ACS Litigation Threatens to Take Me to Court

Was left a phone message that a process server, Destiny Brooks, is trying to reach me and to call her back at 866-395-3362. I called and was told I owe money to My Cash Time and they were taking me to court for fraud, taking out a payday loan with no intention on paying it back. They said the called me several times and I did not respond. I asked for more detail, turns out they called me ONCE and left a message back in July of 2011 ten months after the alleged loan. I asked where are they located? The girl, Ashley, on the line said "For what reasoning?" OMG, this is a professional place? For what reason, Ashley...
Anyway, she would not divulge the location even when I said I wanted to send a response and a cease and desist letter, just said she will see me in court and hung up on me.

    I received a message from a blocked call saying I wrote a bad check and they were going to come find me at my place of employment or my home. They didn't even pronounce my name correctly and do not say who I supposedly wrote a bad check to. What a joke.

      called me and say i had taken a payday loan out six years ago. called someone else in the family and said would put a bench warrant out. wont give address out when you call back

    Same story they were going to take me to court, and have police come to my work and take me to court for check fraud even though I got nothing by mail or phone and I couldn't speak with the "loan" company or have any documentation because there "wasn't time" I must admit it scared me to death.

      Yea they've been saying the same thing. I do owe a payday loan company who I contacted and they said they are not suing me but "ACS" is. Reps were rude and at least 2 hung up on me when I caught them in a lie. They are charging me an additonal $300 for fees that no one can explain to me. Wont give me an address or city and insist that I pay with a pre paid card. Im not saying I dont owe the loan I just dont feel comfortable paying it to ACS which after my research does not seem to be a legitimate company!

      Was wondering what happened in your situation?...Cuz they are threatening my husband to go get him at his work and arrest him if we dont call back the ACS litigation dept....Some lady by the name of MS McMullin called me saying that my husband has three acts of fraudulant activity and was in trouble....someone told us they cant arrest him and it was all just a scare tactic and we should just let our lawyer know whats going on and he will handle it....just curious what happened in the end with yours..

        You cannot be arrested for a debt.  If they change it to a bad check, then they may be able to in Texas especially.  But just because you did not pay back a loan, they cannot arrest you.

    ACS has called my house phone looking for someone who apparently does not reside at this number. I informed them this person they are looking for does not live here. This has been going on since mid february and I want it to stop and this was told to them over and over again. I spoke with a Michael Simms and he was very, very, very rude as a matter of fact has hung up in my face after him and other from this phony law firm has called my house. I asked to speak to his supervisor and he said he was the manager. He is very rude and needs to be FIRED!!!!!!

    These calls from ACS, NCS, etc. are scams. They are trying to find people to steal money from. Hang up immediately, contact phone company to block caller, and file complaint at FTC.gov.  Don't ever call them back. Ignore long enough and they'll give up.

      They call me every 3 to 4 mo saying I owe but will not send me anything even gave me the wrong ss#

    ANYONE RECEIVING CALLS FROM ACS LITIGATION FIRM SHOULD GO TO FTC WEBSITE AS WELL AS FDCPA, you can sue them & get paid up to $1,000....

      Problem is, you will never find them to collect.

      They are hiding overseas, using cheap VoIP in an extortion racket.

      They harass you, harass them back until they give up.
      Or determine their VoIP telecom, and file extortion complaints to get them cut off.

    Wow...these guys are ridiculous...I have been told a state prosecutor will be serving me shortly, I think I will put some lawn chairs out front and wait.  Kept insisting I just pay it and try to get my money back after the investigation was over.  "Mr.Drake from ACS with no website, no address"  Do you really think I am that stupid?  And whats with the names?

    I was just told they have an investigor in my county ready to serve. I told them that the fair debt collections act requires then send me something in the mail. He said they were not a collection agency but a private litigation company, but if i did want to pay the debt they do have a collections dept......what a crock. So then the collections dept said i would be served.

    Yes, I feel all of you!!! I just got a call today telling me that I was going to be served for a fraudulent check issued in 2008 Dallas TX for a payday loan on the internet, where I was NOT! But the kicker is this call is a year + after I gave them authorization to debit my account for the 300 in 2 payments. Well today I find out they took 180 the 1st time and $5 the second time. Ok, so I want this off my name I told Anthony Jones that I will give my card number same as last year for payment that was now up to $300 on today for payment on Nov 2 when my direct deposit hit. I was told NO! it had to be in 24 hours! I dont have it and wonder about this account that I suppose to owe. Why wait a year later to contact me?? I never moved, account never changed, job never changed and phone number never changed. I just find it really odd. I was told they called me aug  2011 after they didnt get the 2nd payment, REALLY! NOW THEIR THREATENING ME AGAIN BUT REFUSED MY MONEY TO CLOSE IT...

    i have been getting calls and have actually paid them 100 and then missed a payment and now they have called saying that if i didnt contact them in 2 hours they will b sending local law enforcement out and they gave my registration numbers on my cars which i have no clue how they got that

      They called my dad that I hardly speak to and my wife at work and told them they were going to sue me and and have police at my door if I don't call back in 2hrs. When I called , I told the man to only call me and he started yelling like a mad man. He than said they had my file for 3 weeks and they were trying to reach me for months, than someone else said they only keep files for 72 hrs. Of course they wouldn't give me an address and they have to have a credit card payment only.

        It's a fake "debt collection" extortion racket.
        Ignore them.

        Real debt collectors send letters as required by FDCPA, within 5 days of first contact, to notify you of the alleged debt, and of your right to dispute it.

        Those who don't, are fakes.

    My mother received a call today from ACS litigation.  The call was for my brother-in-law on my husbands side, absolutely NO relation to my mother.  They left her a rude message on her machine saying if my brother-in-law didn't contact them within 2 hrs they would pursue with a court summons for check fraud against a financial institution.  First, debt collection companies are not allowed to leave detailed messages on answering machines, only that their call is an attempt to collect a debt, their contact information and an account or reference number.  My husband called my brother-in-law to tell him and he has no idea what the call is regarding.  Obviously this is a scam!!!  Googled the phone # they left on my moms answering machine, 855-734-0411, and all that came up was "scam" and "complaints".  I tried calling the number back and kept getting a voicemail for someone who works at ACS litigation.  I plan on calling back every hour until I reach a real person, and then giving them a piece of my mind!

    I too received a voicemail today of the sane thing... I'm poised because these foreigners come here, get great jobs and sell our information over seas......
    I'm waiting for then to call me Asian so that i can actually answer and act as an attorney......

    tired of these scam artist calling me and my family members, saying if I dont call them back within 24hrs that the copps would be serving me court papers about a lawsuit. there so dumb they have tried this 3 different times about 2 weeks apart . leaving a message to call chris at 866 205 4961 ext 1431313 I did call from another phone and the ext. rang and rang then got a voice recording that said the ext. was ashley  leave yr name number and acct. number and she will get back to you.
