I got a call today at home from a man stating he was a process server for Collin County DA's Office and he is with the Sheriff's office and needed to come serve a warrant on me. I was shocked and asked why? He stated do you live ....are you still at this address are you now at this address and I stated who are you? He again, stated he was from the county going to serve court papers on me today. He gave me a toll free number for what he stated was the county's office which is 1 866.872.6116 gave me a case no. which he called a Cause No. 008307-TX. I called the number was transferred to a Mr. Fisher's office who stated that law suite in the amount of $6,214.24 was filed in Collin Co., Tx and that warrant was out for me. He then after back and forth said let me get more information from my secretary and state this was for an outstanding debt in from Capital One a credit card that I obtained several years back and had disputes over interest charges etc. He stated that if I did not want to go to court or jail that I could pay $1,951.00 in full by end of business today and this matter could be cleared up. I explained that I recently lost my job etc. Anyway, he stated that I needed to call him back by EOB today or they will serve the papers. Ok, so that was a heads up for me. I called the DA's office nothing is filed on me as of today, after searching PMG it is clear that they do not practice best practices for collections and have been in trouble for this before back in 2004. I need someone to give me advise. I want to pay off my debt, I don't want this type of collections to continue this upset me, made my blood pressure raise, this type of collections are not the right thing to do. Had they called and ask to make arrangements or give me an opportunity to clear the matter, rather then threaten me by taken legal action, or harassment stating they are sending a sheriff over today. This is wrong, bad business, and should not continue this company is bad news.

This "process server" will probably first call a relative, pretending to be trying to locate you to "serve you a summons". (Some of them are idiots, so they might say they have a "restraining order" or some other nonsense.)
They might possibly leaving a threatening message that you will be "arrested" if you don't call back "within 3 hours", or some similar BS.
Should you call back the number left, they will claim you owe them some "debt" that sounds a lot like an old account on your credit report.
It's a con.
Why would you want to contact them, unless maybe you want to collect evidence either to file a complaint or to sue them?
You won't "resolve" everything, just subject yourself to more deception, implied threats, abuse, and harassment.
Just wait for them to start contacting you.
Keep good notes and record calls.
Get paper copies of all your credit reports, as evidence that they have illegally pulled them.
Then contact FTC to file a complaint, and a consumer attorney to review your options. You might try www.naca.net
What credit report(s) did they pull?
What name(s) show up on the inquiries?
What type of inquiry was it?
Do any suspicious names (possibly different) show up under promotional inquiries?
Any client of a credit reporting agency can pull your credit report with nothing more than your name. They do not need your SSN to pull a credit report. If several names match, all those names will come up, along with choices of addresses and SSN, and they can just select one.
Despite all the pious pronouncements about protecting against "identity theft" and protecting your identity information, if you are part of the club, the system is wide open.
Identity security is basically a sham. The only protection you have is illegal access to credit reports leaves a trail, and you might sue them after the fact if you catch them.
Note that Experian's id theft prevention products are aimed at reducing business fraud losses, not consumer losses. They appear to be entirely blind to carefully constructed fake "debt collection" telemarketing fraud.

The Indian scammers usually just make fake "payday loan debt" claims, using id information from their fake "loan application" sites.
Consistent access to actual old debt information requires access to credit files. Corona Scam has been shown to have routine access to credit files.
Of current fake "debt collection" scams, Corona Scam is probably the largest single operation currently active.

There are few things more intimidating than a telephone call from a collection agency. Some scam artists have been using that fear to bully people into giving up their debit card numbers on the telephone, then draining their bank accounts, the Better Business Bureau said in a recent alert. In some instances, the callers have personal information about the target, including actual debts, making the call seem legitimate. The bureau recommended that anyone who receives a suspicious call about an outstanding debt demand written proof of the debt and never provide bank or credit card information over the phone until making sure the collection firm is legitimate.

