Allied Interstate has been harassing my wife and I for several years. We have told them repeatedly that we are not who they are looking for but they continue to call on a regular basis and harass us. We have tried being professional. We have tried to ignore them. This morning I had enough and cussed this guy out. I demanded that the calls stop. I know cussing them out won't stop the calls but it sure made me feel better. There has to be a way to stop the harassment.

    You have tried politeness, professionalism, and common sense.  It hasn't worked, and experience tells you it won't in the future either.  Some debt collectors, including apparently Allied, don't care how many people they harass, or even if they are harassing the wrong person, so you have to set them up to be liable for violations of law.  It is time to raise the stakes, since so far, it has cost them nothing.

    Note in particular Sec. 806, containing prohibitions against abuse and harassment, and Sec. 813, Civil Liability.

    Employing telephone calls in a harassing manner is prohibited by FDCPA.

    Send them a letter notifying them that they have repeatedly been calling you attempting to contact someone else, and that you do not know that person, nor can they be reached at your phone number.  

    Include your number that they have been calling you at, which should be sufficient for them to both find your information in their records or remove your number from their autodialer.   Include in your letter the times and dates of the calls, and the nature of abuse and harassment engaged in by their employees.  Demand that they cease all future telephone contact, as their repeated harassing calls are abusive and inconvenient.

    Send your letter certified, return receipt requested, so you have proof they got it.

    If you get further harassing calls, file complaints against them with your state Attorney General, and FTC, including a copy of your earlier letter.  Document the times, dates, and behavior of all their future calls.  

    In addition, if the callers are abusive, harassing, or threatening, tell them you are recording (and do record), and then tell them that you have previously notified them to cease calling.

    If complaints to your state Attorney General cannot stop them, find an attorney with experience in FDCPA litigation.  Your letters, log, and recordings of phone harassment should be sufficient to bring suit.

    There is no reason to toleration this behavior.
