Complaint

Debra M. Persiano
Country: United States
I got a call today at home from a man stating he was a process server for Collin County DA's Office and he is with the Sheriff's office and needed to come serve a warrant on me.  I was shocked and asked why?  He stated do you live ....are you still at this address are you now at this address and I stated who are you?  He again, stated he was from the county going to serve court papers on me today. He gave me a toll free number for what he stated was the county's office which is 1 866.872.6116 gave me a case no. which he called a Cause No. 008307-TX. I called the number was transferred to a Mr. Fisher's office who stated that law suite in the amount of $6,214.24 was filed in Collin Co., Tx and that warrant was out for me.  He then after back and forth said let me get more information from my secretary and state this was for an outstanding debt in from Capital One a credit card that I obtained several years back and had disputes over interest charges etc.  He stated that if I did not want to go to court or jail that I could pay $1,951.00 in full by end of business today and this matter could be cleared up.  I explained that I recently lost my job etc.  Anyway, he stated that I needed to call him back by EOB today or they will serve the papers.  Ok, so that was a heads up for me.  I called the DA's office nothing is filed on me as of today, after searching PMG it is clear that they do not practice best practices for collections and have been in trouble for this before back in 2004.  I need someone to give me advise. I want to pay off my debt, I don't want this type of collections to continue this upset me, made my blood pressure raise, this type of collections are not the right thing to do.  Had they called and ask to make arrangements or give me an opportunity to clear the matter, rather then threaten me by taken legal action, or harassment stating they are sending a sheriff over today.  This is wrong, bad business, and should not continue this company is bad news.

    Coincidence?
I think there's a new group going by the name of Green Tree Financial that has ties to Thai Han and/or Pamela Mathews. A few months ago, I was getting messages for a relative about legal action, serving papers, blah, blah, blah. I knew it was a scam, but they keep waking up my sleeping child. When I finally called back to tell them to cut it out, I believe that Pamela Matthews right hand man (at least while she was still working under Thai) answered the phone. He just kept fishing for info under the guise of helping me out. “Are you related to the debtor?” “Do you have a way to reach him?” “What state do you live in?” He got pissy, refused to remove my number and hung up on me. I called him back, read him the riot act and must have scared him so much that he actually sounded timid. Was it the right thing to do? No, but it was a small victory.

When I kept getting calls from CMAG (under a new name) I contacted a lawyer. I had already started connecting the dots with Pamela Mathews, found the registered agent out of Nevada and kind of left it alone after I found out that I'd have to start sending a bunch of certified letters to their last known addresses. After getting a message left on my phone by Green Tree Financial (800-691-8323) my interest was renewed. A quick Google search will show that they're kind of a quiet bunch. Much smaller and selective. They are definitely trying to fly under the radar.

Their M.O. Is exactly the same – call the relatives, work phone number and neighbors of the alleged debtors to create panic. They fish for information, but in a much 'nicer' way (I can't believe I just said that) and they change their name, and then start all over again. They appear to have been in operation since at least December of 2011, but the same number that they are calling from has complaints listed back as far as 2008. I believe that the person being described as Ms. Tony also goes by the name of Ms. Way/William(s?). She speaks quickly and tries to be aggressive. Definitely not her first trip around the block. If this is the case, there may be no more than 4 or 5 working there.

I believe they chose the name Green Tree Financial with great care. Greentree Servicing, a subsidiary of Green Tree Financial (real company) is apparently a mortgage servicer that loves to screw it's customers, so there are already plenty of complaints floating around the net. Besides having a different number and a slightly different name, all complaints seem to point toward phone harassment and collection calls. Most of this is speculation, but hopefully it helps someone else out.

You are so full of it all around!
You are calling people debtors,But we are to believe that you aren't a bill collector?
You are a relative of the "debtor" but somehow you gathered all this information?
Come on Pam stop it already.....let this all go you are ONLY hurting yourself, And you do not do a very good job of masking your personal vendettas while doing so.

Warning, snark ahead replies to Pam
Are you seriously being serious right now? Really? Do you know what contextual clues are?  Conducting thorough research spread out over several months will help you to find - wait for it - more detailed information! If I were Pamela Mathews...how exactly would this help her case? Right. Anyways, I say it's more than a coincidence. But please, take what you want from it and spit out the bones.

Anyways, thanks for the links, TJ. The very last link that you posted points back to what I think is the 'real' Green Tree Financial I mentioned before. I think that they are a mortgage servicer of some kind. The Green Tree Financial that called for my relative didn't specify what type of alleged debt they were trying to collect (but really, it wasn't hard to read between the lines of the message left by the 'claims coordinator'), but when I saw all of the other comments, alarm bells started to go off.  Also, were you able to connect the 800-691-8323 number to the BBB report? That's where I'm having a problem. Since I have no idea what state that the call originated from, I can't connect this outfit to any one specific Green Tree Financial.

tj replies to Warning, snark ahead
BBB report appears to be on the "Greentree" mortgage negotiation company with the Oceanside address, but the report says no complaints in the last 12 months.  That says it was active over 12 months ago, yet complaints against the number only start in Dec. 2011.

