On or about May 25, 2010 I called BAC Home Loans to learn if I could get a   modification to lower my payments. I was told that I was eligible for loan modification and I agreed to participate in the “Home Affordable Modification Program” (I was never told that BAC Home Loan is a participating servicer for my lender), which is a federal program introduced by the U.S.Department of the Treasury to assist at-risk homeowners restructure their mortgages to avoid foreclosure.

I spend months feeling “harassed,” “like a yo-yo,” and “blocked at every turn.” When I called BAC the information I received over the telephone often conflicted with written statements or prior telephone conversations. In many of the telephone calls BAC spun me in a labyrinth of transfers from one department to another and back again. I spent hundreds of hours on the telephone, explaining my stories to different person each time I called; often  I was transferred between departments knowing I would never speak to the same person again, and wondering if the information I was provided would be contradicted by the next person I spoke with. Often, I requested to speak with supervisor or manager was met with resistance. During the course of telephone calls I often found myself disconnected after waiting on hold to speak to a supervisor, or I was told that no supervisors were available. I was asked to send and to sign the same documents three, four or even five times, and I asked to provide the same information repeatedly.

After almost 6 months On January 27, 2011 I received a letter telling me that they received my documents. Two days later on a letter dated January 29, 2011 stating that I was not eligible for a home Home Affordable Modification because I was current with my Mortgage Loan, although I already send a hardship and told that in order to be eligible for Home Affordable Modification I have to be current with my payments.

After that I began having difficulty making my mortgage payments. I made some payments on time, sometimes made partial payments and sometimes missed payments. BAC misapplied some of my payments even refused some of the payments I sent, and the result was to report me as delinquent to the credit agencies. I continue to applies for a Modification only to spend more months being shuffled through BAC “Home
Retention,” “HOPE”, departments with no resolution. I was assigned multiple
“Negotiators” who would not return telephone calls, or provide timely information.

I sought out face-to-face interviews by contacting Bank of America branch office, but simply found myself on speakerphones with the same unaccountable departments that had previously been providing them with misinformation by telephone.
On August 24, 2011 I received another denial the reason this time : “The workout assistance you have requested is not an option”
This event caused me a great amount of stress, over the course of my dealings with BAC, I suffered anxiety attacks for which I sought medical treatment and I am now on a medication.
As of today I received no help. Only to have a serious delinquency shown on my credit report.

    BAC did the same to me,..except,they bumped my escrow up twice in 6 weeks...making my mortgage payment rise by 50%,
    I did all the help programs,...i didnt qualify, they basically stole my house back,...and ruined my credit in the process.. they are [***] indeed.

      you were denied because your fin.  dont meet guidelines or your investor doesnt do mods.

      on the lady on escrow acct.  thats easily corrected.  talk to their escrow dept.

    I got this letter today. I am NOT leaving my home. If they want to kick me out, they better be prepared to  come shoot me because I am not leaving!

    bought our house 15 years ago...
    never made a late payment...
    we both lost work because of the economic crisis in america....
    we went through the "loan mod" process and were told we qualified....
    after months of jumping through their hoops and over their hurdles they finally
    sent a letter stating congratulations!
    here's your loan modification:
    but they didn't lower the interest rate....
    they didn't put the delinquent payments on the back end...
    they didn't help by lowering the balance...
    they actually UPPED the mortgage payment and demanded a check to bring the loan balance up to date!
    too bad we couldn't afford to retain legal representation...
    i KNOW they were just setting us up to foreclose...
    so with all the equity we had...
    and love of our home and location...
    we ended up having to do a REVERSE MORTGAGE just to keep our home!
    i think we got away from the evil bank just in time...
    but i guess i shouldn't complain....
    we're still here where we always wanted to be...
    while so many americans have lost their homes after doing business with this bank...

    Other banks have done better..
    Chase has been doing HARP refis for several years, no cash closing, refied to current rates on same loan term period as before, costs paid by Freddie or Fannie.

    You can find many consumer reports on how smoothly they are going through.
    Their refis have been sailing through smoothly, about 30 days.

    the run around for 2 years,
    i have been dealing with bank of america for almost a year , 3 reps and still the same place i was a year ago, i still waiting on a ans. i feel like a bank can mess with you and mess with you and nothing, why???? how can they get away with it? i have sent the same paperwork 3 or 6 times and STILL NOTHING!!! what can i do?

