Anyone else getting NONSTOP Unsolicited phone calls from these idiots?
These morons are clearly violating the Federal DNC Law (calling me with Anti-Republican Auto-Dialer phone calls all day and night. I'm neither a Rep or a Dem.), as well as 18 U.S. Code § 241 AND 42 U.S. Code § 1985 for the Conspiracy Against Rights law. Will be filing a complaint against with with the BBB, the FCC and their State Attorney General. The unsolicited incoming calls are clearly smear campaign calls against one of our local politicians here in Louisiana. I wonder if they are committing the crime of Slander and Libel (Defamation) with these calls?

Political calls are excluded from the Do Not Call laws.  (It was written by Congress, which is made up of politicians who might want to use telephone autodialing in their political campaigns.)

Slander and libel (defamation) aren't generally crimes, only torts, and the party suing would have to have standing (i.e. probably only the politician smeared could sue).  As public figures, most politicians would then have to prove malice, not just damaging error.

In addition, the courts would probably give wide latitude to most political expression under the First Amendment.  Slander against government officials stopped being a crime way back, after we broke away from George III, around about 1776.

You might have a stronger case under TCPA if they were calling your cell phone.

Or if Accountable America was set up as a non-profit for purposes of soliciting funding, rather than a PAC, but was conducting advertising specifically aimed at a candidate for office, rather than an "issue".

You might, however, object to the target's political opponent, via letters, calls, or letters to the editor.  Although there are no teeth in such a complaint, pragmatism and self-interest might drive him to control his supporters if he is getting too much flak from their activiteis.

Go to Accountable America's website and add your number to their do not call list.  They also have a section for comments so you can really take your anger out on their liberal fascist organization.

In AZ we get several calls a day opposing candidate Jeff Flake.

If political callers will pay my phone bill they are welcome to call.  But I am not paying a bill for their benefit!

To be removed from un-Accountable America's calling list, go to their website (www.accountableamerica.org) and select "Do Not Call".  All you need to give is your phone number, but you can also give them a piece of your mind.  Altho, I beleive it's correct that they are exempt form the DNC registry requirements, I do intend to report them to DNC.  If DNC gets enough complaints about these political announcements and auto-dialers they may change the law.  Good luck!
p.s. we use caller id and rarely answer the phone anymore.

thanks for the website info, Virginia ... now only hope it works to be added to the do-not-call, even
if they thank you for "joining our do-not-call" list!

Don't bother going to that website unless you want to vent. I have sent them one and they still call my house ruthlessly. It sounds all fine and good that you can get your name taken off, but you don't, so if you don't want to get into anything with these idiots, than don't even bother to go to the website because it's useless. It's good to see that others hate those phone calls as much as I do.

Talk about non accountability!! They are invading my private space at least three times a week with computer generated phone calls. No way to contact them at their website. It is outrageous. I contacted my congressman's office. They are getting many calls concerning this outfit. How stupid can they be trying to get people on board & instead, just irritating them.

I got one of these calls on my cell phone.  Prerecorded non-emergency robocalls to cell phones are illegal under the TCPA unless you have given them permission.  The statute provides no exemption for political calls, and this is privately enforceable with a penalty of $500 per call or $1500 for a willful violation.  With the volume of calls these people are making, some lawyer is going to file a class action and make a fortune.

I keep getting these call too. This group is sooo annoying. I guess the best way to deflect the fact that Obama/Pelosi and other democratic leaders are forcing us into a socialist society is to make up some false accusations and call everyone with an auto dialer. P.S. can some one give me a phone number that actually works for accountable america so I can let them know that I enjoy living in a capitalist country? Also, can someone let Obama know that Pelosi is totally using him for her agenda?

These people lie on the messages. I got one condemning my congressman for not doing anything in a pelosi-controlled congress.
    Bad, paranoid liars.
Stop calling me, you are dividing America.

These people are amazingly cowardly; they know it. If they had any credibility, they would not call w/ an anonymous number and provide a way to contact them to remove your number.
The guy who founded this must be a HUGE coward.

You should be glad to be getting these calls.  It's about time you were educated, but since you obviously paid no attention in high school, I suppose you're no more interested in listening to informative phone calls.

I am so sick of these idiots.

The Federal Telephone Consumer Protection Act of 1991allows these calls BUT for all automated calls even political in nature, callers must identify themselves (which AA does) AND they must leave a number or address where they can be reached (AA being the weaklings they are, they don't).  Therefore these are NOT legal automated calls.

from § 227. Restrictions on use of telephone equipment:

    (3)  Artificial or prerecorded voice systems
The Commission shall prescribe technical and procedural standards for systems that are used to transmit any artificial or prerecorded voice message via telephone. Such standards shall require that—
    (A) all artificial or prerecorded telephone messages
    (i) shall, at the beginning of the message, state clearly the identity of the business, individual, or other entity initiating the call, and
(ii) shall, during or after the message, state clearly the telephone number or address of such business, other entity, or individual; and
    (B) any such system will automatically release the called party’s line within 5 seconds of the time notification is transmitted to the system that the called party has hung up, to allow the called party’s line to be used to make or receive other calls.

This is definately an issue to take the FCC which is what I'm doing myself.