That gap suggests they are unconnected, and maybe that the Oceanside company may no longer be in business.

Although there is sometimes cross-over between "debt negotiation" and "debt collection" companies, BBB report names all appear to be aimed at debt negotiation.

The other Greentree in CA appears to be a financial advisor, with some history as a financial advisor associated with other businesses.  Unlikely to be related.

Name may be purely a red herring.  If they take payment by credit card, they would have to have a bank account and be set up to process cc payments, but maybe that is under some other name.

I did check Wyoming LLC registrations, since the Thai Han operations layered their CA LLCs under Wyoming LLCs, but didn't find anything there under Greentree that looked remotely related.

Lacking evidence either way, we leave both possibilites on the table.

Let's see how it checks out.  https://800notes.com/Phone.aspx/1-800-691-8323

      First complaint, Oct. 2008.
Predates Bagley and Lundsford by almost a year.
"RTE Federal Credit "  phishing scam to random person who was NOT a credit union customer.
Phishing complaints stop in Oct. 2008, Number was probably reassigned.
      .
Next complaints is Dec, 2011.  .
      "GFS"
      "Green Tree Financial"
      "Granger Financial Services"
      "Miss Tony"
" a complaint against my SS# for fraudlent activity. What a joke It is a scam"
"They called me at work today. I spoke to a Ms Tony from Greentree Financial. They said that I owed $$$ for a payday loan (Companies name was CASH YES).
I explained to her that I paid it back in 2009."
"about an affidavit of my SS#.  "
"The person called and stated that an law suit is being brought against your social security number "
"stated this was a check collection and when i asked him to send my attorney the proof he got irrate and started asking me my attorneys name and location. Then he was trying to make me call my exhusband and ask for the money and then said he would call him. He never would agree to email or mail the proof. and was asking for over $800 dollars. I refused and he got very ill with me and threatened me."
      "RME ??"
"Because I paid this payday loan over two years ago and have the copy of the paid receipt in my office."
"Did some deeper checking because I can. Discovered it is a debt collection agency picking up on the bottom-feed/ old debt. They are not using the name or location for the alleged debt to contact you. But, they are using the phone numbers that were put on original loan applications. Discovered this because one of my old employee's relative applied for multiple Quick Cash Loans and defaulted, but used by office number as the point of contact."
"Ive explained its being paid through another co. that bought the loan but he will not listen."

Calling a lot of people who owe nothing.
      Many calls to employer numbers.
Same old Corona-style scripts, threats, evade validation, and have "reason" to get money regardless of whether it's owed.
Very few aliases.  Most complaints refer to "Ms. Tony".

    consumers are not being protected
It has become evident to me that the consumer is not being protected against these type of debt collection scams going on all over are country. As soon as when illegal debt collection closes another 3  pop up. Even when this thieves get caught their punishment if any is usually very minor. So why would they stop stealing from us?. The laws need to be changed or this menace is just going to continue and grow. Even with the case against lunds and bagel it's just civil. They rarely ever make it a criminal case.
Why would these thugs ever stop. Wouldn't it just be easier for them to just change their business name and phone number and keep the charade going. The laws how they stand right now are not protecting the public and there needs to be a change.

    Stewart

Someone besides Stewart, Jim and Thai tell this blog the truth about Pamela Mathews.  I’v noticed that everyone is on a subject and then all of a number one I worked with this women for 3 years at Asset Management and   ISH.  She was the pioneer and the beginning of the empire built by these 3 men.  It was sad to watch Stewart continue to demote her for doing a great Job. The more money she made them the more he took away from her.  The sad part is Jim Phelps just stood by and let him do it,  He is by far the weakest link of the three.  Stewart thinks women do not belong in a leadership position.  She was the only manager for over a year with 2 offices.  Then they had another  James Novela open his second office and decided to cut Pam’s pay by $3000 dollars. They took Wayne  Swanson and Anothony Saude out of her office along with 10 collectors she had trained then said she was not doing her job and hitting the numbers.  Then ISH for the first missed hitting 100k of course this was after they pulled over 60k in post dates and said the offices could not run per the bank.  Jim’s friend who came to train with Pam was to take over ISH. So they said that the only way Pam could get ISH back was to beat them the following month and Jim and Stewart would work ISH,  They pulled there top collectors to work at ISH Pam still doubled their number.  Was told they changed there minds and she was not getting ISH period.  That office hit 125.000 – 150,000 every month until they replaced her.  It never  hit  over $50,000 from that point on but the manager never lost the office,  Anyone who has ever worked for her knows she helps anyone who needs it,  I don’t care if it giving people money to pay there mortgage or rent or just listening when needed.  I really hope this Dana May takes these selfish idiots down.  It would be awesome that it was a strong female that wipes them out,  Just to really set the story straight un like all of their offices Pam taught everyone the FDCPA.  She did not tolerate anyone violating it.  I worked at 2 other offices of Stewarts and Jim’s and no one even new what the FDCPA was including  the manager running it. So next time you see something derogatory about  Pamela Mathews know it is just from the people she is suing Thai, Jim, and Stewart. She left that company years ago they still try to destroy her and cannot , Stay strong lady  I hope one of you women take them down

Also you may want to proof read what you are writing here some of it really does not make sense.

