Defective sofa bed

We bought a sofa bed made by Simmons Upholstry in the late spring of 2012.  When it arrived, we were still painting, etc., in the room where our son would be living and using this piece of furniture.  Therefore, we didn't move it into that room or open it for a couple of weeks.  When we did and first opened it into its "bed" form, we noticed that the whole frame was slanted toward the foot of the bed!  We checked for adjustments or ways to make it parallel to the floor AS ALL BEDS SHOULD BE, but there weren't any. We have had to prop the end of the bed with 2X4's, just to make it level!

Thinking that it was a manufacturer's defect, I started trying to call and/or email SImmons.  Seems that neither they nor their parent company will communicate with consumers...you MUST go through the company through which you bought the item.  In OUR case, it was the Direct Buy in Edison, NJ.

Despite a chain of emails (between Direct Buy and me) that would circle the equator, WHICH BEGAN LAST AUGUST, AFTER I GAVE UP ON TALKING TO SIMMONS, I have been passed back and forth, like a hot potato, between their  "member relations" people, each of whom made empty promises.

I wonder what their reaction will be when I sue them??? (Which I WILL!) It has been an ongoing battle for SEVEN MONTHS , and I've HAD it!

It's a shame, because we have been members for MANY, MANY years, and had always had good luck with them in the past.
