We filed bankruptcy back in 2009 and a year and half later we attempted to apply for the making homes affordable but we were denied because my husband makes to much. Bank of America told us they could not help us because we haven't missed any payments so therefore we started missing payments. The usual letter came about foreclosure and 8 months of not sending payments in we finally got a letter stating that we accepted for a a trial period for a modification. We made our 3 payments and expected to hear from them but nothing. We attempted to call our lead manager for 3 weeks but no return back. We finally filed a complaint and only then got a call back. We were told that our modification was delayed and to continue making our payment. Reluctantly we made that 4th payment to our lead manager and ended up overpaying by $37.00 because his computer showed a different amount to send in. After discussing it my husband and I did not feel comfortable sending in any more payments until we received a letter stating that our trial period was extended and the payment to send in so again we tried to contact our lead manager and nothing. We had to file another complaint to get him to call us back. When he finally returned our call he was very rude and his whole language changed. It went from when we receive our modification to when and if it goes through. We were told that they would not send any letter or coupons. This made us very uncomfortable and now we feel that hbank of america is up to something and being sneaky. We want to file a complaint but we are not sure who to do that with. We have now called a realtor who specializes in short sales. Financially it doesn't make sense for us to stay. We owe close to $400,000 and our specific style home is being sold for $155,000. We are going to file a complaint against Bank of America and our lead manager Mr Carlton Woods. We have been more than patient and now we just want to get away from this mortgage company . We are beyond frustrated at this point and have decided not to make any further payments. We feel in our hearts that they are just trying to get whatever money they can out of us and it will still go into foreclosure. Not going to wait around to find out so hopefully our agent can get somewhere with a short sale.

I was originally with Countrywide and was in process of modification .  I kept calling and was told it was still in process This went on for 3 months and then when I called again I get a greeting that said.  "Thank you for calling Bank of America" I was never notified that my loan transferred and when I spoke with Bank of America Rep about my countrywide modification process I was told I had to start over as BOA has a different procedure.  I had to get the package from BOA  I sent everything in and as everyone else I was told to send in 3 month trial payments.  After three months I called and was told "still in process"  I was never told to continue sending in the payments  and then after several calls and the same response, 3 months later I get a letter of denial for failure to make payments under the trial period.  I started again with new modification program and this continued on until now they tell me there is no other program available for me and now want me to sell my home.  As with many other homeowners my home is below value by 75% of what I owe and if modified I would be able to stay in my home.  It seems to be that the banks dont care about putting families out on the street they just want money.  They were bailed out and still are being greedy at our expense.  I will fight to the very end.
