I too am getting sued by Mary Jane Elliott for a credit card that I never had.  I asked for verification of debt several times and even sent a certified letter asking for this.  They responded with a summons and complaint.  I responded and now I have a pretrial hearing.  I can not believe I have to pay an attorney for a debt I never had.

    Concerned & Frustrated!
    I have a court date this week with these people & after reading all these posts am very nervous.  I tried setting up an arrangement over the phone with one of their people, the girl said she would submit it & get back to me in a couple of days, I never heard back until I received my court date.  I pulled some info from the internet that I'm hoping will help me, they are rated "F" with the BBB & lost a law suit against them in July 2012 (they were bulling someone that had payment arrangements with them).  One thing I have been told is if I do make payment arrangements with them DO NOT under any circumstances give them a check or credit/debit card, that gives them my account numbers & they will be able to pull e check any time they want, pay in Money Orders OR Certified Check...something that does not have ANY account numbers on it.  I'm curious in ready these posts they have accessed people checking/bank accounts with out them knowing, how would that happen?  Fortunelty for me, I live close enough, if need be I can drive to their office & pay in cash if need be.
    If ANYONE has any advice to offer, please do!

    Insted of complaining about the debt that you owe why dont you ask them if they can cut any deals with you like they did for me they cut my debt in half i made my payments and im done and over with them. I had the debt I defulted it was my fault not theres.

    WOW! After reading all the complaints about this Mary Jane person, if that's what you want to call her, I'm glad I'm not the only one in this boat.  I agree this is my debt and I have to pay for it. I was making payments of 75 a month by money order, was never told of the debt being settled and kept sending payments. I got a letter in the mail with my money order made out to Mary Jane M Elliott pc  saying debt settled and now no one will cash this money order. I went to my bank and to 7-11 where I bought it and I called her office and the [***] Vince and Alysha said they had nothing to do with that. I said to them maybe you can piss $75 away but I live pay check to pay check and have two kids I have to provide for I was told that was not their problem When asked to talk with the supervisor they said they were at lunch, sent me to their voice mail and never go a call back. When asked to speak with Daniel J Manion I was told he didn't work at this office. If I send Western Union $15 they will refund me my $75, so I'm getting screwed by them again.  Thanks so much for all your help you scums of the Earth!! Rot in HELL

    I have made a couple payments to MJ Elliott, on a very old debt, and my next installment is a few days overdue. My husband and I are both disabled; we collect Soc Sec disability, I get long term disability, and my husband gets a pension from the Air Force. I read that she cannot garnish an account associated with disability income - Is that true??? Can we stop making payments without fear of her being able to take money from our account(s)??

    It's better to hire a lawyer if you wanna deal with her.otherwise she will ripoff you.

    The problem is that she is the problem, it doesn't matter how much you pay her ,it doesn't matter if you pay all the debt you own to her,you always are going to be in debt.
    She is always going to ask you for money, always till the day you die.
    Paying or not ,your life belongs to her and her friends.

    That's not quite true, there is always bankruptcy.....File good ol chapter 11 or 13 and they can still try and trick you into a new payment plan but they shouldn't be able to collect the debt afterwards.   Dont make my mistake, I left my tax refund in my checking account and whoops its all gone.  The debt isnt even mine, it belongs to a relative.   If you owe this agency money, sell your bonds, take the money outside of your account, and cash your paycheck instead of depositing.

    This Mary Jane Eliott PC sent my employer paperwork to start a garnishment on me shouldn't I have also received some type of paperwork myself stating this was going to happen?

      No one, not Mary Jane Elliott or any other bottom feeder, sends paperwork to 'start' judgment.  If a judgment is granted, your employer's payroll department will receive an order of garnishment in the mail and at that point, the garnishment proceeds.  clk, you're going to have to try a bit harder than that...I used to work payroll and I processed a few garnishment orders.  1.  No one receives advance notice (start judgment?  There's no such thing.)  2.  An order of judgment is never the entire paycheck.  A judge has decided that some amount is going to be garnished.  In order for the judge to determine this, the defendant has to show up to court with proof of income.  In those instances when the defendant does not show up, there is a default judgment and nothing happens unless the debt collector files for a proof of income.  What usually happens next is that the defendant is 'sort of' sought after to serve and this means that the defendant has no idea that there is another legal proceeding.  The result of this is a contempt of court order by the judge which leads to nothing, or, a bench warrant.

      This is a complicated and time consuming process.  There is no such thing as 'paperwork to start judgment.'

      Yes there is. I just got a letter about the class action. All I have to do is wait for my money.  They found me, I didn't go looking for it.

    Don't you think it's weird they always get their judgment and win.  Mary Jane is the name of the law firm to throw you off.  Wonder if they should be investigated by the govt.

      It's easy to win.. replies to Mary
      when you're unopposed.  Their "business model" appears to be based on obtaining default judgements.  Easiest way to get a default judgement is "sewer service".  (Hundreds of thousands of cases were thrown out in NY a few years back due to rampant "sewer service").  Whether you're the right "debtor" or not, without an attorney, you'll lose.  Get an attorney.

    This woman has made my life a living hell.  She supposedly purchased a very old JC Penny and/or Sears debt that had already been charged off on my credit report.  She garnished me in excess of 4 times the original debt.  I contacted them and attempted to settle the debt when I got my tax refund and they would have no part of me paying any amount that was anywhere the original debt.  Everyone I ever talked to at her office was not only rude but downright cruel.  It looks like she may finally be getting an opportunity to reap was she's been sowing as I just got notice of a class action lawsuit against her!!!  I knew this day would one day come.