        Or maybe.. replies to Rubbish
the shift to many smaller offices (with correspondingly smaller revenue) was a deliberate strategy to allow increased use of illegal deceptive collection, attempting to obtain the protection of compartmentalized LLCs and additional deniability for when they are caught.

Fact is, it's still going on, and California is starting to stink like New York.

California needs to re-regulate this garbage industry, with licensing and bonding requirements to re-establish accountability.  Instead, we have the legislature apparently bought off by the payday loan industry, one of the feeder groups for this scum.

I fail to see how Pam could have run things so compliant, when everyone she trained who left shows up running the same illegal racket.

        Fraud is taught and learned.

All of Thai , and Jim's offices lost there merchant and are now having there managers put the offices in there names in order to get new merchants.  Looks like they probably all have new names again.  FYI they are opening offices out of State now because California is to hot.  Why attack the managers that are hired to do a job for these three scum bags why not go after the ones with the power and the millions of dollars  they make every month.  This Dana May lady is trying to collect on managers that don't even work for these guys anymore. Her attorney must be dumb as dirt, all the money is right in front of his face.  I don't see how he can get a dime from people who did not even work for the company,  This lady sues people for a living and does not care who it is.  If your a bill collector look out if she here's your name she will amend you into her law suit it does not matter if you work for the company or not, Counter sue her and see how she likes it I here she may be worth a few million soon ha ha

managers just has bad as owners replies to Empire Gets Slick
"Why attack the managers" The managers are not only aware of the fraud they are committing but without them this debt fraud would not be able to continue. It doesn't matter that they are not working for the company anymore. They are still responsible for all their actions whether it be past or present.
I found it amusing that you suggest a counter suit against Ms Mey. Remember you idiots only know how to threaten lawsuits but actually have no idea how to go about filing one.

that California got too hot.  This was far too easy, for far too long.

Nice to hear they lost their merchant accounts, too.

If any of you have a conscious and want to do the right thing (or perhaps avoid personal liability for a $10 million dollar judgment) email my lawyers with what you know at the special email set up for whistle blowers:  evildebthounds@gmail.com

Of if you feel comfortable, you can call them:  Marty Sheehan at 304-232-1064 or Pat Cassidy at 304-232-8100.

I have personally sued Pamela Mathews along with Thai, Jim and Stewart.  If Pam has information that suggests she is not liable, then I would encourage her to reach out to my attorneys.

Most of the other managers and key personnel that I sued have been served - and I can always amend the lawsuit to add more key players as they become known to us.

I appreciate those of you who have already come forward but time is running out for the rest of you.

Are you employed or do you just sit around hoping that the phone will ring and you can make a buck.
Do you cruise parking lots hoping someone will back up and hit you so you can file another claim?

Touch of hypochrisy, don't you think? replies to MEY
Someone catches you playing "cop", and you are upset.  Why?
Don't like the rules when they go to court, yet you threatened it all the time.

The "game" was ALWAYS about the money.  The "debt" was just a prop, to keep the callers thinking they were honest, and hold off the cops when they visited.  Since that is all you were buying, real cheap and real old was as good as anything else, no docs needed.

If you could play the game without "debt", you would.  In fact, you did.
"Spiff money" is what made the "best script ever", and it wasn't even owed.

Dumb Ms May replies to Diana Mey
Ms. Mey how many of the people you amended into your $10 million dollar lawsuit work for the office that called you?  Better yet how  many people show as the owners of the company?  It is so obvious that your trying to strong arm people into giving you information.  There must be some type of law against that.  You sued a huge corporation that more then likely makes $10 million a month and you can not get your money, maybe you should dump the attorney and pay for a private investigator before he gets you sued. A smart attorney would have already hit the bank accounts and had you paid and on to the next lawsuit.  That is what you do for a living if I heard right but it was chasing Telecommunication people before.

} "Ms. Mey how many of the people you amended into your $10 million dollar lawsuit work for the office that called you?"

I doubt you'll catch Team Diana Mey on a "party of interest" problem. Abuse from debt collectors is a systemic problem, hence the multiple respondents.

} "... your trying to strong arm people into giving you information.  There must be some type of law against that."

When your guys do it the "type of law" is the FDCPA. When someone legally "strong-arms" a violative debt collector, they call foul on a "frivolous action". There should be a law against hypocrisy.

} "You sued a huge corporation that more then likely makes $10 million a month and you can not get your money"

Winning a jackpot is not the point. The defendants are forever damaged even if they never pay up. Her ten mil award shames the FTC almost as much, which should start their damage awards against collection rogues at three times as much.

} "lawsuit.  That is what you do for a living if I heard right "

Ms. Mey's background was never a secret.

If the job of "private attorney general" blooms into a full time position, that should say something about how much effort consumer abusers pour into defending their fraudulent business models. If they only worked half so much at behaving honestly there would be no Diana Meys throwing spikes in their path.
