ECF & Migration Fee

I was told (the second time that I called) that I was eligible to port my number back to Fido from Rogers, even though I had done it just over a year before. I confirmed this with the Fido sales representative I spoke with, and now am receiving a bill that totals $519 and the Rogers representatives are telling me there's nothing that they can do about it because my conversation with the Rogers representative who said that I was eligible was not documented/noted, there was only the previous conversation with the initial representative I spoke with who said that I was ineligible. This is stupid! I was told by a Rogers and Fido representative that the only fee I would incur would be the migration fee - if I had not been told that I would not have left because I do not have $500 to pay for the ECF! Now it is not being honoured and I am being penalized, yet again, for the incompetency of Rogers representatives! I am only being told that it is not part of policy and that I would have to switch back to Rogers to have the fee "waived" (meaning it would not be charged, since I would not be leaving anymore, not that they were actually waiving any fee, since that would mean doing a courtesy to me) and am pretty much being called a liar throughout this entire process. I'm so tired of Rogers B.S. and now I am being forced to stay or forced to pay the penalty for inconsistent information and documentation by Rogers representatives!!

    This is why they can do what they do:  Quote from terms and conditions:   .... If you do not accept a change to the affected Services, your sole remedy is to terminate the affected Services provided under the Service Agreement, within 30 days of your receipt of our notice of change to the Services (unless we specify a different notice period), by providing us with advance notice of termination pursuant to Section 34. If you do not accept a change to these Terms, your sole remedy is to retain these Terms unchanged for the duration of the Commitment Period (as defined below), upon notice to us within 30 days of your receipt of our notice of change to these Terms.

    9. Unless otherwise set out in the Materials, if you agree to subscribe to one of our plans or Services for a committed period of time (the “Commitment Period”), you may be subject to an early cancellation fee (“ECF”) for each Service. Any decrease in your Commitment Period may be subject to a fee. If your Service is terminated prior to the end of the Commitment Period, you will pay us an ECF as specified in the Service Agreement, plus taxes."    Since it was not document is one of the reason they can get away with what they doing to you.  When you ask they also refuse to put in writing that they are promising that you can do.  With no written proof they have an individual over a barrel if you have several months remaining in you commitment.
