Refusal to pay for covered item by falsifying information

CDWS sold me two policies one basic, that covered catastrophic mechanical failures and a second included the basic package and Cooling and Heating AC and some electrical. In the second policy it clearly states what is covered by item and several of the items listed in my Mercedes required replacement. Mercedes of Beverly Hills contacted CDWS via the phone to get approval for the repairs. This took the agency several days and many hours to get a refusal for the items in the contract that were clearly covered. CDWS claimed the car had oversized tires there for the coverage was void. Tie size has nothing do to with the operation of the air conditioning system. This is a complete fabrication on the part of CDWS, they lied. Several conservations and days later they wanted pictures of the license plate and tires to prove the car did not have oversized tires. Mercedes Benz of BH supplied the pictures but by the time the dealership wanted the loner car back since it had been 10 days. The dealership would not deal with the CDWS any longer, they were wasting the dealerships time so I had the car repaired and the pictures sent to CDWS. Again they denied the claim since the work had started but now they admitted the car had the correct size tires. This whole time CDWS claimed the case had been adjudicated (no names or claim number just a no) and the claim was closed.
I went to the Better Business Bureau to file a claim, paid my money for the hearing and today I found out CDWS will not participate, the case is being closed by the BBB. I have to take the cheats and liars to small claims court. Closing of the unresolved BBB hearing does not affect CDWS’s BBB score. Beware of this company unless you have weeks to spend resolving any work before it is performed. They are thieves as far as I am concerned and I plan to take them to court in California and have backup information from the BBB.

They may have sold you this warranty through deceptive telemarketing, which may have violated state law.
