Dear Sir


1.    I happened to see your prog today in the evening on CNBC AWAAJ and found it to be a very educative for the POOR CUSTOMERS  like me who are cheated by the TELE SHOPPING COMPANIES.
2.    I am an Army officer presently posted at MEERUT ( U P). I ordered a Sony Ericsson mobile phone model no W850 I on 19 Mar 08 to AVA MERCHANDISING  order no 160077543. Since the company failed to deliver me the product in 21 days rather in even 40 days I cancelled the order and asked for the refund.
3.    After my order the company debited the EMIs in Mar 08 and Apr 08  and even after the cancellation of order and of the promise from the AVA MERCHANDISING  REP Ms Sweta Kaloo (refer e mails dt 05 may and 06 may reproduced below) to refund my principal amount etc ,I did not get my money back in my account. To add salt& pepper to my injuries The bank kept debiting the EMIs .
4.    I kept on sending e mails to AVA MERCHANDISING  without any satisfactory reply, please refer to all the correspondence through e mails as below. I received the last e mail Ms Kaloo on 30 Jul 08 and spoke to her later also but did not get my refund. The bank charged me the penalty which I asked the company to pay since they failed to refund my money.
5.    I have recently been posted to NAGALAND in FIELD COUNTER  INSURGENCY AREA and will be joining the unit by 10 Sep 08 . May I please request THE PEHREDAR to do something and get me my money and the PENALTY CHARGED TO ME BY THE BANK REFUNDED.
6.    Will be obliged for an early action

1. It is regarding the order no-160077543 Dt 19 Mar 08 which was later cancelled due to non receipt of order in time.
2. To my surprise I received citibank credit card statement of jun 08 in which Rs 2665/- has been debited to your company for the mobile which I never received, and your company agreed to refund/adjust the amount with the citibank.
3. It is requested the sort the matter with the citibank and inform me accordinly. I am not going to pay this amount to Citibank so please clarify this before the DUE DATE ie 14 JUL 08.
4. An early action is appreciated.

Thanks a lot for the reply .

Till now I was just thinking that I am sending the mails to satisfy myself only since there was a complete silence on the other end.But what hurts me more is the attitude of the people eg. yesterday 05 may at 1800 hr I spoke to Vijay at your toll free no who told me that Ms Manjot is busy and will call me in 15-20 min, after waiting for 1 Hr+ I rang up again only to find out that everyone has gone to home since the shift finishes at 1900 Hr !!!

Glad to the rights of the customers, I wish to cancel the order and want the refund of the money debited from my credit card (ie Rs 250+2665+2665 ) and a interest of 2% pm on the amount ( this is the min interest a bank charges from the defaulters) Total amt of the interest will be approx 100-150 bucks which is definitely much less than the price of the free gift offered as a compensatory gesture.

Please settle this and I am ready to forget the experience with AVAMERCHANDISING as a bad dream.

Please let me know your view by 1400 Hr 06 may 08 so I will not accept the mobile if delivered by courier company and also fwd my ICICI bank acc no for crediting the amt.

Perhaps you will also like to forget this !!

1. I am Col Piyush Sharma presently posted in Meerut UP. I placed an order of Sony Ericcson mobile W 850 i , product code 874 on
19 mar 08 to Ms Nisha for my son Mst Shivam Tyagi.
My order no. is 160077543.
2. On 11 apr 08 I received a SMS that on my mobile(9319777735) from 09910380288 that the Mobile has been dispatched on 11 apr and EDD is 18 apr 08 vide AWB no 900028822.
3. Meanwhile I received my citibank credit card statement in which Rs 250/ & Rs 2665/- were debited to Avamerchandising on 19 mar& 20 mar respectively.
4. On 21 apr I spoke to Mr Vinayak on your toll free no 18001800300
and asked about the order and he told me that I will be receiving the mobile in a day or two. I tried to ring up the mobile no by which I received the SMS but it was switched off.
5. On 23 apr 08 I again spoke to Mr Vinayak and he told me that there is some problem in sending the product to UP state and also some problem with courier company.I also spoke to Ms Manjot since I wanted to talk to someone responsible, she said that she will inform me about the status of order in 24 hrs.
6. on 24 apr again I spoke to Mr Amit and Ms Manjot since I did not receive her call. She regreted the delay and said the product will be delivered shortly. I asked her to cancel my order since it didnot come in time and I failed to keep my promise to my son that I will present the mobile on his Bday.She again promised me to tell the status with in 24 hrs and also said as compensation in delay of order a free gift will also be send.
7. I again waited for three days for any details from your esteemed AVAMERCHANDING FIRM but failed. I rang your toll free no on 28 apr & spoke to Mr Gopal who said that Ms Manjot is on leave and My product has been dispatched on 23 apr.
&n bsp;
MY QUESTIONS ARE
a) AS a customer I should have right to cancell my order if the comany fails to deliver it within time( today is the 40th day of m
order which your company promises to deliver in 21 working days).
b) I have already paid your company two EMIs ie Rs 5330/ without receiving the product.Why I should not be refunded the interest the bank charges for defaulters ?

MY REQUEST IS
Someone responsible from your company should respond to my queries otherwise I will NOT ACCEPT the order when it is delivered to me and secondly legal options are always open !!

    This is truly an act of cheating. Most of the merchandise first try to impress the prospective customers with the help of various means, once the customer is enroleed or subscribe the services or order the service or product, merchandise become irresponsible. I have read about AVA MERCHANDISE on net and every time i have found the same mention. All the time the customer is complaining of non-delivery of the product, receipt of the distorted product.I receive HDFC credit card statement every month along with a AVA MERCHANDISING leaflet. The offers are quite tempting, i even thought of ordering couple of products, but such experiences of other customers have shown me the path. Strict action must be taken against these merchandises. Also i would like to request the agrieved customers to move to consumer court. Hope they will come forward for the best.

Then I start searching under Google and I found lot of complaint against Ava...I stop my process.... Thanks...

    Today I received Ava MerchandIIng product leaflet with my ICICI Cr.Card statement. In that "Grab the hottest deals" as Samsung LCD TV MRP rate Rs.18,490.00 for offer price of Rs.1,990.00, Philips home theatre MRP Rs.9,980.00 for offer price of Rs.1,990.00 like so many products "Pick any gadget" asking "Simply use your ICICI Cr.Card to avail these amazing offers". This is truly an act of cheating. Is it really ISO company? The Govt. must take severe action against this type of merchandises.
