Do not use HSBC for mortgages or refinancing unless you love to go through hell and lose money. I have investigations ongoing from state and federal agencies along with the better business bureau into the business practices of HSBC Bank, Mortgage Division. The complaint concerns two issues:
1.) Deceptively assuring customers that loans were pre-approved to collect non-refundable application fees
2.) Performing fraudulent appraisals.

On February 5, 2008 I inquired online to HSBC Bank on the refinancing of my manufactured home. HSBC Bank is the current lender for my mortgage for over 15 months which I have had no prior issues with or had any late payments on, so I thought it was in my best interest to continue my business relationship with them. I received a call of pre-approval from Denise Olszewski of HSBC at 1-800-622-7759 ext. 6393 and she brought up my account and asked me for more personal information and brought up my credit report. At this time we locked in a rate at 5.6% and I was told that I would have to pre-pay a non-refundable application fee of $525.00. At the time she brought up my credit report, which is a credit score of 678 and said that with all of the information she had that the refinancing should go smoothly and quickly. Knowing that they manage my mortgage and have for over 15 months, I paid the $525.00 after being assured that the refinancing would be done. After several days I contacted Denise to see how the loan was progressing, and was told that HSBC does not refinance manufactured homes and that they would not able to  refund the application fee of $525.00. Being that they have managed my account for over 15 months I was puzzled why they did not tell me that they could not refinance my home before they took my “non-refundable” application fee.

At this point I submitted a formal complaint and received a call from Denise’s supervisor. I explained my frustration that I was assured and pre-approved for a loan which they ultimately would not provide and that they would not refund my money.  I would not have given them the application fee of $525.00 if I would have known they would not refinance my manufactured home. She told my that I had given Denise false information concerning the property type, for which I stated that not only did I not give any false information, but that they have all of my information from the current mortgage which would made it impossible to falsify my information. At this point she told me that HSBC buys mortgages in bundles and has no idea of what those mortgages are, but she would investigate.

She called the next day to inform me that HSBC would not refund my application fee of $525.00. I the told her that I could not believe that after 15 months of making thousands of dollars from me that this business relationship was going to go sour over $525.00. She then apologized and said that the $525.00 could not be refunded because it was used for an appraisal of my house. I told her that there was not an appraisal done of my house and she checked on her computer and said that one had been done. At this point I told her that I am a certified Appraiser II for the Property Tax division of the Arizona Department of Revenue and that a drive by picture of a house may justify as an appraisal in New York, but not in the State of Arizona. She then checked the computer again and said that a full appraisal had been done of my home. I told her that in order for a full appraisal to be done, the appraiser would have to enter my home and therefore I would have to be present or someone representing me would have to be there. She insisted that a full appraisal was done. I then asked her how did someone get into my house and why would HSBC perform an appraisal on a house that they would not finance. She did not know. I then asked for the name and license number of the appraiser. She said that I would have to talk with underwriter Judy Harway at 1-800-432-5632 ext. 5173, but quickly said that she was not in that day.

I have left messages with Judy Harway, but she refuses to return my calls. At this point I felt that there was some kind of fraudulent or criminal business behavior going on and I wrote in another formal complaint to HSBC stating that I was going to file a complaint to the Comptroller of the Currency, the New York Attorney General’s office, the New York division of the Better Business Bureau and the United States Justice department asking for a full investigation into the mortgage practices and possible fraudulent appraisals performed by HSBC Bank. Since issuing complaints to state and federal agencies and multiple complaints to HSBC I have heard no response from HSBC and have not had any money refunded to me at this date.

The moral of this story is stay as far away from HSBC bank as possible. They will find a way, legally or not to take your money.

    Please be advised that HSBC cares little about the law, unless the law works for them. I too have had the displeasure of dealing with HSBC Mortgage Services Inc. Over 2 years ago I attempted to refinance a mortgage being serviced by HSBC. Understand that HSBC was not the originator but in fact bought my loan in mass from Accredited Home Lenders.

