Ian smith had called my sister and told her that i was being summ to court that  i owed some money to a loan company which i never have heard of this place he is talking about. is there anyway  i have  go to court and is it true abouth  this place call shapiro price in new york po box 661 amherist new york 14226 ph number is 1888-499-8064. i spoke to him on the phone less then 1 hr ago he said he would settle for $287.00 which he said i owed$559.00. it sound like it is a scam to me should i pay that money or not which i really dont have cause im not working at this time.

    This type of scam often deliberately first contacts a relative, even though disclosure of information on the alleged "debt" to a third party is illegal and a violation of federal law (FDCPA).  Their presumed goal is to panic the target into paying without checking out whether they or the debt are legitimate.

    Just because some thug calls you on the phone and threatens you does not make the alleged "debt" owed.  This type of scammer generally never actually "sues".  That is the whole reason they use extreme but illegal threats.  

    If they did sue you they would have to serve you a summons.  Odds are very high you will never see a summons.  Given the extent of complaints of illegal threats, they are probably hiring ex-cons, and snorting the profits up their noses.

    They commonly try to claim a larger amount is owed, that they have already sued, but that you are so lucky that they will settle with you for about half, as long as you pay it immediately.

    You already believe you don't owe them anything, and that they are scammers.  Why would you pay them something you don't owe, just because they have a phone, and make illegal threats?


    Based on many similar complaints, they appear to be a fraudulent debt collector running a phony "payday loan" scam, with the usual threats of "criminal prosecution" similar to others in the Buffalo area.  Numerous reports the "debts" are mostly phony.  There is even one report that there was some outstanding payday loan included that on contacting the initial payday lender, they were warned about this company, and the possiblity they might be collecting on debt they had no right to collect on.

    That may indicate that in many cases they are probably fabricating them rather than buying old actual payday loans, maybe just pulling credit reports and collecting on old accounts they find there.  That would be consistent with your case.

    If you do get a "summons" get an attorney and respond to it, but all indications point to fraud.  This scam, including fabricating claims using information found on credit reports, is becoming increasingly common, and the various complaints match that common pattern.  

    The NY AG has shut down a number of similar scam "debt collectors" in the Buffalo area, and prosecuted a number of their employees for larceny.  You can find footage of some being led away in handcuffs on Youtube.

    Contact the New York Attorney General to file a complaint for attempted fraud and violations of state and federal debt collection laws.  Also contact FTC.  These people deserve to build up a thick file.
