NOT COMPLIANCE TO ISO/TS16949/SAE STANDARD ( Gear Box Malfunction in 26670KM

I had purchased a motor vehicle from Auto Bavaria Glenmarie (under auto Bavaria authorized sales person Mr.Jerry Choo), The vehicle model :BMW323i(E90, LCI/N52,CKD), Registration Number:WUV4020 Year Make:2009 . The car was purchased from Auto Bavaria Glenmarie (Sales person: Mr.Jerry Choo )Engine Chasis No:PM1PG74060A580424 ,Engine No:73574464,Vehicle Current Mileage:26670.Unfortunately,thevehicle has not been satisfactory because the vehicle whole body shaking and vibrate while driving in 40 to 50km/h. the vehicle been send to Auto Bavaria Glenmarie,Malaysia service center on 23 Nov 2013 , 12:12pm ,further troubleshooting report of fault from Auto Bavaria Glenmarie was stated as Gear Box malfunction. I can digest a BMW with ISO/TS16949/SAE STANDARD
Are producing a not reliable car. The gear can malfunction at low mileage as 26670KM . The are no history found that other posh car models with this type of gear malfunction.
With reference to above subject, regret to informed as a certified company (BMW Group Malaysia or Bavaria Motor Works-BMW) not compliance to Global Automotive Standard of ISO/TS16949/SAE.The company fails to meet following basic requirement of process quality approach:
1. Design the product to Customer requirement and expectations.
2. Analyze on process and product compliance to Engine Compartment functionality, stability and durability.(DFMEA/PFMEA not effectively pointed and meet CSR).
3. Product validation(Endurance test 100~300K KM mileage)not been effective close under reliability qualification phase.(Robust analysis and optimization design)
4. Fail to capture, Market recall analysis on "Voice Of Customer"
Further highlight not meeting above qualification phase and will impact your Company reputation.
Since these defects substantially impair the use, value, or safety of my vehicle .I look forward to settling this matter amicably. If, however, the matter is not satisfactorily resolved as soon as possible, I will consider taking further action to resolve the complaint through the courts and publish in media or press if no compensation or goodwill offered from your side.

Complaint already posted to technician team from autonbavaria sg best branch and bmw website But until today there was not any reply or nobody from there giving advise what need to be done but as consumer we have to source all over places to look for solutions IT WAS HELPLESS & disappointed with the services received !! I doubting on the competency of the technician team and doubtful BMW have sufficient foreman to serve and solve car problem and cope up the complaint since it came with warranty !,
Now the unsolved sound of the car still not resolve yet & the free servicing mileage is coming to the end only left 1400km then the problem all came back to me and my pocket !, IT KIND OF FRUSTRATING & UNFAIR !!LOTS OF MY TIME WASTED because I keep sending my car average almost 2 months once - problem coming back
To be fair to me & all the hassle caused , I would Auto Bavaria should extend my servicing mileage TO INVESTIGATE THE UNSOLVED CAR-PROBLEM & to replace all the hassle incurred to me .

Since my email last Friday – no one has the courtesy to call me regarding my email below.
I am very disappointed in terms of the after sales customer services. On Friday itself, the customer service only called my son Anas to check whether the car has been towed and thereafter informed that they received the car and promised to get back on the condition of the car. Then on Monday En Faiz called my hubby for the courtesy car, by then, I am already disappointed with the After sales customer service, as well as I am so traumatic with the condition of the car, being the third time having the same problem, so I told my hubby, not to take the courtesy car.
FYI, the 1st time – my car has the problem on the battery, it took almost a week to rectify. Then for the 2nd time, my car almost 2 months in the workshop and the courtesy car just came only about 3 weeks before my car is ready. We only got the courtesy car, after several arguments back and forth between my hubby and with the Glenmarie branch. Just imagine, I have been paying the BMW credit for nothing, for not being able to use my car for almost 2 months.
Now again – the car having problem, hence I have decided to stop the payment to BMW credit for this month, please see the sms I got from bmw credit….of which, again, if I pay, I am paying for nothing as the car having problem, in the workshop and not with me. I am at the disadvantage in view of this.

I am no longer interested to use your brand car… and I have decided not to have my car unit back. So, if you want me to continue paying the loan, you need to replace me with brand unit 330E with no cost or you take back my car and offset it with my balance loan.
I am putting on record, because if I received legal letter from BMW credit on my non-payment of loan, I will not hesitate to personally go to kpdnkk/tribunal and will engage a lawyer to fight. FYI, I have lodged online report to NCC centre.
