Both of my adult children were contacted via telephone by individuals   claiming a complaint was registered against me and if I do not contact the "firm" within 48 hours the firm will be forced to make a decision without my consent. My son was very concerned and called the number they provided 855-265-6780.  He spoke with William Brewer who refused to give any information.  My daughter got the same voicemail from a woman named "Elaine."  I called the number and asked to speak with "Elaine." I gave the "case number" and was told William Brewer was handling my case and was transferred to his extension.  I asked Mr. Brewer what type of business this is and why they were contacting me.  Mr. Brewer asked me to confirm the last 4 digits of my SSN.  When I refused to do so, citing concerns of identity theft he stated we were "at an impasse."  I again refused to provide personal information at which time he stated he could continue the conversation if I confirmed my date of birth which I did. Mr. Brewer said the company is called TCF & Associates based in Murrieta, CA with offices in Las Vegas, NV and Ft. Lauderdale, FL.  He said they were hired by a bank, while I did have an account with this bank over 10 years ago the past the dates Mr. Brewer gave were not consistent with my actual account information.  When asked questions such as the name of local counsel, date of cause of action, and other inquiries to determine whether or not this was a legitimate call Mr. Brewer became extremely defensive and rude.  I asked if he was a lawyer; he refused to answer.  He stated he sent 3 letters I told him I never got anything in the mail.  He told me I had no right to see anything in writing and that he does not file against everyone but because of my attitude he will make sure that I am filed against.  I asked to speak with his supervisor and before I finished my sentence was put on hold. After 10 minutes on hold I hung up and redialed this time asking for the supervisor of the legal dept.  The man who answered knew nothing about what type of company it is, said he is only a switchboard operator and transferred me back to Mr. Brewer.  When I got Mr. Brewer on the line again I repeated my request to speak with his superior.  He claimed to be the supervisor and yelled at me that I have called 4 times this morning, which is untrue, and I am harassing him.  He threatened that not only will he make sure I am "filed against" for the collection money but will add a harassment complaint against me.  At this point Mr. Brewer said we were speaking on a recorded line and repeated his threats of lawsuit then hung up on me.  The entire incident seemed so suspicious and unprofessional I looked the company up online and found multiple reports of scamming and fraud identical to what I experienced.  I contacted the bank directly and was informed that they have not had anything to do with my account in years and knew nothing of TCF & Ass. or William Brewer.  I googled "William Brewer Murrieta, CA complaints" and found numerous stories and warnings against him individually using different company names.  I urge anyone who receives a similar phone call or message to report it immediately and do not give any information to them.

    Typical shakedown scam..

    Real collection agencies will send you a letter within 5 days notifying you of the alleged debt and allowing you to dispute and request proof you owe it.
    The fakes harass relatives and coworkers in violation of FDCPA, and make threats to get money while evading providing any proof.
    If they won't comply with the law (FDCPA) you are at an impasse, but so what?  These scams don't sue because they have to hide from lawsuits and prosecution themselves.

      William Brewer IS an attorney in Southern California. There has to be someone using his good name. The William Brewer I know, is a ethical hardworking businessman who has a passion for helping those in need,especially the under privileged children from the inner cities, which is where I had the pleasure of meeting this fine gentleman, at a fundraiser in downtown Riverside raising money to help inner city kids from the inland empire. Shame on anyone calling this man a fraud!

    file complaints with FTC and your state Attorney General.

    FTC shut down a bunch of similar scam "collection agencies" in Southern California several years ago.  The rats scattered, and some reopened shop under different names. These might be some of those.  Let FTC know what they're up to.

    They were calling themselves "BCI (Bureau of Crime Investigation)".  Illegal on its face.
    Reports consistent with phony "IRS" shakedowns by overseas scammers.

    Inconsistent old "bank account" information is consistent with a fraudulent shakedown using information they might have found online, or through phony "payday loan" websites if you have ever applied on one.

    The language used...
    ...smells of something overseas:  "A complaint will be filed..."  No debt collector in the US says that.  They say that you'll be arrested (which is equally bogus).  "At an impasse" is suspicious too.  Just because they cited a CA location and a US bank doesn't mean that the person you spoke with was in the US.  It does, however, mean that there is a corporate structure with at least one foot on domestic soil.  This means that you can get them for FDCPA violations.  Talk to your own state's Attorney General and find out if there is someone from this outfit who is registered as able to receive a subpoena.  If so, talk to a lawyer.  You might have some legal options.,  And, regardless of whether you can sue or not, file a complaint with the FTC.