    Apparently I got denied because I couldn't fax a form over to them at 7:30 in the evening from a bank branch office that closed at 5:00, although they never did bother to inform me that I was denied. I asked them the status today when they called wanting to know why my regular payment that was due on November 1st hadn't been received yet. They called me on November 5th. I'm pretty sure that the only reason they went through with some of the modification paperwork was to collect the money the government promises them if they initiate a modification.

      I think that everyone with a BoA mortgage should just stop paying on the mortgage for the month of December 2012.  We need to shed some light on their practices.  The light must be bright enough for the media to take note.  That will happen if substantial numbers of people refuse to pay.

    not a BOA FAN
    Have been dealing with Bank of America for over 3 years. I didn't ' qualify' for HARPS program but they offered  the ' inhouse Bank of America modification'.  It took over a year to get this modification that DID not reduce my payment, it made it higher and almost impossible to pay. They added all late fees interest etc to the end of my mortgage, and this put me 'UNDERWATER' with the value of my home. They reduced my interest rate.......but.......they did not reduce the maturity date. So messed up with dealing with so many different people , who at times NEVER returned your phone calls. I can understand the frustration of many who posted here. This bank is ruthless! Now I've received a new offer.......after getting my modification a year ago.........Now they want to RE modify my mortgage and also are offering a PRINCIPAL reduction to my mortgage.  This is what should have been done a year ago........I need to meet with one of their customer service people asap.......I want to know HOW long this will take........another year??? If I could refinance my loan with a good bank I would....I'm stuck with no equity because this mortgage is Underwater.

    I've applied 2010 got mod papers from bank of america 2011 same stories made all thanks payments for a year jumping through paperwork missing doc on the phone every other day cause if you didn't keep something would go wrong like I wasn't interested in the mod any more it like getting on a ride going on a merry go round lots of stress then they put me in-house. Mod for six months and was denied then they said we can't help you Mr palama bring you payment up to date to avoid for closer it been a year a a half didn't make a pay ment wasn't behind on payment till they said make the mod payment instead of your regular payment they will not get away with thisbank of america

      They did the same thing to me.  In 2011, my husband and I split.  I tried to get a modification to stay in my home.  All the while, making payments on time but barely feeding my family.  I kept getting denied over and over again until September 2012, I received a letter stating I qualified.  I was told to make trial payments for the next five months.  If I could swing those, then I would be accepted.  Since then I've been bombarded with Fed Ex packages from BOA stating I'm behind on my mortgage payments and in danger of foreclosure!  This is a travesty to the American people.  I was starving before, but at least I have a roof over my head.  Now my credit is ruined and I'm in danger of losing my home when just six months ago I was making it.

    Don't waste your time with B of A
    My story goes along with the previous stories, it gets better---Bank of America strings me along for 5-6 months and then decides to sell my loan to another mortgage provider, they don't come out and tell me the modification is no longer in the works, I have to ask.  I have wasted 5-6 months in this process, I would not recommend doing business with Bank of America--they are not out to help, they just want to string you along.  Bad business practice!!!  Everytime I called in I would get a different rep, the rep assigned to me could barely speak english, I sent all information requested and still get screwed in the end!!!  Thanks Bank of America!!!

      You need to contact a law firm that specializes in class action lawsuite. I did that a few years ago, not with BOA but another lender. This law firm filed suit for me because I could not get any cooperation to refinance. Turns out, the law firm found 33 other plaintiffs they screwed. I ended up with 4 grand and got my refinance only to be held now by BOA. I have tried to get a loan mod since August and I get the same run around as others.

      Don't forget BOA is being sued by the government for a billion dollars because of the Freddie Mac and Fannie Mae mortgage fraud, so we may eventually see BOA's demise! The government needs to make an example out of them!

        the gov is the PREDATORY HELPER . the lawsuit was BS just get back the home affordable act money they were using to doctor false documents to give to fannie to now have "valid" mortgages?

      Yes, file a complaint with the comptrollers office of California.  I will be doing the same. My story is long but i will be posting my problems to this sight soon,D6AB

    Had enough of BOA

    I'm going through the same thing with Bank of America now. I'm on to the second recommended law firm from BOA and only to find new stall tacks. I just called them today to see what's going on since I have resubmitted my paperwork for the 3rd time to only find out that they don't have a mod on file again. I just resubmitted Nov 12th and no feedback. So I called them. I'm looking to file a lawsuit.

    I am also intrested in a lawsuite against BofA.  I have had the same stories as above.  There has to be someone we can contact about this.
