When you do an over draft Bank of American will reshuffle all the amount for the last 3 days by largest to the smallest, not by date.
Then this will empty your acount quicker.
I got 5 $35 overdraft charges all of the items were done the day before I the one I should have been charged for.
On of them was $35 on a $2.00 charge.
The state and the Fed's don't care.
After Enron I thought that we were to have ethics in book keeping.
Bank of America has none.
They will give lips service, but not any money back.

As a banker the majority of banks pay largest items first to smallest.  This is across the board.  The reason being, we figured you would rather us pay your mortgage/rent, childcare, car payment first.  The bottom line however is this...if you don't have money in your account, then don't write that check or use that debit card.  If one of my clients came to me and asked me about the fees, the first thing I would ask is "where is your register (or journal)?"  If they don't have one, I can't help them.  There is no way to find an error if I don't have your records to compare to mine.  Another thing is the fact that we have no control over when the vendors you pay will submit your check/debit card approval for payment.  Also, with Check 21 there is no longer a long 'float' period for check clearing.  I understand that mistakes happen and we have emergencies, but to blame the financial institutions for your own shortcommings is ridiculous.  One last thought...Bank of America is on real time.  This means that if you have 12 itmes coming thru that day but your deposit is put in at noon...anything you did before noon will not be 'caught'.  They go by what time things hit their accounting system.  I would suggest you find a bank that is more local, processed credits (deposits) before debits(checks).  This will help you greatly.  Also, you need to understand that when you run your debit card it could take up to 2 weeks for the vendor (gas station/grocery/etc) to batch or finalize their machine.  This is out of the banks control.  We can not deduct that amount for your purchase until we receive the final batch from your vendors.  I know this doesn't get your fees back but maybe a better understanding will help you to not have this issue again.  As for the State and Fed not caring is silly.  Banks are HIGHLY regulated by the Fed and we are audited atleast annually (usually quarterly) to make sure we are federally compliant.  With those regulations it's near impossible for the bank to 'rip you off' or 'steal your money'.  Bottom line...if you don't have the money...keep your checkbook and debit card in your purse or pocket!  Own it people!

Have you tried calling Bank of America and asking for a removal or reduction of this late fee?? Many times, banks will do so. Be polite but firm.  If the first person you speak with is not helpful, ask to talk with a supervisor.   If they totally refuse, tell them  you will be forced to close the account.

I have Bank of America and have had it with them.  The recently allowed a company to take money from account w/o authorization and it caused several checks to bounce.  Everything would have gone through just fine if this reoccuring fee ID theft is taking wasn't there.  They refuse to refund me any money even though I didn't authorize ID theft and now have other bills that aren't clearing and bank fees piling up.  They claim they are so wonderful about protecting you. but they aren't.  Screw bank of America

They - have allowed someone, how about you providing someone. Take responsibility for your goof up, the banks have better things to do.
