I got a call today at home from a man stating he was a process server for Collin County DA's Office and he is with the Sheriff's office and needed to come serve a warrant on me. I was shocked and asked why? He stated do you live ....are you still at this address are you now at this address and I stated who are you? He again, stated he was from the county going to serve court papers on me today. He gave me a toll free number for what he stated was the county's office which is 1 866.872.6116 gave me a case no. which he called a Cause No. 008307-TX. I called the number was transferred to a Mr. Fisher's office who stated that law suite in the amount of $6,214.24 was filed in Collin Co., Tx and that warrant was out for me. He then after back and forth said let me get more information from my secretary and state this was for an outstanding debt in from Capital One a credit card that I obtained several years back and had disputes over interest charges etc. He stated that if I did not want to go to court or jail that I could pay $1,951.00 in full by end of business today and this matter could be cleared up. I explained that I recently lost my job etc. Anyway, he stated that I needed to call him back by EOB today or they will serve the papers. Ok, so that was a heads up for me. I called the DA's office nothing is filed on me as of today, after searching PMG it is clear that they do not practice best practices for collections and have been in trouble for this before back in 2004. I need someone to give me advise. I want to pay off my debt, I don't want this type of collections to continue this upset me, made my blood pressure raise, this type of collections are not the right thing to do. Had they called and ask to make arrangements or give me an opportunity to clear the matter, rather then threaten me by taken legal action, or harassment stating they are sending a sheriff over today. This is wrong, bad business, and should not continue this company is bad news.

These guys are not even business owners (or bank account owners for that matter) anymore, but they are making false promises to keep the workers from making a scene or being fearful of losing their homes. So they pretend that they still have access to payroll, and pat you on your little heads and tell you that you "Didn't do anything wrong" and "This will all blow over after we pay off the FTC". Newsflash- the FTC already took all your money...now they want blood.

A dialer was the entry-level position. A dialers' sole purpose was to place calls intended to get the alleged debter to call back - where they would reach a junior or senior "closer".
That one of the very first tasks on the Dialers' list was to contact the alleged debtor's POE (Place of employment) and pose as a process server and threaten to disrupt the business to have a sheriff "serve a summons" - would be a dead give-away to anyone but a moron that the operation was illegal.
They were schooled on various methods of brow-beating to get info on the alleged debtor. They had a script for every eventuality; if they were told he/she was dead, etc. If they were told he/she didn't live there and was homeless, the dialer told them to get in their car and drive around the neighborhood because "homeless people are easy to find".
New dialers were warned to refrain from calling law offices "unless you're looking for trouble". Otherwise a dialer was encouraged to be creative in their effort to get the alleged debtor to call a jr/sr closer back.
That they never responded to a debt validation request is also quite telling. It's one of the basic requirements of the FDCPA.
I think its more telling that many of the former employees and ex-contractors don't have access to a credit card because Pacer is only $.08 a search. You guys doing okay financially? Are you going to be able to pay your bills in the next few months or have you already maxed out your credit cards?
For whatever reason, they still think that things will blow over. Of course, this close-knit 'family' is already showing the cracks in its armors. The owners have jumped ship and the lower level workers are starting to freak out. Maybe they won't go to jail. Losing everything that they have earned in IRS penalties would be so much better at this point. That and public humiliation. I've already googled some of the employees named to see their Linkedin pages openly admitting that they work for these outfits as 'junior closers,' as well as their criminal profiles (one guy got caught having pot shipped to his house two years ago. Yeah, real moral people here, just like I thought).

I would suggest Francis & Molinaro, but I hear they don't read all that well...
But i think there is probably some clause in our expansivelegal / judicial system that prohibits lawyers from helping to conceal the crimes of their friends / clients. You NEVER, EVER share an office with these kinda "Heavy Hitters" cause then you lose YOUR RIGHT to do business too... I guess they shoulda gone to a little better law school.