Fake and/or Highly Questionable Collection Calls
Debt collection complaints to BBB have been on the rise in 2011, mostly due to the economy, as well as a number of questionable debt collection services overstepping boundaries and breaking “rules of engagement” regarding debt collections. With both parties desperate for the same $$, this creates a perfect hotbed for scammers to use the industry to attempt to collect bogus debts. It also creates an atmosphere where some legitimate collectors are bending rules and pushing boundaries with their collecting tactics to see how far they can pressure. While in a legitimate debt collecting situation, collectors have the rightful job of collecting, and debtors have a responsibility to make payments, what happens when you are harassed by a scam collector who won’t STOP harassing, even in the workplace?
Here are two types of scenarios we are hearing about:
Scenario #1
Collection agencies from Maine, NY, and CA call victims claiming:
*you have a debt that needs to be paid or civil and criminal sanctions will be sought
*a great deal about you, including past indiscretions, and personal and/or financial information
*(sometimes) a very old past issue that needs repayment, making it look urgent and legitimate NOW *just about anything, whether true or false, to try to convince you that you have a debt
*the ONLY method of repayment to them is via your debit card
These reports are significantly increasing. To add to confusion, scammers are spoofing phone numbers to make the incoming calls look like they are from legitimate agencies. According to law enforcement, just last week, two local Spokane collection agencies had their numbers spoofed for the purpose of scamming.

Earlier BBB alert regarding scam debt collectors with access to SSN and bank account information, commonly used in the Indian scams. Use of credit reports to get old account information is a recent domestic "innovation".

If you find that they have pulled a credit report and used that information to attempt to con you, file a fraud and extortion complaint with your local police to document the attempt.
Then file complaints with FTC and your state AG. Send them copies of the police report.
In addition, file a fraud and extortion attempt complaint with the credit reporting agency, sending it a copy of the police report. Include in your complaint that you have notified FTC that this criminal fraud ring is using their services in their scheme, and demand that they block all further access to your credit report from this scam.

OK, excuse me, but you'r wrong. I'm a new hire at one of the companies mentioned. Its a brand new office. They are legitimate and the industry is growing quickly, hence all the new subsidiaries. I am sure that its registered with the state of California because I just checked the California Secretary of State website http://kepler.sos.ca.gov/cbs.a... and they are registered and have been for some months now. Go ahead and check for your selves readers, these companies were registered months before this guys article was written! JUST MAKE SURE TO AD THE 'S' ONTO THE WORD SERVICE or the website will not find it (because you are misspelling the name of the company!), but if for example you do a search for ASSET FILING SERVICES, lo and behold there it is and it was registered in April. and dude, I do suggest you watch what you say because these legal people know there [***] and if your badmouthing them like this they might come after you for slander or something. Next time get your [***] right before spewing it out as bad advice to people in trouble. I suggest you recheck with the proper S in the spelling of the names "serviceS" and you will find they were registered months before you wrote the article.
As per the confusion on what having a case filed means, it means they have received it at the filing agency and are going to do the legwork for their clients to register the lawsuits with the courts. If people are contacting you or people who know you, is because they are preparing to serve you and to do so they must know where you stay and how to reach you in person. If they are unable to find a way to serve you, then eventually the courts will hear your case without you which usually results in a judgement for the the parties who show up (I believe that would be these companies or their clients).
The fact that a process server or whom ever contacted your people trying to make sure they would actually reach you is a rare blessing, god forbid you avoid it only to be slapped with a judgement by default because you chose not to be present in court. I strongly suggest that if they are looking you, you find a way to be served so you can represent yourself in court. They are coming for you, I know because I'm one of "them", if you don't find a way to make it to court to defend yourself, then when we do register your case with the courts and the process server tell them they couldn't find you... your probably [***]. I mean when the judge holds your hearing and the only evidence being presented is the evidence against you, and then he looks over and sees you didn't even bother to come in with counter evidence to defend yourself, hes going to rule against you 98-99% of the time.
As for the multiple mailing addresses, dude, each one of these is a company in and of itself (corporate-subsidiary or not), receiving mail for itself, they are supposed to have different mailing addresses. Imagine if the manager of company A had to sort through 7 other companies mail each time they were looking for their own. Imagine if you had to sort through all your distant relatives mail (uncles, cousins, grandparents, everyone in your bloodline over the age of 18), [expletive regarding stupidity here]. It just doesn't make sense to have agents for one company sorting through he mail of other companies just to find their stuff. And with that, [Tip of the hat] -Good day.

So they have lots of addresses, to keep their mail sorted, because they have lots of companies. And they have lots of companies, why?
They must have a full time mail flunky.

These "process servers" call with a "case number" or "docket number", but now the "case" has only been "filed" with them, not any court? And they "register the lawsuits with the courts". Sounds like what attorneys do.

They are looking so hard for you, to "serve" you for this "lawsuit", at your relatives across the country, even though they just pulled your credit report?

Even the "True Believer" isn't sure it's really a "process server". May just be "whom ever".
We are all so rarely "blessed".
