Fraudulent Use Of A Credit Card

Ordered Dish July, 2013-- it was crap, never did what I was told it could do. So I CANCELLED IT 12 days later.  After canceling service, which I was told you cannot do-
I laughed and cancelled it anyway- verbally and by e-mail and then by certified letter.
I had auto pay with a bank Debit Card - which I promptly stopped payment authorization on through my bank the same day I cancelled Dish.  I was told there would be a $475.00 charge since I did not fulfill my 2-year contract.  I wished the Agent "Good Luck in getting my $475. Everything was fine, equipment returned, all was well.  Then, on September 30, 2013, my Capital One credit card was charged $475.  I immediately called Cap One Fraud Department and gave them the facts.  Never had I given Dish the credit card number, for any reason.  The auto-pay payments were ONLY set up with the bank debit card. I HAVE NO IDEA HOW THEY ACCESSED MY CREDIT CARD NUMBER.  Cap One Fraud Department resolved the issue and returned my $475.  a 16-day period.  Capital One is an awesome company. It stands behind its customers like no other credit card I have ever seen.

If they have your debit card, be sure to block that card number.
Whenever you have to cut off unauthorized payments, block all card numbers the perps have.

They have other complaints that suggest they dig into their files to attempt to find some card number to charge "contract termination fees".  For example, other consumers have reported that they may have given a card number to originally set up an account for a housemate or girl friend, the account charges were then switched to the card of the named account holder and charged, maybe for months to years, but on termination, they dug up the earlier card number which was under a different name than the account holder.

It doesn't appear they are real careful about whether they have authorization for such charges.

DISH was/is charging me an inaccurate charge. I have been dealing with their different 'levels' they have set up for this, including Christina Atencio (what a laugh!) and finally twice writing to David Clayton, CEO. The matter is being "looked into" (again more laughs).

When this all started, I called Cap One and froze their account that I had previously authorized DISH to use for regular monthly billings. After 2+ months and several tries by DISH to still put through an incorrect amount (a  $ number that has changed several times), Cap One advised me to just change the card number - cancel the first account and open a new one. Cap One said that would keep DISH from being able to bill me, BUT would allow me access to use the card again.

SURPRISE SURPRISE...approximately 2 weeks after opening this new number I received an email from DISH thanking me for the payment.  I called CAP ONE and was told by them: yes, a DISH payment had gone through, and, "they" didn't give the number to DISH, but a "middle management" company had. This was not a number DISH went back through files and found---this was a brand new account number that I had not used for anything.

During the 50 minute call that ensued, CAP ONE also got DISH on the line for a conference call, DISH saying the amount was proper and me saying not so. I informed CAP ONE (with DISH still on the line) that if they actually paid DISH then it is out of their pocket as I will NOT be paying them. I had to make several calls to get someone with "ability" to cancel my Cap  One account altogether...again telling them if they release the funds to DISH, a company that they illegally gave my new account number to, then they will be out the money themselves.

I am done with both companies, as far as bringing any business to them.
BUT I am just getting started in my complaints filed against them.
