of id theft disputes by debt collectors.  

    You may also wish to contact an attorney regarding violations of FDCPA or FACTA/FCRA.

    I had my name put on the nation wide list when a forger used my checks and has been prosecuted.  The check had stop payment..Name and address on checks from both accounts.  Never got a call, just a letter.  Certigy has signed for my registered letter, denied they got it.  Two charges filed on me by two of their customers.  I have faxed all info and still, no answer.  Another attorney called me about one of those same accounts and then I had to fax him all of info.

    It is common for debt collectors to continue to attempt to collect on fraudulent accounts or checks even when notified of id theft and provided documentation such as police reports or fraud affidavits.  

    They know their chances of getting paid by the thief are zero, so they might as well sqeeze the victim, even though the law says you are not responsible for debts due to fraud by others.

    Your experience is consistent with this stonewalling, since although you have proof they received your documentation, they are pretending they did not.  They will likely continue to hound you and attempt to coerce you into paying on the fraudulent checks until you get an attorney, since until then they know there is no risk that they will get sued.  

    FCRA/FACTA and similar state laws place specific legal requirements on creditors and debt collectors given notice of identity theft, including that they remove reporting of fraudulent debts, that they not sell such fraudulent debts, and that they investigate within certain time limits.

    Find an attorney with experience in FDCPA and FCRA litigation to assist you in dealing with this situation.  They may already have violated one or the other by continuing attempts to collect after you provided documentation of id theft, so they may be subject to statutory and actual damages and attorney fees should you need to sue.
