Fake debt collection for Dish TV

I keep receiving calls which show up as ReceivablesPerf (424-235-5862). When I answer the call, I am told it is about a debt to Dish TV for $300+ in my husband's name. We have never had a contract with Dish and currently don't have a contract with any cable network.

They had me hold while they connected me with another department, and the call was disconnected. I called back the number that showed up on caller ID, told them what the call was about and they said they would transfer me to another department. The call was once again disconnected.

They are calling between 1 and 3 times per day. Where do I go from here?

    You want to cover yourself should they trash your credit, and be prepared to sue them for violations of FDCPA, FCRA, and damages.

    First, nail down the facts.  Call Dish to see if there is even any such "account" in their system.  That should allow you to determine if this is some "id theft" problem, or just RPM making things up.

    Second, since they have contacted you, they have 5 days to send you an FDCPA required letter notifying you of this alleged debt, and of your right to dispute and request validation (proof), that they would have to obtain from Dish and send to you.  Send Dish a letter, mailed certified, disputing the alleged debt, and demand proof you owe it.

    According to FDCPA, they should cease calling you and demanding payment until they send validation. If they violate FDCPA, file complaints with FTC, your state AG, the Washington state AG, and the Consumer Financial Protection Bureau, and find an attorney who handles these cases.  Consumer attorneys often take such cases on contingency, since both FDCPA and FCRA allow courts to award damages and your attorney fees if you win.  You can find a consumer attorney in your state through www.naca.net
