Cannot cancel a contract signed by a minor

My 17 year-old daughter and her friends went to Bally Fitness Center. They had trial pass with them, but the employee talked them into signing a contract. When she said that she is only 17 and will be 18 in a few months, the employee changed her date of birth in the contract and said is not a problem.

When I discovered they signed the papers, I contacted the corporate office and requested that her membership with Bally Fitness Center be canceled because it was signed by a minor without parent's approval.

They responded that the contract will be canceled as soon as they have a copy of her birth certificate. I promptly sent the documents via registered mail. At the time we already started getting non-payment notices from Bally Fitness Center.

The calls from collection agency stopped for a few months but resumed again a month ago. We assumed that the contract has been canceled but apparently it was not.

I am not sure what to do as I already contacted our local attorney general, the corporate office, and FTC. They use deceptive practices to get people into signing a contract and I only hope that other people who read this will be aware of the way they conduct business.

    I have tried calling bally's so many times, you just can't get anybody on phone. the number keeps disconnecting or you get a recorded msg due to high volume calls you wait time it over 1/2 hr and then there phone disconnects.
    i've tried 800-638-1343 and 866-402-2559. anyway, I'm in Atlanta GA and the guy at Bally's conned me into giving him a check as a form of payment. immediately he voided and scanned the check into some machine. this was an authorization into EFT withdrawals from your account ! I cancelled the membership in writing, certified mail within the 7 business days per contract. so far it has been over 3 weeks and have not heard from them or got my refund back. I wish I had researched about these clowns b4 going there. I have a feeling they will continue with automatic withdrawals from my bank acct so I will be closing that acct for good. can't get thru on phone with them to discuss my cancellation. I have all my paperwork & proof of cancellation. they have NOT sent me any cancellation letter also. I went to the club and cancelled it over there also and got my 'notice of new membership cancellation' paper proof all within 7 day. reading all the post I realize they will NOT be cancelling and send this to collection agencies since they won't be getting any money. I will sue them in court and the collection agency also. anybody out there can shed some more light on this ?

    I am very unhappy about Bally.  They have the worst support that i have seen.  I have been trying to call over a week to cancel my membership.  The phone recording says that the wait time is over 30 mins and it will not let me wait but hang up my phone line. I am not pleased at all with Bally and this has been frustrating.

    I sign up for membership due to club is just couple of blocks away. However, it was closed and I don't want to go far away only for the fitness with this expensive gas price. I called request cancel but it was not done. It has been a 2 months charge after I requested cancel. If I send written cancel request, does it work? Do I need to send any more things? Thanks.

    I used EG's suggestion and you get right through. They said you have to give a ten day notice to cancel, and I asked they why you need ten days to push a button on your keyboard? They said it's our policy and you agreed to it when you signed the contract. I was able to cancel but had to pay a $10 charge through my CC, but at least i am done with them. Never again.

    The best way is to call 562-484-2000 and press 0, ask the person that you want to speak to Customer Service.  And then you can talk to a real person (instead of getting the recorded voice runaround), who will tell you what to do to cancel your contract.  Send certified mail using return receipt.

    Apparently it isn't enough to sucker adults and kids, might as well con the developmentally disabled as well.

    INDIANAPOLIS -- The brothers of an Indianapolis man claim a local gym took advantage of their developmentally disabled sibling, signing him up for a contract that he couldn't understand.

    Mark Hannon is 49, but functions at a much younger age, the family told 6News' Rafael Sanchez.

    That's why they were upset when Hannon told them that two men representing Bally's Total Fitness came to his door last week, offering to sign him up for a gym membership.

    Hannon told his brothers that the men drove him to the Pike Plaza gym, where he signed a contract and agreed to have $29.99 withdrawn from his bank account every month. He also paid $69.98 to cover the first and last month of membership, in addition to a services fee, he said.

    Hannon's apartment complex has signs posted prohibiting soliciting. His brothers called the gym's actions predatory.

    "They knew he was developmentally challenged and it did not bother them one bit," said Joe Hannon. "That's our brother. We care for him. We love him. We don't want anything to happen to him."

    The brothers told Sanchez that they went to the gym Monday hoping to resolve the issue, but that their requests were rejected by the management at the facility.

    When Sanchez went to the gym on Tuesday, a man who refused to identify himself said the matter than been taken care of, but would not offer any further explanation before showing the crew out of the building.

    Hannon's brothers said they are worried this isn't the first or last time the gym has taken advantage of someone in a similar situation.

    "I'm wondering how more people are they going to do it to? After meeting two young gentlemen yesterday, they don't feel they've done anything wrong," said Pat Hannon. "They feel it's their right to get America fit."

    6News called and faxed Bally's corporate headquarters, along with a media relations representative, but those calls had not been returned Tuesday evening.

    I joined the ballys total fitness in East HArtford on new britain  ,  i wanted to join the gym only for two months . the employee of the bally a mexican some made me signed the two years contract in Aug 2008 for $ 59 per month fee .  Since November on 2008 i am telling the bally employess that  i want to cancel my membership but they not listening . they are just just showing the contract says " it can only be cancel on medical ground ( that will be only decided by Ballys ) or you have to stay at place where on Bally in nearby of 25 miles and for this i have send proof such as utility bill , rent agreement ,state/drivers licence   id with address .
    For the Last one year i am corresponding with them , it so depressing I have to pay $59 per month for the services i dont use .
    Is there any consumer protection in USA which can protect against Ballys extortion ? This is a daylight robbery .

