Failing to be able to pay on a debt or loan is not a crime. Providing post-dated checks is a common practice in the payday loan business, but the underlying transaction is a loan, and the lender knew the check was not good at the time it was written. Debtor's prisons disappeared centuries ago.
Harassment and abusive collection by a debt collector, and specifically threatening arrest, is a violation of both Federal and state laws. So is threatening to take any action they cannot legally take, or do not intend to take. See FDCPA on the FTC.gov site.