    The link is fine...
    ...but these guys are famous for farming out their phone banks overseas.  Sorry, but the language sounds hinky to me.  Even though, it seems as though, given the info in the original post, that the 'mother ship' is here, in the US, and, thus, vulnerable.  I wouldn't worry about what country you were being called from.  The ultimate goal is to get them to stop and too often, when a debt collector is from overseas, they don't comply.  But when the company is sourced from the US, they have some assets at stake.

    Encore is  an example of outsourced phone banking by debt collectors.  Experian Credit Reporting is too.  But I wouldn't let that deter the original poster.  Go after the corporate haunchos.  That's where you want to go anyway.

    4)  I asked if he was a lawyer; he refused to answer.  He's been implying it, and he doesn't deny.  Deceptive collection.
    5)  he stated he sent 3 letters I told him I never got anything in the mail.  He never sent anything.  Deceptive collection.
    6)  He told me I had no right to see anything in writing  False statements about consumer rights under FDCPA.  Deceptive collection.
    7)   he does not file against everyone but because of my attitude he will make sure that I am filed against.  He isn't suing anyone.  Deceptive collection.
    8)   He claimed to be the supervisor and yelled at me that I have called 4 times this morning, which is untrue, and I am harassing him.  He threatened that not only will he make sure I am "filed against" for the collection money but will add a harassment complaint against me. Threatening action he can't or won't take.
    9)  At this point Mr. Brewer said we were speaking on a recorded line and repeated his threats of lawsuit then hung up on me.  Violates California's 2 party recording law, if disclosure was not given prior to recording.  If not recording, abusive and deceptive collection.
    10)  I contacted the bank directly and was informed that they have not had anything to do with my account in years and knew nothing of TCF & [***]. or William Brewer.  Then the bank didn't hire him.  Deceptive collection.

    Alleged locations..
    Southern California, Las Vegas, and Florida, are pretty typical for scam "debt collectors" with connections to scammy Buffalo area "debt brokers".  It appears that they sell really old, out of statute "debt" of dubious legitimacy for pennies on the dollar, to be used by these scammers for shakedowns.  They might have old information on  your account, but if so, it's so old it's out of statute (can't sue) and past FCRA reporting limits (7.5 years) so all they can do is make illegal threats.  They might have changed the "information" to pretend it's more "recent", or maybe they just pulled a bunch of credit reports for some similar name in an old portfolio, and use the "debt" as cover to shakedown whoever they find, changing the "debt" to sound like some old account on the credit report.

    I have a similar call today telling me to call them at 855.717.1085 a complaint has been file against Indiv, who I don't know, my concern was how did they get my number.        The guy who got on the phone was so rude, and hung up the phone on me twice.    I had to call to get my number removed and than he hung up, than call 2nd time to ask for the name of the company and this is how I was able to google tcf associates.

    I was contacted by them yesterday they said i owed some money from an old bank account from us bank they knew alot of my personal info it was weird im gonna go to us bank tomorrow and talk to them the dates they gave me didnt add up

      Got the same exact call.   US bank knows nothing about it.  Just report them to FTC and whomever else you can.

    I've been a legitimate collector for over 40 years, I did some work for them and quickly learned they are thugs, cheats, crooks and hoodlums.  They employ people with no knowledge of collections and no regard for laws that govern collections.  Many of the accounts they deal in are way past the statute of limitations as far as legal action being taken.  They scare people by claiming to be law enforcement, by claiming they are trying to serve your interests with an affidavit of complaint which they don't have.  They do not have process servers, they do not have uniformed law enforcement coming to your house, but most of all what they don't have is the back up paperwork for any of the debts they are collecting.  They change names and phone numbers on a monthly basis.  They try to scare you and your relatives into believing the sheriff is on his way to your home, which is not true.  They also claim they are going to improve your credit score once you pay, yet they have absolutely no contact with credit bureaus.  If they know your employment they send a bogus employment verification letter and call your employer to ask what address they can have you served at.  When speaking with them they will tell you that they have the attorney on the other line and he's making the decision to settle or sue you and this is an absolute lie.  They want you to give a debit or credit card so they can charge your account monthly or bi-monthly, DO NOT give them any information at all.  I have witnessed collectors saying outrageous and sexual comments to people, including calling them the C word and other highly sleezy things.   A lot of the people who work there, including the owners are convicted felons.  DO NOT believe them or anything they say.   If you deal with ANY of these type of collectors from here or elsewhere please file a complaint with the California State Attorney General's Office or the Attorney General's office in the state where they reside.
