These people have been calling me for months, but never asking for me by name. Their message always begins: "Portfolio Recovery Associates... Please return this call at 1-800-860-0644..." They go on to say, "This communication will be with a debt collector and is an attempt to collect a debt." Then they give their corporate address -- nothing else.

I searched them online and found that there are many complaints against this company. They buy old debts for next to nothing, and then try to intimidate people into paying. They must be stopped.

I would like to join a class action against them. Please advise.

    Call Lemberg & Associates, they will work with you and stop all that nonsense.  I know from experience and I got the debt collector to pay all attorney fees plus pay me $1,000.00.  Can't hurt to try, or www.StopCollector.com.

    I received calls from them all the time about a $4.000 dental bill. I never owe. They name a bank I dont have any accounts with.They even have my last 4 of my Social and DOB. How did thy get my personal info?

      You may have caught them in a deceptive bluff, i.e. attempted fraud.

      Most likely your info was never attached to the original dental bill, particularly if that was tied to a bank account that was not yours.  Opening the bank account would generally require id (DL) and SSN, and although it might be id theft, more likely they are "fixing" their account information to deceptively pressure you into paying it.  They might not actually have enough id with the original account info to know who owed it.

      Best guess: They are pulling credit report and skip-trace information based on your name or a similar name match, and filling in the SSN and DOB info that actually applies to you.  They might, for example, be using Accurint and pulling credit reports.  Pull your 3 credit reports, and you might find an inquiry on one of them, which would have allowed them to get enough identity information on you to pretend this was "your debt".

      Debt collectors use id information pulled from sources different from the original account information to "prove" you owe it, as an attempt to evade your expected demand for validation.  Far from being proof, it is how you can catch them red-handed engaging in deception and fraud.

      Send them a letter, mailed certified, disputing the alleged debt and demanding proof you owe it.  If they fail to send any proof, or only concoct their own letter claiming you owe it with nothing from the alleged original creditor, you know they were trying to bluff you into paying what they already suspected you didn't owe.  


      If you catch them continuing to try to collect on some unowed "debt", get an attorney and sue them for deceptive collection or erroneous credit reporting, violations of FDCPA or FCRA.  These allow courts to award damages and attorney fees, so you can find attorneys who take cases on contingency.  You can find a consumer attorney in your state through www.naca.net

    I have just contacted them by phone to tell them to remove my number. They say my husband gave this number as a contact number in 2004. Funny thing is this number was just received in Feb 2012. Funny people. I told the man that my state laws allow me to tell them to stop calling or I will contact my local PD for telephone harassment. No one is allowed to continue to call you after you ask them to stop. Worst part is this is a number in my name with my local cable company. Just because we are legally married does not mean they can contact this number. If they start calling on the cell phone then I will do the same, that is also in my name. These people are nuts and just so you know I called them every choice name in the book. The guy says oh you have some intelligence, I laughed and said Yeah piss me off some more!!! You do have the right to ask for all contact by mail.

      I have told them to stop calling me too. they constantly call and i am tired of explaining my situation to them, so i am choosing to ignore them rather than go off on them again

    Yeah, JDS recovery,  this is the worst ever company that ever existed. They call excessively and leave threats and statements about being arrested and coming to your place of business. Calling your relatives and giving your personal information. That let me know they were not legal but scums.  Also, stating that they are filing charges against you for writing a bad check. Mine was an internet cash advance which I know I paid over and over until I could not keep up the payments. These people are scum of the earth the way they talk to you on the phone, you could not keep an intelligent conversation with them at all. They could not be legimate. Their intimidation tactics are beyond reproach and cannot be legal. There has got to be a law against these scum bags. As soon as i welched on the payment arrangement then they started cursing at me and stating that I go to hell. How do collectors like this prey on the public? Pure Scum bags.

    Be aware of the times in which creditors make telephone calls. Be ware that creditors are restricted by federal law from contacting you after 8:30 PM your time Monday through Saturday and are not authorized to contact you on Sundays. If they do violate this than you may be able to file a law suit against the company for violating this federal law

    This is getting better and better, I got the same M.O. and called back wondering what was it and they told me that my number was on file and if I knew [mentioned 2 names], 1 of them is my sister's name and it was related to Texas, the other I have no idea about, no one in my family has that name. Anyways, it gets better... my sister DOES NOT live in the US, only has 1 bank account in the city where I live (and is WAY far from Texas) and she doesn't even have SSN because she's not resident or US citizen.

    These leeches call my 13 year old daughter's cel phone every day.  She obviously does not have any outstandind debt and neither do any of us.

    My only assumption is that the person that owned her cel number before her had the debt

    I have been receiving calls from this debt collector company, to my home and cell numbers. The person I spoke to, keep asking for me to setup a payment plan over the phone, she even told me the name of my bank. I asked to send a letter to me stating all the info she was asking me to do over the phone, but the person refused and got upset. It seems like a scam to me, that a debt collector will refuse to send a letter, to the debtor instead than just asking personal info over the phone like bank account numbers. I told her that until I receive a letter in the mail, I will not pay a penny to them. Do you think I did the right thing? Thank you for your reply.

    Under the Federal Fair Debt Collection Practices Act, you don't have to run hoops to get Portfolio and similar scum to stop calling you. Section 806, subdivision 5 provides (effectively) that repeated unwanted calls where the recipient communicates that he doesn't want further calls is harassment. Moreover, local laws governing harassment apply.

    Don't let anyone tell you that you need to send Portfolio registered letter. They don't deserve it. You don't have to send a registered letter to get scum to stop harassing you! Just tell them in no uncertain terms you don't want them to call.

    If they continue (and they will) take police or civil action if you have the inclination; otherwise, HARASS THEM. Call them three times and scream at them for every nuisance call. Abuse them heartily. That seems to stop them. They can't complain about your harassing _them_, because if they don't want contact they shouldn't be calling.

    I won!
    I contacted Virginia's attorney general office to file a complaint about the continued harrassment regarding a ghost debt that passed the statue of limitations in my state. Their business representative sent a letter to the attorney general saying they would close my account and not contact me further regarding this debt that is not even being reported to my credit bureaus. Call Virginia's AG and keep notes of contact made with PRA. These guys are relentless if you let them. Ignoring them just adds to the problem!

    I've been getting calls from Portfolio Recovery almost daily, twice a day. I've called them back and they kept asking for an identified person. I kept telling them I don't know that person by the name given. They said they would take my number out of the system. They still call! I have an outstanding credit and have worked very hard to pay all of my bills on time. I work 2 jobs, 7 days a week. I feel harassed. What can I do to get them to stop calling?

      You could sue them for violating FDCPA, which prohibits abusive and harassing collection, including repeaded calls for purposes of harassment.  Since FDCPA allows courts to award both damages and your attorney fees if you win, there are attorneys who take these cases on contingency.

    If these folks are calling your IPhone get on the Internet and download a silent ringtone load it and block callers by assigning them the silent ringtone. Your phone will show you they called but you won't hear it etc. also the message I have ties up there computer for 2/3 minutes with BS. I have no debts but the previous owner of my number did. As of today I have 46 blocked numbers

    they left over 20 phone calls to my office number. but have never called during business hours. i finally called back and they asked if someone with the last name BOGGS was available. I told them nobody with that name works here and they said ok thanks bye. thats it. after numerous calls they had the "wrong number" wtf.