    In August of 2006 I attempted to refinance my loan. It was at this time the loan was found to be in violation of Truth in Lending, RESPA and latter as informed by the FTC, HOPA. I informed HSBC of this fact by way of a legal RESPA complaint to HSBC. While waiting for HSBC to reply, I had my mortgage audited.

    As a result of the audit my mortgage was found to be under disclosed by $288,000.00 and understated by $294,000.00. The APR was overstated thereby confirming the understated amount of $294,000.00. Payment schedules were missing or incorrect as was payment amounts. therefore based on these facts I exercised my rights under the law and rescind my mortgage. I sent as required by law a notice rescinding the mortgage. The reply from HSBC was that they would not comply with the law and rescind the mortgage. The law allowed me by failure of the lender to comply with the law and the required time frame the following.

    1. By failing to comply the note becomes null and void. That means I was no longer responsible to pay any mortgage payments, late fees or increase in interest. It also made the process automatic since HSBC failed to reply.

    2. I was entitled to all money paid up to the point of filing the notice and a return of all closing cost.

    3. And the lender(HSBC) was required by law to remove the security interest in the property.

    This is the law. Truth in Lending and RESPA clearly spell out how the lender must respond, when the must respond and further states that if the lender disagrees with the debtor it must file a declaratory Judgment with 20 days of the receipt of the notice. It is then up to a judge or the court to decide if the claim of violations are in fact valid. The law does not allow the lender to ignore the Right To Rescind nor does it allow the lender to ignore the Extended Right To Rescind. It must comply.

    HSBC's response "FORECLOSE". We went to court as HSBC had filed a foreclosure. While in court for the foreclosure a second and third Right To rescind notice was filed. In foreclosure Truth In Lending allows the right to rescind as an affirmative defense in the proceeding, as long as a error of $35.00 can be found. Again HSBC stated they would not comply with the law, and a stated earlier HSBC did not have the right to refuse and was required to have the court decide the validity of my claim. HSBC then had the court vaccate the judgment for strict foreclosure in July of 2007. HSBC walked out of court and has never returned or filed again.

    In the interim HSBC knowing that I filed claims of the loan being under disclosed, understated and having missing or incorrect figures sent in October of 2007 a letter stating that my interest rate and payment amount was due to change on November 1st, 2007. The new amount stated was exactly that was missing from the loan documents and confirmed that the loan violated the law. When confronted HSBC denied any wrong doing and walked away.

    I now have filed fraud charges with the US Department of Justice, and have had my file assigned to a Supervisory Special Agent of the FBI. I also have received by way of Staff Commentary of the FTC that the loan is in violation of the law. OCC has also supplied proof of violations by confirming that the APR is over stated and again violating the law.

    I am in the process of filing a civil law suit in both the Connecticut Courts and the 2nd District Court.

    This company lies, ignores the law, and will ruin your live and steal your home and money. The people who work for this company care little about complying with the law.

    Also understand that with the current bailout of banks and mortgage lenders, HSBC has refused federal money. If HSBC accepted the money it would have to open its books, show mortgage loans and comply with the law.

    If you have any business with this company run, do not walk, but run away as fast as you can. Do not deal with this company on any level. Credit cards, auto loans, savings or mortgages, they will cheat, steal and lie to get and keep your money.

    I am having problems with a loan notification program.they are putting through he'll.I have been trying to get out of my mortgage but they won't let me. I have been told that  they keep needing information about modifying my ,pervade. I have been paying my mortgage not knowing they put my money into an account till I get modified. In the mean time my credit rating is so poor that I couldn't get a car loan. My credit rating shows I haven't paid my mortgage. If there is any information you might have I would appreciate it. Thanks

      Is there any actions being done to HSBC in light of info that just came out. How it was backing Mexican drug cartels but refusing to re finance for decent Americans. We must band together to fight this bank.