    Check with your state attorney general to see if any state laws apply.

    It might be worth moving, just to cancel.

    Bally doesn't seem to let anyone leave their gym. I just move in a place where I have gym access at work, and Bally doesn't want to cancel my membership. We should not have to explain why we don't want to go to their gym. What type of business practice is this?
    I told the manager of the gym that I wanted to join just for 2 months. He said "ok" and I didn't see any 3 years commitment. And here we are, I can't get them to stop my membership.

    If there is any 3 year commitment, it would have to be due to signing a contract, not just some "verbal agreement" or "policy".  You should have a copy of that contract.  Check the terms.

    If you didn't agree to any extended contract, they may still attempt to keep taking your money on a monthly basis until you close or block their access to your account, or use other excuses to claim you have to keep paying them.

    Or is there a difference between what they claim is in a contract, and what you actually signed?

    Be aware that there are common patterns to creating fraudulent contracts, for example, where one contract is presented for signing, but later a contract is alleged with altered or modified terms.  Simplest form of this is to leave some blank to be filled in later, or adding a digit to some filled in blank, such as for the length of the contract.  

    Another form is to present the contract for signing, but not providing the consumer with a copy at the time, claiming it has to be signed by the company, but a copy will be mailed later.  Then, additional pages are added, maybe even "initialed" (which is easier than full signature forgery, or the contract is modified, and either a copy is mailed, or not even mailed, since the purpose is to use it later by selling it off to a debt collector.

    Delay between original signing and providing a copy of a fabrication works to the advantage of the con, as many people will be less certain of what they agreed to with the passing of time, particularly if the alteration is close to the original form.

    I signed a three year contract. That I paid in full. Six mo. before my contract end I started receiving letters from creditors. I called and told them I paid my contract in full. Then they told me it was from a membership 11yr. ago. I called Bally's to find out why I was not notified about the previous membership. They said it had nothing to with the new membership. I replied "I would have paid the money I owed on the old membership instead of getting the new membership.  I did not renew the second membership and they are still billing me. I completed my contract and I still cannot get them to stop billing me.

    I signed up in 2001, went for a while and stopped going because of the long lines for machines.  I kept paying because I kept thinking I would go, but have not been there in over 3 years.  Finally about 3 months ago I started the battle to cancel my membership.  I was out of the contract and was month to month, but they “never received the request to terminate” until this month.  I have sat on the phone for hours trying to cancel, I have filled out the cancelation request online all to no avail.  Finally after several hours today on the phone with a supervisor (Charles Redard) who kept saying that If I had proof that I had cancelled he may be able to help…  Hello there is no confirmation e-mail from Balley’s showing that the form went through online.  Then he was saying to should have sent a letter, again there is no proof that I sent them a letter.  Balleys has done a great job of holding all of the cards and when they finally want to acknowledge that you sent in a termination request there is nothing you can do to prove that it was the 20th time you sent it in.

    I am definitely going to try to talk with Michael Sheehann the current CEO, I found a phone number of 773-399-1804 And an address of 8700 West Bryn Mawr Chicago IL 60631.

    I would encourage all of us to file something together, is there a lawyer among us?  If not maybe the Attorney general and the BBB could be of some assistance.  It is an utter outrage to see them taking advantage of children, disabled people and the others of us who just want out from under them.  Fortunately there are other places to go work out, but it sucks that I have to keep paying them after I cancelled.  I would have said until I died but I am sure that they would still send bills and require a death certificate to stop billing you.  They even asked me after 2 hours on the phone if I would like to keep my membership…Talk about crazy!

    Please forward this information to anyone else we need to make our voices heard, they are the worst company as far as cancellations.

    Very upset after reading all these comments. Before coming on here i thought i was the only one going through it with this gym. I HATE THIS GYM , the customer service is horrible!. I will not make any payments to them it seems like all they do is lie to people to get money ...

    Bally's sent me a renewal notice for $99.99/yr. The notice says
    Credit Card, Check or Money Order. I figure if I pay with Money Order
    they can not charge additional fees. They do not have my checking account or credit card info. Will it work?

    I totally agree with you I HATE THIS GYM! I was lied to also and want out. I have written two letters stating what they said on how to cancel and both  were denied. No one knows what is going on in customer service, I am not sure what to do but I will fight this!

    I an gald there are web sights like this that people can warn others of there issues with Bally's I was getting ready to go goin there tomorrow and now after looking at at all of these complaints I will be going to the nicer and newer gym a block away from them the $5 more a month seem well worth it anfter hearing all of htese horror stories. Sorry for all of the problems everyone has had with this company hopefully there will be a lawsuit against and everybody with complaints will be reimbursed!

    Agreed with you Natalie. That's the samething The Customer service of Ballys told me when I tried to cancel my month to month contract.They still charging me eventhough, I already cancel it. I try to cancel my personal trainer which was not doing her job at all. For only one visit they charged me about $750 and I am still due for another &370. The customer service was so rude said, you only can cancel this personal trainer if you are permanently disable. What was the meaning? I think they waiting for me to loose my leg or my hands then they will cancel my membership. I think we need to let everyone know, don't ever used Ballys services. I am so confused what should I do with the remaining bills for one time using a personal trainer. they should change their customer service provider, we need sweet voice of customer service .
